RECOMMENDED ACTION:
98 -7* Approval of Resolution No. approving the Stipulations with Request for Award which
authorizes the payment of $13,680.00 to Peter McKenzie.
ITEM EXPLANATION
The claimant is a Fire Engineer in the Carlsbad Fire Department. Mr. McKenzie developed low back
pain in October of 1996. Later he developed a numbness in his left leg and surgery was subsequently
done for a herniated disc, which was determined to be an industrial injury.
Mr. McKenzie was declared permanent and stationary on June 25, 1997, and was given a work
preclusion of no very heavy lifting and the provision of future medical care. He is able to continue in
his usual and customary occupation as a Fire Engineer.
The terms and conditions of the Stipulations with Request for Award (on file in the Risk
Management office) is based on the disability rating provided by the State of California, Office of
Benefit Determination and recommended by TRISTAR.
FISCAL IMPACT
The cost of the settlement is $13,680.00 and the provision of future medical treatment.

3 CARLSBAD, CALIFORNIA, AUTHORIZING THE
EXPENDITURE OF FUNDS FOR SElTLEMENT OF THE
4 WORKERS’ COMPENSATION CLAIM OF PETER MCKENZIE
5 WHEREAS, TRISTAR, Third Party Administrator for the City of Carlsbad, has
6 recommended a settlement of the Workers’ Compensation claim of Peter McKenzie; and
7 WHEREAS, there are sufficient funds available in the Workers’ Compensation Self-
8 hsurance Fund to pay the settlement,
9 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
10 California, as follows:
11 1. That the above recitations are true and correct.
12 2. That the expenditure of $13,680.00 from the Workers’ Compensation Self-Insurance
13 Fund is authorized for the settlement of said claim.
14 3. That the Council Accept the Stipulations with Request for Award on file in the Risk
15 Management office.
16 PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the
17 City of Carlsbad on the 24th day of March 1998, by the following vote, to wit:
