ENG CITY MGR. ?-- RECOMMENDED ACTION: Adopt Resolution No. 9 8 - I Yo accepting bids and awarding Project No. 3511 for the construction of the Beach Access Stair Reconstruction to Sean Malek Engineering and Construction, Inc., or in the event Sean Malek Engineering and Construction, Inc., fails to execute the contract documents and provide suitable bonds and proof of insurance, award the contract to Wakeham-Baker, Inc. ITEM EXPLANATION: On March 3, 1998, City Council authorized the advertisement of bids for the construction of the Beach Access Stair Reconstruction at two locations as shown in the project plans. The Purchasing Department received nine (9) sealed bids on April 16, 1998, as shown in Table 1. This project will provide for the reconstruction of the existing concrete stairs and handrails at the north end of Ocean Street and for the reconstruction of portions of the existing concrete stairs and landing platforms opposite Cherry Avenue. To comply with the Coastal Development Permit (CDP 97-50), the contractor is required to complete the project by July 2, 1998. This tight timeframe will require the contractor to respond in a timely manner in submitting his bonds and insurance. All bid documents submitted by Sean Malek Engineering and Construction, Inc., and Wakeham-Baker, Inc., have been reviewed by staff and found to be in order. Staff recommends that Council award the contract for the Beach Access Stair Reconstruction to Sean Malek Engineering and Construction, Inc. Because the work being performed under this contract is for beach access and because the access is highly desirable to be restored as early as is feasible, staff recommends the City Council authorize a contingency award. This would allow a rapid process to award to the second bidder should the low bidder fail to execute the contract documents and provide bonds and insurance in a timely manner. Increases in contract costs will be paid for by the lo,w bidder’s bid bond company if such default should occur. Staff further recommends that in the event that Sean Malek Engineering and Construction, Inc., fails to provide executed contract documents, suitable bonds and proof of insurance to the City Purchasing Officer within twenty days from May 12, 1998 and upon recommendation of the City Manager, the contract for the Beach Access Stair Reconstruction be awarded to Wakeham-Baker, Inc. I Page 2 of Agenda Bill No. / Y, b: 0 ENVIRONMENTAL REVIEW: On December 17, 1997, the Planning Commission adopted Resolution No. 4211 approving a Coastal Development Permit (CDP 97-50) for the project. On May 6, 1998, the Planning Commission adopted Resolution No. 4245 approving an amendment to the Coastal Development Permit. On December 19, 1997, a Notice of Exemption for a Categorical Exemption (Section 15301 Class 1 (d)), was issued by the Planning Director in compliance with Section 21152b of the Public Resources Code (California Environmental Quality Act). The project incorporates construction features and procedures that will satisfy the requirements of the environmental approval and permit. FISCAL IMPACT: Table 2 shows City staffs estimate of the costs for constructing this project. Funds in the amount of $182,200 have been appropriated for this project. Staff anticipates no additional funds will be required for this project. Unused funds will be returned to appropriate accounts upon completion of the project. Table 2 EXHIBITS: 1. 2. Location map. WHEREAS, plans have been reviewed by the City Council of the City of Carlsbad for the construction of the Beach Access Stair Reconstruction, Project No. 3511; and WHEREAS, bids have been received by the City of Carlsbad for the construction of said project; and WHEREAS, the low bid received to construct said project was submitted by Sean Malek Engineering and Construction, Inc., in the amount of $91,467; and WHEREAS, the low and second lowest bid received to construct said project submitted by Sean Malek Engineering and Construction, Inc., and Wakeham-Baker, Inc., are responsive; and WHEREAS, the total estimated costs for said project if performed by Sean Malek Engineering and Construction, Inc., are $156,807 and if performed by‘wakeham-Baker, Inc., are $174,532; and WHEREAS, Council has previously appropriated $181,900 for design, construction, administration and inspection of said Project; and WHEREAS, rapid progress in completing the work is highly desirable; and WHEREAS, City Council finds that failure by the low bidder to provide the requested executed contract, bonds, and insurance and to begin work within twenty days is sufficient to find the low bidder in default. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the bid of $91,467 by Sean Malek Engineering and Construction, Inc., for Project No. 3511 for the construction of the Beach Access Stair Reconstruction is accepted, and the Mayor is hereby authorized to execute a contract therefor. That the bid of $105,102 by Wakeham-Baker, Inc., for Project No. 3511 for the 2 construction of the Beach Access Stair Reconstruction is accepted, contingent on the failure of 3 Sean Malek Engineering and Construction, Inc., to provide executed contract documents, 4 suitable bonds and proof of insurance to the City Purchasing Officer within twenty days from the award. For good cause shown, the City Manager may grant reasonable extension of this time 5 period. The Mayor is hereby authorized to execute a contract therefor under said contingency. 6 4. That in the event Sean Malek Engineering and Construction, Inc., be found in 7 default and a contract is executed with Wakeham-Baker, Inc., for construction of Project No. 8 3511 for the construction of the Beach Access Stair Reconstruction, staff is authorized to seek g bid bond funds from the bonding company of Sean Malek Engineering and Construction, Inc., to 10 pay the difference in construction cost. 11 5.
