RECOMMENDED ACTION:
That the City Council INTRODUCE Ordinance No. NS-450 for Zone Change 9-
ADOPT City Council Resolution No. 98-226 APPROVING the Negative Declaratio
Addendum to MElR 93-01 and the amendment of the General Plan Land Use Map,
Coastal Program Land Use Map and the Zoning Map.
IT E M EXP LAN AT IO N :
The General Plan, Zoning, and Local Coastal Program Consistency Project is one segmt
City’s larger, more-comprehensive General Plan Implementation Program that was approv
City Council with the last major update of the General Plan in 1994. To begin impleme
program the Planning Department is bringing forward, for review and approval by the
Commission and City Council, a series of General Plan Amendments, Zone Chan
amendments to the City’s Local Coastal Program land use maps for parcels that curre
inconsistent land use designations. State law currently requires that zoning conforr
implement the General Plan and the Local Coastal Program. Therefore, where inconsisten
between these designations, the law requires that changes be made to bring about consistt

WHEREAS, on April 1, 1998 the Planning Commission held a duly notic

Project Phase 1. At the conclusion of the hearing the Commission adopted Resoli
4247, 4248, 4249 and 4250 recommending that the Negative Declaration and Add
Master EIR 93-01, GPA 97-01, ZC 97-01, and LCPA 97-04 be approved; and
6th WHEREAS, the City Council of the City of Carlsbad, on (
October , 1998, held a public hearing to consider the Corr

WHEREAS, the City of Carlsbad certified Master EIR 93-01 on S

WHEREAS, the Addendum to Master EIR 93-01 for GPA ’
described in the attached Exhibit “Addendum To MEIR # 6”, dated June 12
intended to change the Master EIR 93-01 project description and;

Commission hereby RECOMMENDS APPROVAL of the Negative 1

STATE CEQA GUIDELINES, Chapter 3, Article 5, Section 15063 requires that the City conduc
Environmental Impact Assessment to determine if a project may have a significant effect on
environment. The Environmental Impact Assessment appears in the following pages in the form
checklist. This checklist identifies any physical, biological and human factors that might be impac
by the proposed project and provides the City with information to use as the basis for deciding whe
to prepare an Environmental Impact Report (EIR), Negative Declaration, or to rely on a previoi
approved EIR or Negative Declaration.
e A brief explanation is required for all answers except “No Impact’’ answers that are adequa
supported by an information source cited in the parentheses following each question. A ‘
Impact” answer is adequately supported if the referenced information sources show that

BACKGROUND INFORMATION:
The City of Carlsbad’s Planning Department is currently in the process of updating the City’s Gent
Plan Land Use, Local Coastal Program, and Zoning Maps to make them consistent with one an01
per the requirements of California State law. State law currently requires that zoning conform to i
implement the General Plan. Therefore, where inconsistencies exist between these designations.

Consistency Program is one segment of the City’s larger, more-comprehensive General P
Implementation Program that was approved by the City Council with the last major update of
General Plan in 1994. The General Plan is the City’s required long range comprehensive land

staxdads that control the use and intensity of development for property within the City of Carlsb
Every property in the City has a General Plan land use designation, a Zoning Map designation, i
when located in the Coastal Zone, a Local Coastal Program land use designation. These land 1
designations (i.e. open space, residential, commercial, industrial) are shown on three separate offic
maps that are legally adopted by the Mayor and City Council Members.
During the Planning Department’s recent review of the official maps, properties has been identified
having inconsistent General Plan land use designations, Local Coastal Program land use designatio
and Zoning Map designations. To achieve consistency between the General Plan, Local Coas
Program, and Zoning Map the City will be officially amending either the General Plan Land Use M
or the Zoning Map. For properties located in the Coastal Zone there will also be Local Coas
Program Map Amendments.

