Adopt Resolution No. 98 - 1 8 $ approving a quitclaim for an easement originally dedicated to the City of Carlsbad for the Ranch0 Carrillo Park access.
ITEM EXPLANATION:
This is a request by Continental Ranch, Inc., the owner of the Ranch0 Carrillo property to quitclaim
the City’s interest to an existing access easement for the Ranch0 Carrillo Park. In accordance with
the restated Ranch0 Carrillo Parks Agreement between the City of Carlsbad and Continental
Ranch, Inc., the Community Services Department has agreed to the quitclaim of the old existing
access easement from Palomar Airport Road. An access easement via the new roadways
constructed for the Ranch0 Carrillo subdivision project provides for the new park access.
The old easement is no longer necessary and staff recommends that Council approve the quitclaim
request.

None. Actual access road no longer exists.

A strip of land, 60.00 feet in width, for road purposes lying within portions of the
North Half of Section 19 and the South Half of Section 18, Township 12 South, Range
3 West, San Bernardino Meridian, according to Official Plat thereof, in the City of
Carlsbad, County of San Diego, State of California, the centerline of said strip being
described as follows:
Beginning at the North Quarter Corner of said Section 19, from which the Northwest
corner of said Section 19 bears North 89”39’01” West; thence North 86” 11’20” West
329.50 feet; thence South 15”16’35” West 1410.75 feet; thence South 24”54’09”
West 59.00 feet to the TRUE POINT OF BEGINNING; thence retracing the last

II RESOLUTION NO. 98-182
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A QUITCLAIM FOR AN
ACCESS EASEMENT ORIGINALLY DEDICATED TO THE CITY FOR THE RANCH0 CARRILLO PARK.
WHEREAS, Continental Ranch, Inc., has submitted a request for quitclaim of an access
easement which was originally dedicated to the City of Carlsbad over a portion of their property
known as Ranch0 Carrillo; and
WHEREAS, in accordance with the restated Ranch0 Carrillo Parks Agreement between
the City and Continental Ranch, Inc., the old access easement is not now nor is it contemplated
to be needed in the future; and
WHEREAS, the City Council of the City of Carlsbad has determined it to be in the public
interest to quitclaim said easement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Quitclaim Deed releasing the City’s interest to an existing easement for
park access to Continental Ranch, Inc., which is on file with the City Clerk and is incorporated by
this reference is approved;

1 3. That the Mayor is authorized to execute the original Quitclaim Deed and the City
2 Clerk is hereby authorized to cause the original Quitclaim Deed to be recorded in the office of the

RE: QUITCLAIM OF ACCESS EASEMENT FOR RANCH0 CARRILLO PARK -MP-139
Enclosed for your reference are copies of Council Agenda Bill 14,718 and Resolution
No. 98-182 which were approved by the Carlsbad City Council on June 16,1998.
Also enclosed are copies of the signed Quitclaim Deed of Easement and our letter to
the Recorder’s Office requesting recordation.
Normally, a quitclaim deed is sent to the grantee who has it recorded. This time
Engineering instructions were for the City Clerk to have the document recorded, and it
was prepared with the Ciis return address on it.
The City does not need the original recorded quitclaim deed. I have placed a note in
our “transmittal to Recorder files” directing the original Quitclaim Deed be sent to your
attention when it is returned by the Recorder’s Office. It can take up to 7 weeks for a
document to be returned to us after recordation. I hope that this does not present a
problem for you.
