REQUEST FOR AUTHORITY TO DESTROY RECORDS CITY ATTY. m KEPT BY THE CITY ATTORNEY’S OFFICE CITY MGR. 23 RECOMMENDED ACTION: Adopt Resolution No. 98-l 17 ITEM EXPLANATION: authorizing the destruction of certain files. This agenda bill is part of a continuing Record Management Program for City departments. Adoption of the Resolution will complete the destruction of obsolete and unnecessary files in the City Attorney’s office. Government Code section 34090 provides authority for destruction of documents that are more than two years old and are no longer required. Authorization of the City Council is required prior to the destruction of any documents. The documents listed in Exhibits “A” and “B” have been reviewed in accordance with the provisions of section 34090 of the Government Code, and meet those requirements, and the City Attorney has consented to their destruction. The documents listed in Exhibit “B” are housed off-site at the Palomar Storage facility. FISCAL IMPACT: None. EXHIBITS: Resolution No. 98-l 17 Exhibit “A” list of records to be destroyed Exhibit “B” list of records to be destroyed RESOLUTION NO. 98-l 17 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 CARLSBAD, CALIFORNIA AUTHORIZING THE DESTRUCTION OF CERTAIN RECORDS KEPT BY THE 4 CITY ATTORNEY. 5 The City Council of the City of Carlsbad resolves: 6 1. That pursuant to Section 34090 of the Government Code, the City 7 Attorney is authorized to destroy records over two years old as shown on Exhibits “A” and 8 “B”. 9 10 2. This resolution shall not authorize the destruction of any record which 11 the City Attorney deems is necessary for the ongoing or current activity of the office of the 12 13 14 15 16 17 18 City Attorney.
