Conduct Public Hearing on the proposed Bridge and Thoroughfare District No. 3. After receiving public testimony, close the Public Hearing and, if the Council desii Resolution No. 9 .%- I%% , overruling and denying protests and establishing E Thoroughfare District No. 3 (Cannon Road West) to finance the costs of ma improvements in said City. ITEM EXPLANATION: On May 19, 1998, the City Council declared its intent to establish Bridge and Thoroughfa No. 3 (Cannon Road West) and directed staff to set this matter for a public hearing on June 1 Notice of hearing was mailed to all property owners inside the district as well as property owr 300 feet of the boundary of the district as required by law. Only protests from those proper inside the district will be counted to determine whether a majority protest exists from the area be benefited from the proposed improvements. Also on May 19, 1998, the City Council approved the Engineering Report dated April 161 19’ proposed Bridge and Thoroughfare District No. 3 (Cannon Road West) which did the followin! 1. identifies the proposed area of benefit for the District as shown on the map entitled ’ Boundaries of Bridge and Thoroughfare District No. 3 (Cannon Road West)” which i as Appendix “E” of the Engineer’s Report. Identifies the total costs for the roadway as $19,678,329 which may be adjusted in after the construction is completed and more accurate costs are determined. Proposes the method of allocating costs to the area of benefit as follows: The fee is $124 per average daily trip (ADT) in Benefit Zone B. In Benefit Zone A, $124 per average daily trip (ADT) less the amount assessed in Assessment Distric (Carlsbad Ranch). This fee may be adjusted in the future based on changes in development, such as a the number of ADT’s brought about by a general plan land use change or more construction costs. The one time fee will be paid upon development of the property i the time building permits are issued. 2. WHEREAS, the City Council of the City of Carlsbad, California has, by Res1 declared its intention to order the formation of a bridge and thoroughfare district, as aut1 under Section 66484 of the Government Code of the State of California, and specific authorized by Section 20.08.140 of the Municipal Code of the City of Carlsbad; said distric known and designated as BRIDGE AND THOROUGHFARE DISTRICT NO. 3 (CANNON WEST) (hereinafter referred to as the "District"); and WHEREAS, the Assessment Engineer did submit a "Report" generally setting fo describing: (a) the boundaries of the area of benefit; (b) the estimated costs for the cons of the facilities; and (c) a method of allocation of the costs to the area of benefit; and WHEREAS, the legislative body has now conducted a duly noticed public hearing purpose of considering the establishment of said District, and all persons have I opportunity to speak either in favor of, or in opposition to, the proceedings and establish1 the District; and WHEREAS, protests have not been received from the owners of one-half (1/2: property to be benefitted by the facilities; and WHEREAS, this City Council now desires to proceed with the establishmenl District. AREA OF BENEFIT SECTION 4. That the area of benefit encompassed within the boundaries of the include all those properties benefitting from the proposed improvements. That the "Report" as submitted by the Assessment Engineer, setti the: (a) boundaries of the area of benefit; (b) estimate of the costs; and (c) method of all is herein approved and adopted, and a copy shall be kept on file in the Office of the City ( IMPROVEMENTS SECTION 6. That the total improvements, a portion of which are to be funded this District shall generally consist of the following: Full width grading of the roadway, all curbs, gutters. sidewalks, base an pavement, median landscaping and irrigation, median hardscape, street light! street monumentation, storm drainage facilities, erosion control, guard rails, an other incidentals necessary to complete a four-lane majoip arterial roadway. The cost estimate, as set forth in the "Report" of the Engineer, reflc total estimated costs for the proposed works of improvement, and the method of fee al represents a fair method of allocation of the costs to the area of benefit. The above unfunded fees, as set forth in the "Report" of the Er shall be applicable to all property within the area of benefit, except for publicly owned I and said fees shall be payable as a condition of issuing a building permit for the pro1 portions of the property to be developed. TIME FOR PAYMENT SECTlON9. The above fees, as set forth in the "Report" of the Engineer, s applicable to all property within the area of benefit which is not exempted on the bene map, and said fees shall be payable as a condition of issuing a building permit for the proF portions of the property to be developed. CREDIT SECTION IO. Landowners, developers and subdividers may be entitled