Grosse Development Co., Inc. to prepare a Finance Plan and an amendment to the Local Facilities Management Plan for Zone 15. The Finance Plan and LFMP hendment are required for the processing of our 40-acre development project (The Terraces at Sunny Creek). This project is currently under consideration by the Planning Commission. The amendment addresses itself to this 40-acre project; however, the finance plan affects the entire 1,500 acre Zone 15 area. It should be noted that a Local Facility Management Plan for this zone was previously approved in 1990 with the concurrence of all the property owners. A finance plan was not approved at that time but instead a condition of the LFMP was placed that one needed to be approved prior to any development within the zone. At this time, we are not able to obtain 100% concurrence from all the property owners within Zone 15 for the preparation of the LFMP Amendment and Finance Plan as required by Section 21.90 of the Municipal Code. If 100% property owner concurrence cannot be obtained, Section 21.90.120(d) of the Carlsbad preparation of the LFMP Amendment and Finance Plan. Accompanying this letter are mailing labels and a property owners list for all property owners within Zone 15. Please accept this letter as a formal petition to the City Council. We are requesting that this item be placed on the June 16* City Council Agenda. June 22,1998 Dear Commission e rs, You are in receipt of two letters from us in which we discuss our primary concerns w regard to the Grosse Development project: grading and access. I would like elaborate on these issues as well as address some of our other concerns. After reviewing some of the City of Carlsbad’s policies for growth and development is our contention that the proposed projects are in conflict with the Sycamore Cre Specific Plan, The El Camino Real Corridor Development Standards, the Hillsic Ordinance and EIR restrictions, as well as with several other City regulations. 1. The Terraces at Sunny Creek and Sunny Creek Plaza are associated projects ar should be heard concurrently. When it serves their purposes, Grosse Developmei would like the two projects to be viewed separately, and when it is otberwiz convenient, Grosse Development would like the two projects to be viewed joint] This inconsistency serves only the developer and is contrary to Carlsbad’s policy c “corn pre hensive planning”. a. As an example, when Grosse Development made the calculations for the grading plan, they combined both projects in order to comply with the HILLSID ORDINANCE. If the Terraces project is considered separately, then the cubic yara per acre do not comply. In fact. with a cut in excess of 14,000 cu. yds. per acre, thr grading would be prohibited. By treating the two sites conjointly, however, they art able to manipulate the figures to meet the standards. Ironically, in the EIR, the desigr and quantity of cut and fill were based upon total acreage that also included two acre of rn~ property. While two acres would not skew the figures significantly, Gross4 Development has now conveniently deleted them from the grading plan current1 under review. While both proiects were treated in toto for the purpose of grading, YOL are being asked to treat them completely independently for the purpose o development. 2. The SYCAMORE CREEK SPECIFIC PLAN was approved in 1984 and wc understand that approval is open-ended. However, if the specific plan is amended ir any way, then the entire plan is subject to City Council review. Grosse Development i: petitioning for change on the residential property but contends that this should no affect the commercial site. We strongly disagree. If the specific plan is amended in any way, then all properties within its province should be open to review and subject to current City standards. - 0 0 a. Grosse Development has petitioned for an amendment to the Specific PI; in which the underlying zoning would be used as the basis of their currently propost development. The introduction to the Sycamore Creek Specific Plan (Plannir Commission Resolution #2269 411 1/84-City I Council Ordinance #9717 5/1/84) stat€ “The Specific Plan is a set of standards for development and does not provide guarantee of approval for future discretionary acts or projects within its boundarie Th e perm i tted uses, d eve I o p m en t s ta n da rds a n d en vi ro n m en ta I con side rati o contained in this plan may be more stringent than those found in the underlyir zoning. Therefore, the provisions of this plan shall take precedence over tt- underlying zone. The provisions of the underlying zone shall apply to subjects n covered in this plan. Where a conflict may exist between this specific plan and tt underlying zone, the most restrictive shall prevail.” The Grosse Development Plan in conflict with many of the standards set forth in the Specific Plan and those standarc should clearly prevail. b. The proposed amendment to the Specific Plan is substantially different fro the original plan. There are land use changes; there is significant encroachment in designated open space areas; there are density changes; there are exceptior proposed to standard setback requirements and architectural and structural heig requirements; there are major conflicts with scenic corridor standards; and, contrary I the opinion expressed in the 6/7\98 Planning Department letter to the Plannin Commission, there are significant grading changes, both to the residential landscap and to the commercial pad. (1). For example, the proposed site development plan shows a pa elevated to heights exceeding 13 feet with a corresponding retaining wall beginnin at the entrance to our home. In the approved grading plan (DWG #251-5 / signe 511 6/85) there is only approximately 5 feet of fill adjacent to our driveway. 