ENVIRONMENTAL ANALYSIS:
This analysis does not contain a detailed discussion for each individual environmental impact anal:
category from I. Land Use and Planning through XV. Recreational on the checklist because, for
project, in all cases but one, the proposed action would result in a property’s zoning being chan
consistent with the property’s existing General Plan land use designation and Local Coastal Progi
designation (applicable to the parcels located in the Coastal Zone). The Final MEIR analyzed all
impacts associated with the land use designations shown on the 1994 General Plan Land Use R
which is still applicable to the land use designations shown on the current General Plan Land 1
Map. The proposed Zone Changes and Local Coastal Program Amendments associated with 1
project are designed to achieve land use consistency with the land use designations already shown
the General Plan Land Use Map and analyzed in the Final MEIR for 1994 General Plan update.
The project also includes one parcel level General Plan Amendment which would not be covered
the analysis in the Final MEIR because it is changing the description of the General Plan Land ‘c
Map that was analyzed in the 1994 General Plan update. In this case, the parcel’s General Plan 1s
use designation would be changed from a residential designation to an open space designation to
consistent with the parcel’s existing open space zoning. Since the Open Space (OS) General P
designation is more restrictive in terms of land use and development potential than the residen
(EM) General Plan designation, it can be concluded that less future environmental impact wo
potentially occur. Because the proposed General Plan Amendment would change the physic
composition of the map/plan and there is not an increase in the potential for environmental impact
separate addendum to the Final MEIR will be processed as part of the General Plan Amendmf
portion of this project. The addendum will also serve to update the project description of the Fii
MEIR (see attached addendum).
In all cases the proposed project would result in a change to a property’s zoning designation, Lo
Coastal Program land use designation, or General Plan land use designation to a more restrictive la
use designation (i.e. residential to open space or commercial to residential), thus resulting in If
intensity of development and less potential for significant environmental impacts. This project is r
associated with any specific development project and will not directly or indirectly result in a
significant environmental impacts. Any future development project on any of these parcels shall
required to undergo project specific environmental review if that development project is proposing
create significant environmental impacts.

I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No.
RECOMMENDING APPROVAL of the Negative Declaration and Addendum to Master EIR ‘
issued by the Planning Director, and ADOPT Planning Commission Resolutions No. 4248. 4245
4250, RECOMMENDING APPROVAL of GPA 97-01, ZC 97-01, and LCPA 97-04, based o
findings contained therein.
11. INTRODUCTION
The General Plan Amendment, Zone Changes, and Local Coastal Program Amendments proposec
this project affect approximately thirty-one (3 1) parcels located within the City of Carlsbad. Sevc
of the parcels are located within the Coastal Zone and the land use designation changes on these
(7) parcels will also require approval by the ‘California Coastal Commission. The majority (
amendments include a land use change to the Open Space Zone to be consistent with the existini
use and either the underlying Open Space General Plan or Local Coastal Program land use designa
where applicable. There is one (1) parcel level Zone Change to a residential zone to be consistent
the underlying residential General Plan land use designation, and one (1) parcel level General
Amendment to the Open Space land use designation to be consistent with the parcel’s open
zoning. In all cases, the changes will make the parcel’s General Plan, Zoning, and Local Cc
Program land use designations all consistent with one another.
111. PROJECT DESCRIPTION AND BACKGROUND
The Planning Departmenf is beginning a land use consistency program that will include a serj
General Plan, Zoning, and Local Coastal Program land use designation changes that must be revi
by the Planning Commission and City Council. The General Plan, Zoning, and Local Coastal Prc
Consistency Project is one segment of the City’s larger, more-comprehensive General
Implementation Program that was approved by the City Council with the last major update c

General Plan in 1994. To begin implementing the program the Planning Department will be brir
forward, for review and approval by the Planning Commission and City Council. a series of Ge
Plan Amendments, Zone Changes, and amendments to our Local Coastal Program land use map
parcels that currently have inconsistent land use designations. State law currently requires that z(
conform to and implement the General Plan and the Local Coastal Program. Therefore, v
inconsistencies exist between these designations, the law requires that changes be made to bring i
consistency. The project will have multiple phases and will take in excess of a year to carry-ou
complete.
The proposed changes in this first phase of the General Plan, Zoning. and Local Coastal Pro
Consistency Project mostly include parcels that contain an Open Space General Plan land
designation and a Zoning or Local Coastal Program land use designation other than Open Space.

