HD. * MTG. 7/7/98 CLAIM OF THOMAS SUGG DEPT. RM RECOMMENDED ACTION: Approval of Resolution No. 9 $15 approving the Stipulations with Request for Award which authorizes the payment of $11,914.00 to Thomas Sugg. ITEM EXPLANATION The claimant is an Electrician in the Public Works Streets Division who sustained an industrial injury to his back. Mr. Sugg, while climbing down from an aerial bucket, slipped on a pair of pliers that were sitting on a step. Ultimately, Mr. Sugg underwent surgery for his injury. On July 29, 1996, Mr. Sugg was determined to be permanent and stationary with a work restriction of no very heavy work. A second opinion resulted in the same work restriction. The Stipulations with Request for Award (on tile in the Risk Management office) is based on the disability rating provided by the State of California, Office of Benefit Determination and recommended by TRISTAR, the City’s third party administrator. FISCAL IMPACT The cost of the settlement is $11,914.00 payable at the rate of $148.00 per week and the provision of future medical treatment. EXHIBITS 1. Resolution No. 4 8 -2 / 5 a \ 1 RESOLUTION NO. 98-215 ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING THE EXPENDITURE OF FUNDS FOR SETTLEMENT OF THE WORKERS COMPENSATION CLAIM OF THOMAS SUGG WHEREAS, TRISTAR, Third Party Administrator for the City of Carlsbad, has recommended a settlement of the Workers’ Compensation claim of Thomas Sugg; and 7 WHEREAS, there are sufficient tids available in the Workers’ Compensation Self- 8 Insurance Fund to pay the settlement, 9 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 10 California, as follows: II 11 1. That the above recitations are true and correct. 12 2. That the expenditure of $11,914.00 from the Workers’ Compensation Self-Insurance 13 Fund is authorized for the settlement of said claim. 14 3.