3. By addressing only issues related to the residential site while at the same tim passing a grading plan that significantly impacts the commercial site, the Plannin Commission will be denying us a reasonable and timely public forum in which ‘ comment on the commercial development. Approval of the residential developmer with the proposed stockpile permit for a permanently engineered commercial pad wi preclude any significant future changes to the commercial site and belies any attern! at comprehensive planning. a. It is our contention that both access and grading changes are imperativc Once the dirt is moved, it is not going to be re-excavated and hauled away and onc the site is elevated 13.5 feet above the only feasible access road to College Blvd., th2 approach will be rendered permanently inaccessible. The proposed grading plan fc Sunny Creek Plaza shows the commercial site significantly raised with fill dir elevating the pad above the level of El Camino Real on the south side, with ove thirteen feet of fill supported by a retaining wall of equal proportions on the north sid (a retaining wall that is conspicuously in excess of the 42 inch maximum as approve( in the Sycamore Creek Specific Plan). Our home is located on a small knoll above thl commercial property. Once the site is raised up 13.5 feet in the air, on top of which 3! to 40 feet of commercial building will be erected, we will suddenly be face to face wit1 this shopping center. In fact, portions of these structures will exceed our roof line anc should certainly require an EIR visual impact analysis. 0 0 \ b. Access to our home, our rental unit and to approximately IO acres undeveloped land will be radically impacted. Access from Sunny Creek Rd. to Camino Real will be reduced to right turn only and there is no public roadw purposed to directly link our property to access off of College Blvd., a road that we \ of course be required to pay for according to the finance plan. We would be forced access our property through a shopping center parking lot, an approach that 1 believe is totally unacceptable. The neighboring horse ranch will suffer the same fa Can you envision huge trucks and horse trailers regularly attempting U-turns on Camino Real or dodging pedestrians with shopping carts as big rigs troop through t commercial center to get to the stables? Access for emergency vehicles will also seriously impeded. c. The access limitations xeated by the proposed site development plan v also seriously impact our undeveloped acreage. Due to cul-d-sac regulations ai other policy limitations imposed by the City, the Grosse Development plan, implemented, will drastically reduce the development potential of our vacant land a1 we will suffer serious property devaluation and financial lass. d. The issue of access is not being addressed at this time. But, if the grading ( the commercial site is approved, the issue of access will be rendered moot as tt- elevation of the shopping center to 13.5 feet above Sunny Creek Road will precluc the road from ever being linked to College Blvd. Presently, Sunny Creek Road is tt logical public access route to connect all of the neighboring properties to College Blv It would act as a frontage road to the commercial project, eliminating the need 1 traverse the shopping center parking lot, and share access with Sunny Creek Plaza the signalized intersection on College Blvd. If the grading plan before you is passed, will be too late to address the problem of access and we will have been denied ar reasonable recourse. 4. In the EIR specific to The Terraces At Sunny Creek, and titled as such, issues ( grading, traffic, and biology on the commercial site were addressed. Essentially the were coat tailed in with the residential project so that no further EIR studies specific ' the commercial project would be necessary. However, significant factors related to th development of a shopping center, such as noise, lighting, hours of operatior landscaping, and service related issues, as well as the visual impact on a sceni corridor have not been addressed at all and no guidelines have been establishe regarding these issues which will, of course, seriously impact us as well as ou neighbors. As the EIR was supposedly only for the Terraces, as the title clear1 implies, 1 was not even aware that environmental issues specific to the commercial sit1 were being reviewed. In fact, items in the EIR such as the grading of my privat property were included without my knowledge or approval and my acreage was usec to calculate figures submitted as part of this project. I protest the use of my land ii conjunction with this development plan and believe, therefore, that this EIR i. inadequate if not invalid. 