to receivc for the construction of the major proposed bridge and thoroughfare improvements, as autt by these proceedings, said credit is limited to the total amount of Bridge and ThoroL District fee which would be payable by the developer but not-to-exceed the Estimated ( the Improvements. This financing program is required pursuant to condition1 approval for Local Facilities Management Plans (LFMP) for Zones 8, 13 and 24. also necessary to provide an ultimate secondary access to a portion of Phase V of Carlsbad Research Center pursuant to a project condition of approval for Carls Tract 85-24, Unit No. 5, which is in Zone 5. This report includes a project description and cost estimate for Cannon Road W an identification of existing funding sources, a description of the area of bel (including those properties which have a responsibility and a specific benefit from construction of Cannon Road West), a description of the fee calculation methodolc an estimate of the average daily traffic projections from undeveloped properties WI the beneffi area, and a recommended fee structure. BACKGROUND As a result of approved Local Facilities Management Plans (LFMP) for Zones 8 and 24, conditions were imposed requiring a guarantee for the construction of Car Road West prior to the recordation of any final maps or the issuance of buil permits. B8TD No. 3 (Cannon Road West)S.doc 4/16/98 -1- 0 0 DESCRIPTION OF IMPROVEMENTS The road segment covered under this fee program includes the completion of Can1 Road to major arterial standards from Car Country Drive to El Camino Real (herea known as Cannon Road West). These remair improvements would include the following: Paving beyond the 36-foot paved section, outside curb and gutters, sidewa street lights, any frontage landscaping and irrigation, median landscaping i irrigation, median hardscape, and any other frontage improvements which wc normally be required of the adjacent development projects. For the purposes of calculation of the Cannon Road West fee, the cost of the front; improvements along properties which have a general plan designation of open sp and which are environmentally constrained, are shown as “eligible frontage costs” E included in the “common improvements.” These costs are not a frontage obligatio1 the adjoining property owner. COST ESTIMAT€S The cost estimates for the project improvements were prepared using the latest F revisions for Cannon Road West as prepared by O’Day Consultants. The detailed construction cost estimate for that portion of the improvements fi Leg0 Drive to El Camino Real that is shown in Appendix A was prepared by O’Day construction bidding purposes. Table 1 summarizes the overall project cost estim, including incidental costs, for the proposed Bridge and Thoroughfare District No. 3. A portion of the improvements from Car Country Drive to Leg0 Drive was construc by Assessment District No. 95-1 (Carlsbad Ranch) and assessed to benefiting parc in the assessment district. The cost of this portion of the improvements that already been constructed is shown in Table 1. Those parcels in Assessment Dis No. 95-1 will receive a credit for the amount of their assessment. These five fund sources are as follows: H Transnet Highway Funds Cannon Road West is designated on the Regional Transportation Improvemc funds. This allocation will be indexed to the present date. The current inde) amount is $4,193,000. The Transnet funds, administered by the San Die Association of Governments (SANDAG) are limited to funding one-half of * construction costs of a basic four-lane facility, excluding outside curb i gutter, sidewalks, street lights, median landscape, and median hardsci improvements. The detailed cost estimates presented in Appendix A includl column entitled "Common Improvements" which basically includes the fac costs eligible for Transnet funding. One-half the amount of this colu exceeds the amount previously allocated. The area includes portions of LFMP Zones 1, 5, 8, 13 and With two exceptions, each of the properties within the proposed benefit are obligated by virtue of a condition of development approval, or LFMP requiremeni finance all or some portion of Cannon Road West. The relationship betw developing properties within the area of benefit and the need to construct Car Road West is discussed in more detail on a zone by zone basis in the folio\ paragraphs. LFMP Zone 1 There is only a portion of one parcel in LFMP Zone 1. This parcel has an open SI designation and therefore is exempt from the proposed fee. B&TD No. 3 (Cannon Road West)5.doc 4/16/98 -5 e LFMP Zone 5 There are 20 parcels in LFMP Zone 5 that are included within the proposed are; benefit. The 18'parcels designated as Map No. 30 through 47 are fully develo parcels created with Phase V of the Carlsbad Research Center (CRC). These parcels are subject to a tentative map condition of approval which requ construction of a secondary access prior to