CA CITY MGR. + 67 RECOMMENDED ACTION: If you concur, your action is to introduce Ordinance No. AIS- 442 , approving the amendments to Chapter I .12. ITEM EXPLANATION: This is a technical cleanup amendment of the Municipal Code provisions regarding elections. While the law is unchanged, its source moved to different places in the state codes. Elections Code section 6555 is now Elections Code section 8106 and Government Code section 36503.5 is now Elections Code section 10403.5. FISCAL IMPACT: There will be no fiscal impact as a result of this amendment. ENVIRONMENTAL REVIEW: This technical cleanup amendment is a ministerial act, statutorily exempt from CEQA pursuant to Public Resources Code section 21080(b)(l). EXHIBITS: . Ordinance No. NS- Liqb Redline/Strikeout version of amendments . 1 2 3 4 5 6 7 6 9 10 11 12 16 19 20 21 22 23 24 25 26 27 28 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING TITLE 1, CHAPTER 1.12 OF THE CARLSBAD MUNICIPAL CODE RELATING TO ELECTIONS TO BRING IT INTO COMPLIANCE WITH STATE CODES The City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: That Title 1, Chapter 1.12, Section 1.12.010 of the Carlsbad Municipal Code is amended to read as follows: “1.12.010 Candidate’s filing fee. A filing fee of twenty-five dollars is established for a candidate’s nomination papers for elective offices at municipal elections held in the city. The filing fee shall be paid to the city clerk by each candidate for an elective office at the time the candidate’s nomination paper is filed with the city clerk. The city clerk shall pay to the city treasurer all fees received which shall be deposited in the general fund. Notwithstanding the provisions of this section, a candidate may, in accord with Section 8106 of the Elections Code, in lieu of all or part of the filing fee, submit a petition containing the signatures of four registered voters for each dollar of the filing fee.” SECTION 2: That Title I, Chapter 1 .I 2, section 1.12.020 of the Carlsbad Municipal Code is amended to read as follows: “1.12.020 Date for general municipal election. Pursuant to Section 11403.5 of the California Government Code, the general municipal election for the city shall be held on the same day as the day of the statewide general election.” EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption.