5. My evaluation of this project is largely based upon my experiences with regard tc our family owned properties along Paiomar Airport Road and the entitlements we'vc sought in connection with these properties. We have had numerous discussions wit1 the City staff specifically addressing what is and is not acceptable in the City 0' b 0 0 Carlsbad and the advice that we have received is not consistent with the proPo$ before you: with the construction of College Blvd. (Aviara Parkway). We were told that we need( an approved site development plan prior to the issuance of a stockpile perm Currently, our successors to this property would like to surcharge a portion of tl property where buildings will be located as specified in the site development plan th was subsequently submitted. As yet, they have failed to receive staff approval. Th does not entail the import nor the export of m dirt, only mounding for surchargin and involves only a small amount of dirt in comparison to the Grosse Developme project and yet Grosse Development is not being required to submit a siu development plan. b. We were approached by a prospective tenant interested in developing shopping center on our Palomar Airport Road property but who wanted the sii elevated to increase visibility. Like El Camino Real, Palomar Airport Road has als received a scenic corridor designation and we were told by the City that grading woul not be allowed in order to bring the site up to road level, a fill depth of approximate one half of what Grosse Development is proposing. c. Before grading will be allowed on our property on Palomar Airport Roac issues regarding the water channel have to be addressed and even property on thr other side of the channel away from any development will be reviewed and dedicatec for future use (all or nearly all will be dedicated open space). The Gross( Development project appears to end precisely at the edge of their development wit1 no extended review of their remaining contiguous property. Our property on Paloma Airport Road is divided by an engineered, graded channel. Grosse Development‘ property is bisected by Agua Hedionda Creek. Agua Hedionda Creek is a year rounc stream and is arguably the most important stream bed in the City of Carlsbad. While we have been required to submit a site development plan for our entire property Grosse Development’s plan stops abruptly at the edge of their proposed gradin! without regard to issues of the creek bed or their remaining contiguous land. 6. The El CAMINO REAL CORRIDOR DEVELOPMENTSTANDARDS were submittec to the City Council on Feb. 18, 1984 and the Sycamore Creek Specific Plan was approved by the Planning Commission on April 11, 1984 and by City Council Ordinance #9717 on May 1, 1984. Therefore, the El Camino Real Corridor Development Standards were in place when the Sycamore Creek Specific Plan was adopted and should apply to any development proposal under the Specific Plan. a. Under IV. GENERAL DEVELOPMENT CRITERIA, the Specific Plan states: “The Sycamore Creek development has over 3000 feet of frontage along El Camino Real which is designated a scenic corridor. Topographically the area is situated between 10 and 30 feet below the El Camino Real grade elevation.” “In keeping with the campus style design theme, this project will incorporate generous setback and landscaping elements. In addition, this project is designed to maximize view corridors from El Carnino Real through the project to the scenic hillsides beyond.” The site planning goals as stated in the Specific Plan include the “harmony of new a. It is estimated that 32% of the traffic on Cannon Road will originate iri Zon 15. However, about one half of the total traffic generated in the 1500+ acres of th zone wili be solely generated by the i 7.6 acres of Sunny Creek Plaza. it is hardly fa that everyone within the zone will have to shoulder a substantially increased financia burden as a direct result of one single development. Grosse Deveiopment is airecti’ responsible for the traffic that impacts Cannon Rd. and thus triggers a financia obligaiion for that roadway. Therefore, G rosse Development aione snould bear thl financial burden. The other property owners should not be saddled with costs due tr development that they it7 no way created tior from which they can in any way profit. c. And yet, we will both be required to pay substantially for the cos1 building the road. If we are denied reasonable access, we should be exempt from ai financial obligation with regard to College Blvd. If a property does not ha1 reasonable access to a major road and therefore derives little or no benefit from th road, then the property owner should bear no financial responsibility. 8. I believe that the Planning Commission should treat all proposed projects wi consistency, using the same criteria. If these projects are passed as submitted, thc other projects should be evaluated by these same standards. This development is the gateway to the entire valley and sets a precedent for the whole zone. Careful ar judicious planning is required. Site development plans are imperative on bo1 projects and should be reviewed concurrently and in accordance with tt prevailing City standards.