issuance of building permits on any of parcels. Secondary access would occur with the extension of Faraday Avenuf Cannon Road and Cannon road east to El Camino Real or west to the exis terminus of Cannon Road. Interim secondary access may be allowed by the City f Camino Hills Drive to El Camino Real; however, City approval of the interim seconc access is conditioned upon the owner's participation in the financing of Cannon R West. The remaining two parcels, designated as Map No. 28 and 29, are undeveloped Phase V of CRC and therefore, any development of the property would be subjec the same requirement for secondary access as was applied to the CRC properti For this reason, these two properties are included within the proposed area of bel for the Cannon Road West facility fee. LFMP Zone 8 There are four parcels in LFMP Zone 8 that are included within the proposed are benefit. All properties within LFMP Zone 8 are subject to a LFMP requiremer guarantee funding of Cannon Road from El Camino Real to Car Country Drive pric development of the property. LFMP Zone 8 properties which have been excluded from the area of benefit incl City owned property in Macario Canyon and privately owned properties located on north shore of the Lagoon. The property within Zone 8 located on the north shor the Lagoon will access the freeway and other regional routes by way of Park L and Tamarack Avenue and thus were not included in the proposed facility program. LFMP Zone 13 There are 14 parcels in LFMP Zone 13 that are included in the proposed are benefit. Each of these parcels is subject to a LFMP requirement to financ participate in the funding of all or some portion of Cannon Road West. Sek parcels in LFMP Zone 13 located along Paseo Del Norte and Armada Drive are within the area of benefit and would not be subject to the Cannon Road West Fa Fee. These excluded parcels are considered to have responsibility for and be do not have any development approvals. Access to these parcels must occur thro B&TD No. 3 (Cannon Road West)S.doc 4/16/98 -6- 0 0 from Palomar Airport Road and were included in both Assessment District (A.D.) 86-1 for the construction of Palomar Airport Road from Paseo Del Norte to Palor Oaks Way, as well as A.D. No. 95-1 (Carlsbad Ranch) which acquired the lien for f No. 86-1 on the parcels in A.D. No. 95-1. LFMP Zone 24 There are 241 parcels in LFMP Zone 24 that are included in the proposed are: benefit. The existing mobile home park within Zone 24 is not included within the a of benefit. The approved Zone 24 LFMP requires that a financing plan guarantee the construction of Cannon Road from El Camino Real to Car Country Drive approved by the City prior to any development occurring within the zone. 1 requirement was placed on development within Zone 24 because the traffic Cannon Road West generated by the development of Zone 24 is projected to exo the Growth Management threshold requiring implementation of a financing F requiring construction of the facility. METHODOLOGY TO DETERMINE FEE Since Cannon Road West is a major arterial roadway, and future parcels will E access to this arterial by means of collector roadways, the measure of average d trips (ADT) will be utilized as the methodology to apportion benefit within the bounc of the fee district. The approved LFMP zone plans, proposed and approved tentative maps, l recorded final maps were utilized to determine the projected land uses l development potential of each parcel included within the area of benefit. Projec ADT totals were then estimated using traffic generation rates obtained from The ADT projections for each parcel are listed within Appendix C of this report. TI- are a total of 45,258 ADT within the area of benefrt. The traffic projections listed in Appendix C are for future development only and do include ADT figures for existing residences located on property within the prop0 area of benefit. Existing residences are exempt from the proposed fee progr however, any additional development in excess of the existing units on sucl property is subject to the facility fee. There are presently three existing units within proposed area of benefit, two in LFMP Zone 24, and one in LFMP Zone 8. FEE CALCULATION The proposed facility fee is calculated by dividing the total unfunded costs for Can Road West by the total number of ADT anticipated to be generated by undeveloped property within the area of benefit. The unfunded cost, amountin! December 1996 edition of the SANDAG trip generation table (included in Appendix B8TD No. 3 (Cannon Road West)d.doc 4/16/98 -7- 0 a $5,611,293 was identified in the previous section entitled “Funding Sources.” total ADT of 45,258 was previously identified in the section entitled “Methodolog Determine Fee.” The proposed facility fee is therefore calculated by dividing unfunded costs by the total ADT as follows: Facility Fee = $5,611,293 i 45,258 ADT = $123.98/ADT, Say $124/ADT The proposed Bridge