RECOMMENDED ACTION:
Adopt Resolution No. 98-118 approving and authorizing Mayor to sign
Amendment No. 2 and Extension to Agreement with Western Temporary
Services, Inc. and appropriating additional funds to increase contract
amount for additional adult school crossing guards for Magnolia and
Buena Vista elementary schools.
ITEM EXPLANATION
The City entered into a contract for adult crossing guard services with
Western Temporary Services, Inc. on June 11, 1996, to provide crossing
guard services at six locations. This contract was for the period July 1,
1996, through June 30, 1997, with the option to renew for three additional
one-year periods. Amendment No.1 to Agreement, effective December 1,
1996, was approved by the City Manager on February 20, 1997, and added
crossing guard services at two intersections. On July 17, 1997, an
Extension of Agreement was approved by the City Manager extending the
agreement with Western Temporary Services, Inc. for a period of one year
ending June 10, 1998. The current annual contract is approximately
$38,700.
Staff has received requests for the City to provide funding for adult crossing
guards at two additional intersections. These intersections are Monroe
Street and Magnolia Avenue serving Magnolia Elementary School and Las
Flores and Interstate 5 southbound on-ramp serving Buena Vista
Elementary School. Traffic Engineering has evaluated these locations
based upon criteria contained in the Caltrans Traffic Manual for Adult
Crossing Guard warrants and recommends that one adult crossing guard
be provided by the City at each location.
The extension for services through June 30, 1999, will provide crossing
guard services for an additional one-year period and will bring the contract
period back to a fiscal year cycle.
FISCAL IMPACT:
The estimated cost to provide crossing guard services for the above two
locations for the remainder of the fiscal year is $4,000. There are sufficient
funds in the Council contingency account in the general fund.

RESOLUTION NO. 98-118
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, RATIFYING A SECOND
AMENDMENT AND EXTENSION OF AGREEMENT
BETWEEN THE CITY OF CARLSBAD, CALIFORNIA AND
WESTERN TEMPORARY SERVICES, INC., FOR ADDITIONAL
SCHOOL CROSSING GUARD SERVICES AND
APPROPRIATION THEREFORE
WHEREAS, the City first entered into an agreement with Western
Temporary Services, Inc., on June 11, 1996, to provide crossing guard
services at six locations; and
WHEREAS, an amendment to the agreement to add two locations
was approved effective December 1, 1996; and
WHEREAS, an extension of agreement was approved July 17, 1997,
extending the agreement through June 10, 1998; and
WHEREAS, it is necessary and desirable to amend said agreement
to add two additional locations for adult crossing guard services, and to
extend its term through June 30, 1999.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Amendment No. 2 and Extension to the Agreement
for Crossing Guard Services attached hereto between the City of
Carlsbad and Western Staff Services, is hereby ratified.

3. That the Mayor of the City of Carlsbad is hereby authorized and
directed to execute said agreement for and on behalf of the City of
Carlsbad, California.
4. The City Council hereby appropriates $4,000 from the
Council contingency account to the police traffic division.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 21 day of April , 1998, by
the following vote to wit:

AMENDMENT NO. 2 AND EXTENSION TO AGREEMENT
This Second Amendment and Extension is entered into and effective as of the
23rd day of March. 1998, amending and extending the agreement dated June 11.1996,
by and between the City of Carlsbad, a municipal corporation. hereinafter referred to as
"City", and Western Temporary Services, Incorporated, hereinafter referred to as
"Contractor", for school crossing guard services.
RECITALS
WHEREAS, the parties entered into the initial agreement on June 11. 1996,
which identified a scope of work and places and times the Contractor would have
available school crossing guards:

WHEREAS, the parties entered into Amendment No. 1 to Agreement on
December 1,1996, adding additional sites for service:

WHEREAS, the parties entered into an Extension of Agreement on June 11,
1996, extending service through June 10,1998:
and
WHEREAS, it is now necessary and desirable to add further sites and extend the
agreement.
NOW, THEREFORE, in consideration of these recitals and the mutual covenants
contained herein, City and Contractor hereby agree as follows:
I. Paragraph 3 is amended by the addition the following after the existing last paragraph
(as supplemented by Amendment no. 1); "The crossing guards shall be stationed one
(1) each at the following intersections:
i. Monroe Street and Magnolia Avenue
j. Las Flores and Interstate 5 southbound on-ramp
The guards must be posted two (2) times each day at (1) 7:30 a.m. to 8:20 a.m. at
location a and 7:25 a.m. to 8:15 a.m. at location b, and (2) 2:25 p.m. to 2:55 p.m.
Monday through Wednesday and Friday, and 1:25 p.m. to 1:55 p.m. on Thursday, at
locations i and j. above."
2. Paragraph 4 is amended to extend said agreement through June 30,1999 as follows:
This Contract shall be for the period from June 11.1998, through June 30,1999, with
the option to renew for one additional one (1) year period."
3. All other provisions of the original agreement as amended to-date, and not amended
by this amendment and extension, shall remain in full force and effect.
4. All requisite insurance policies to be maintained by the Contractor shall include
coverage for the amended scope of work.

RE: CROSSING GUARD AGREEMENT
Enclosed for your records please find a copy of the Agenda Bill and Resolution that
were approved by Carlsbad City Council on April 21,1998. Also enclosed is a copy of
the signed Amendment No. 2 and Extension to the existing agreement with your
company to provide crossing guards at designated locations within the City of Carlsbad.
We are still waiting for proof, from you main office or corporate headquarters, of your
“authority to bind” or to be a sole signature on documents for a branch of Western
Temporary Services, Inc. As this documentation has not been required of you before,
the Attorney’s Office has processed your agreement, with the assurance of Lynn
Diamond, Carlsbad Police Department, that you would be providing it soon. Please call
the City Attorney’s Office at (760) 434-2891 if you have problems with this request.
Please send the required documentation to the Carlsbad City Clerk‘s Office, 1200
Carlsbad Village Drive, Carlsbad, CA 92008; with a note indicating that it is for the
Crossing Guard agreement.
