ITEM EXPLANATION: This item is a request of Cornerstone Corporate Centre, LLC, owner of the p quitclaim the City's interest in a sewerline easement located over a portion of Lots Carlsbad Tract 81-46. The easement was originally dedicated to the City of Ci sewerline purposes as part of the final map identifying the City as successor in intl CMWD engineering staff has reviewed the request and concurs with the owner's c The easement is not being utilized and the master plan has no use schedulc easement now or in the future. FISCAL IMPACT: Approval of this vacation will result in approximately 12,740 square feet of land k to the tax rolls. ENVIRONMENTAL REVIEW: The Planning Director has determined that the project is not subject to CEQA F Section I5061 (b) (3) of the CEQA Guidelines, because it can be seen with certait activity in question has no possibility of a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That , pursuant to Division 9, Part 3, Chapter 4 of the California Stre Highways Code said sewerline easement over a portion of Lots 7 and 8 of CI Tract 81-46, Carlsbad Corporate Centre, CMWD Project No. 97-259, whic never utilized for the purpose for which is was granted and is not now nc contemplated to be needed for the purpose of sewerline installation, particularly described as Exhibit 2, be summarily vacated.