and Thoroughfare District No. 3 has been divided into benefit zones A and B to reflect a credit for the existing assessment of $36.96 ADT (estimated at that time) that was previously charged to all parcels in Zone I means of Assessment District No. 95-1. Accordingly, all parcels in Zone A wi charged a fee of $124 per ADT less the amount assessed which is shown in Tab1 The remaining parcels in Zone B will pay the total fee of $124 per ADT. The actual fee will be determined at tir development based upon the approved land use and the trip generation projected at the time building permits are issued. These developments are identified follows: Carlsbad Tract 91-02 (Eagle Canyon) Carlsbad Tract 91-03 (Evan’s Paint) Carlsbad Tract 85-24 Unit No. 5 (Koll Research Center Phase 5) Carlsbad Tract 92-07 (Lot 5 and 6 of Carlsbad Ranch) - GIA Carlsbad Tract 94-09 (Lot 5 of Carlsbad Ranch) - Golf Course Carlsbad Tract 94-09 (Lot 6 of Carlsbad Ranch) - NIA (Kreg-O.C. LP) Carlsbad Tract 94-09 (Lots 9 and 10 of Carlsbad Ranch) These developments were allowed to proceed with development on the condition i they deposit an initial amount per estimated ADT. The actual amount of their share payment shall be determined by the City Council at the time this fee prograr established and will be based on the actual dollar per ADT approved by the 4 Council times the number of trips established in the agreements. The number of P and the full amount of the fee for each parcel in the development is reflected Appendix C and included in the total fee program. The agreement for Carlsbad TI 85-24 places the full amount of the fee for all 18 parcels on one parcel, lot 109 of ( 85-24, APN 212-130-43. However, Appendix C shows all of the 18 parcels which t 38.7 net developable acres.. FEE PROGRAM The following recommendations make up the full extent of the facility fee program: 1. Based on the above, the recommended Bridge and Thoroughfare District I 3 (B&TD #3) Fee for the Cannon Road West Facility is $124 per ADT in Ben Zone B and $124 per ADT less any credit for the previous assessmeni Assessment District No. 95-1 in Benefit Zone A. The fee is to be paid at the time of building permit issuance. The ADT for each project shall be based upon the latest edition of the B Guide for Vehicular Traffic Generation Rates for the San Diego Reg produced by the San Diego Association of Governments (SANDAG). A sin family detached residence has an ADT of IO. For multiple land uses and land uses not included in the Guidelines, the City Engineer shall determine i appropriate traffic generation rate. The B&TD #3 Fee will be adjusted annually as a part of the Clty's Cap Improvement Program budget process. The BUD #3 Fee will be adjus according to the increase in the Engineering News Record, City of Los Ange Construction Cost Index. The costs included in Appendix A are based on December I, 1997 Index of 6663.55. The City may use at its discretion all or a portion of the B&TD #3 Fee func design and/or construct any portion of Cannon Road West. Alternatively, Crty may give credits or make reimbursement payments to eligible developer A developer who acquires any right of way, designs andlor constructs an) the improvements or installs any required mitigation for the segments Cannon Road West covered by the fee program may be eligible for crc and/or reimbursement, subject to the approval of the City Council. The fee district intends to collect $5,611,293 from property owners for construction of Cannon Road West. The projected SDG&E share of these unfunded costs is one-third of the total, or $1,835,000, and are anticipated to be derived solely from development of the 45 acres of C-T property (general plan designation) located at the northeast corner of Cannon Road and 1-5. A development schedule for this parcel is very unclear at this time due to the City's recent direction to staff to initiate a land use study of all SDG&E land in and around the power plant and Agua Hedionda Lagoon. Given this uncertainty, it is construction of Cannon Road. If 100% of construction cannot be reasonably predicted, there is a very real possibility that the road will not be constructed as intended. Further construction delays will then occur, and ultimately the total costs will increase, necessitating an adjustment to the ADT fee. The end result is that the SDG&E property will be targeted to bear the burden of the increased costs. Moreover, the traffic congestion will not be mitigated if the road is not completed. WHEREAS, the City Council of the City of Carlsbad, California has, by Res declared its intention to order the formation of a bridge and thoroughfare district, as aut under Section 66484 of the Government Code of the State of California, and specific authorized by Section 20.08.140 of the Municipal Code of the City of Carlsbad; said distri known and designated as BRIDGE AND THOROUGHFARE DISTRICT NO. 3 (CANNON WEST) (hereinafter referred