Plan, Zoning. and Local Coastal Program land use maps all consistent with one another. In subsec
phases other types of land use designation changes will be brought forward. While most of the cha
will be concerned with the land use designations on individual properties, (Le. mapping changes),
may be future phases that include amendments to the text of the General Plan. Zone Code. and/or I
Coastal Program.
The proposed project is subject to the following State and City adopted policies and regulations:
A. State Law - Government Code Section 65860 - Zoning Consistency with General Plan: a

IV. ANALYSIS
A. State Law - Government Code Section 65860 - Zoning Consistency with General Plan
State Law requires that a City’s Zoning Ordinance be consistent with the General Plan. In the even
a Zoning Ordinance becomes inconsistent with a General Plan by reason of amendment to such a 1
or to any element of such a plan, the Zoning Ordinance shall be amended within a reasonable tirr
that it is consistent with the General Plan as amended. The State Attorney General has stated that; ‘
term ‘consistent with’ means ‘agreement with or harmonious with’. The term ‘conformity’ mea
harmony therewith or agreeable to.” This means land uses specified for all land use categories ir
Zoning Ordinance must all be consistent with the land uses specified in the General Plan’s text and
or diagram of proposed land uses.
A primary objective of this project is to bring the General Plan and zoning land use designations
conformity on individual parcels located within the City, in accordance with the requirements of
law, as illustrated in Table 1.

The various parcel level land use designations and the proposed changes, listed in Table 1, fall in
following categories:
a. Parcels that contain a SDG&E power transmission easement with an existing Open
General Plan land use designation and a zoning designation other than the Open Space

applicable to be consistent with the underlying land use and existing Open Space Ge
Plan land use designation (Table 1 - Lists No. 5-8, 10-11, 13-14, 16-17. and 20-23).
c. Parcels that were dedicated to the City for park land through the residential subdiv
process or acquired for park purposes by the City. In some cases. these parcels contain
constrained by steep topography and in all cases they have an existing Opeii Space Ge
Plan land use designation. The recommended action is to rezone or redesignate the pi
to an Open Space Zone or an Open Space Local Coastal Program land use design:
whichever is applicable to be consistent with the existing open space land use and 1

d. A parcel that had the General Plan land use designation amended as part of the 1994 Ge
Plan update and now has an inconsistent Zoning and/or Local Coastal Program lanc
designation. The recommended action is to rezone or redesignate the parcel to a lani
designation consistent with the current General Plan land use designation. Site locatio1
listed in Table 1 is zoned Neighborhood Commercial (C-1), is developed with a church

V. ENVIRONMENTAL REVIEW
The Initial Study prepared in conjunction with this project determined that the environmental effec
peculiar to this project are not considered significant effects. In consideration of the foregoing,
1997, the Planning Director issued a Negative Declaration with an attached Addendum to Maste
The Negative Declaration was noticed for public review and sent to the State Clearinghouse for p
review and no comments were received. Please see the Environmental Assessment Form fc
description of the environmental analysis and an expanded justification for the recommendation tc

Project Planner, Jeff Gibson, presented the staff report and described the project as fo[lows: This i:
request for a recommendation for approval of a Negative Declaration, an Addendum to Master EIR
General Plan Amendment, and a Local Coastal Program Amendment. This is to change land c
designations shown on the General Plan Zoning and Local Coastal Program land use map. They ;
consistent with one another on various parcels located about the city, including the Coastal Zone. 7
proposed changes, in the first phase, mostly include parcels that are contained in the Open Space la
use designation, and Zoning, and Local Coastal Program designation that is other than Open Space. T