to as the "District"); and WHEREAS, the Assessment Engineer did submit a "Report" generally setting fc describing: (a) the boundaries of the area of benefit; (b) the estimated costs for the con: of the facilities; and (c) a method of allocation of the costs to the area of benefit; and WHEREAS, the legislative body has now conducted a duly noticed public hearinc purpose of considering the establishment of said District, and all persons have opportunity to speak either in favor of, or in opposition to, the proceedings and establish the District; and WHEREAS, protests have not been received from the owners of one-half (1/2 property to be benefitted by the facilities; and WHEREAS, this City Councii now desires to proceed with the establishmen District. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: RECITALS SECTION 1. That the above recitals are all true and correct. SECTION 2. That the public hearing for the referenced District is hereby closec protests and objections are made by less than owners of one-half (1/2) of the are; property to be benefitted by the proposed improvements, and said protests are hereby o and denied. This City Council does hereby confirm the District and establish an benefit to be known and designed as BRIDGE AND THOROUGHFARE DISTRICT (CANNON ROAD WEST). That the "Report" of the Engineer, as herewith submitted, forth the estimate of the costs, area of benefit and method of allocation for the costs, is approved and adopted by this legislative body. AREA OF BENEFIT SECTION 4. That the area of benefit encompassed within the boundaries of the include all those properties benefitting from the proposed improvements. The area 01 and boundaries of the District are depicted on the map as approved by the City Council the adoption of Resolution No. 98-154 on the 16'h of June, 1998, a copy of which I approved, is on file in the Office of the City Clerk and open for public inspection. A copy map is also attached hereto as Exhibit "A" and incorporated herein by this reference. REPORT SECTION 5. That the "Report" as submitted by the Assessment Engineer, sett the: (a) boundaries of the area of benefit; (b) estimate of the costs; and (c) method of all is herein approved and adopted, and a copy shall be kept on file in the Office of the City ' IMPROVEMENTS SECTION 6. That the total improvements, a portion of which are to be funded this District shall generally consist of the following: Full width grading of the roadway, all curbs, gutters, sidewalks, base ar pavement, median landscaping and irrigation, median hardscape, street light street monumentation, storm drainage facilities, erosion control, guard rails, ar other incidentals necessary to complete a four-lane major arterial roadway. Tt facilities also include two (2) 455-foot multi-span bridge structures across the si water wetlands at the north end of Macario Canyon, and a 133-foot single-sp: bridge across the Agua Hedionda Creek at El Camino Real. The improvemen also include modifications to the intersection of Cannon Road and El Camino Re; In addition, the project includes the cost for full mitigation of the environmenl impacts of the construction of the improvements noted above. The cost estimate, as set forth in the "Report" of the Engineer, refl total estimated costs for the proposed works of improvement, and the method of fee a represents a fair method of allocation of the costs to the area of benefit. The total e! cost of the improvements is $19,678,329. Contributions in the amount of $14,067,036 I( unfunded cost of the fee program to $561 1,293. ALLOCATION OF COSTS SECTION 8. The above unfunded fees, as set forth in the "Report" of the E shall be applicable to all property within the area of benefit, except for publicly owned and said fees shall be payable as a condition of issuing a building permit for the prc portions of the property to be developed. TIME FOR PAYMENT SECTION 9. The above fees, as set forth in the "Report" of the Engineer, applicable to all property within the area of benefit which is not exempted on the benl map, and said fees shall be payable as a condition of issuing a building permit for the prc portions of the property to be developed. CREDIT SECTION IO. Landowners, developers and subdividers may be entitled to recei for the construction of the major proposed bridge and thoroughfare improvements, as ai by these proceedings, said credit is limited to the total amount of Bridge and Thon District fee which would be payable by the developer but not-to-exceed the Estimated the Improvements. Credits, once determined, shall be considered to run with the lanc awarded on a building permit-by-permit basis to whomever is listed as the buildin! permittee. Any reimbursements shall be made in accordance with City Council policy. PUBLIC AGENCIES SECTION 1 I. Any project by a public agency or public entity shall be exempt fees as herein approved for this District and these facilities.
