PLN @ CITYMGR : %TY OF CARLSBAD - AGE AB A BILL GENERAL PLAN, ZONING, AND LOCAL COASTAL RECOMMENDED ACTION: That the City Council INTRODUCE Ordinance No. NS-450 for Zone Change 9- ADOPT City Council Resolution No. 98-226 APPROVING the Negative Declaratio Addendum to MElR 93-01 and the amendment of the General Plan Land Use Map, Coastal Program Land Use Map and the Zoning Map. IT E M EXP LAN AT IO N : The General Plan, Zoning, and Local Coastal Program Consistency Project is one segmt City’s larger, more-comprehensive General Plan Implementation Program that was approv City Council with the last major update of the General Plan in 1994. To begin impleme program the Planning Department is bringing forward, for review and approval by the Commission and City Council, a series of General Plan Amendments, Zone Chan amendments to the City’s Local Coastal Program land use maps for parcels that curre inconsistent land use designations. State law currently requires that zoning conforr implement the General Plan and the Local Coastal Program. Therefore, where inconsisten between these designations, the law requires that changes be made to bring about consistt The proposed changes in this first phase of the General Plan, Zoning, and Local Coastal Consistency Project mostly include parcels that contain an Open Space General Plan designation and a Zoning or Local Coastal Program land use designation other than Ope] The re-designation of the parcels to the Open Space Zone or land use designation will General Plan, Zoning, and Local Coastal Program land use maps all consistent with one ar On April 1, 1998, at a public hearing, the Planning Commission reviewed the proposed changes. Open Space Lot No. 26 located east of Camino V designation of Open Space and a zoning designaton of Planned Industrial. The applica Courtyard by Marriott project would like to use a portion of Lot No. 26 as a parking lot for proposal and they have applied for a GPA to change a portion of the Open Space des@ Lot No. 26 to Planned Industrial. This GPA proposal has not yet been reviewed by the Commission, therefore, staff is recommending that the Zone Change recommendation fc 26 which is shown as Item C on Exhibit “P”, dated March 18, 1998, is removed from thl Plan, Zoning, and Local Coastal Program Consistency Project Phase I. State law currently requires that zoning conform to i implement the General Plan. Therefore, where inconsistencies exist between these designations. law requires that changes be made to bring about consistency. This General Plan Land 1 Consistency Program is one segment of the City’s larger, more-comprehensive General P Implementation Program that was approved by the City Council with the last major update of General Plan in 1994. The General Plan is the City’s required long range comprehensive land plan for the future physical development of the City and the Zoning provides the developm staxdads that control the use and intensity of development for property within the City of Carlsb Every property in the City has a General Plan land use designation, a Zoning Map designation, i when located in the Coastal Zone, a Local Coastal Program land use designation. These land 1 designations (i.e. open space, residential, commercial, industrial) are shown on three separate offic maps that are legally adopted by the Mayor and City Council Members. During the Planning Department’s recent review of the official maps, properties has been identified having inconsistent General Plan land use designations, Local Coastal Program land use designatio and Zoning Map designations. To achieve consistency between the General Plan, Local Coas Program, and Zoning Map the City will be officially amending either the General Plan Land Use M or the Zoning Map. For properties located in the Coastal Zone there will also be Local Coas Program Map Amendments. PROJECT DESCRIPTION - PARCEL LIST 10 Rev. 03/28/96 ENVIRONMENTAL ANALYSIS: This analysis does not contain a detailed discussion for each individual environmental impact anal: category from I. Land Use and Planning through XV. Recreational on the checklist because, for project, in all cases but one, the proposed action would result in a property’s zoning being chan consistent with the property’s existing General Plan land use designation and Local Coastal Progi designation (applicable to the parcels located in the Coastal Zone). Since the Open Space (OS) General P designation is more restrictive in terms of land use and development potential than the residen (EM) General Plan designation, it can be concluded that less future environmental impact wo potentially occur. Because the proposed General Plan Amendment would change the physic composition of the map/plan and there is not an increase in the potential for environmental impact separate addendum to the Final MEIR will be processed as part of the General Plan Amendmf portion of this project. The addendum will also serve to update the project description of the Fii MEIR (see attached addendum). PROJECT DESCRIPTION AND BACKGROUND The Planning Departmenf is beginning a land use consistency program that will include a serj General Plan, Zoning, and Local Coastal Program land use designation changes that must be revi by the Planning Commission and City Council. While most of the cha will be concerned with the land use designations on individual properties, (Le. mapping changes), may be future phases that include amendments to the text of the General Plan. Zone Code. and/or I Coastal Program. The proposed project is subject to the following State and City adopted policies and regulations: A. State Law - Government Code Section 65860 - Zoning Consistency with General Plan: a B. General Plan & Local Coastal Program Consistency. IV. ANALYSIS A. State Law - Government Code Section 65860 - Zoning Consistency with General Plan State Law requires that a City’s Zoning Ordinance be consistent with the General Plan. In the even a Zoning Ordinance becomes inconsistent with a General Plan by reason of amendment to such a 1 or to any element of such a plan, the Zoning Ordinance shall be amended within a reasonable tirr that it is consistent with the General Plan as amended. The State Attorney General has stated that; ‘ term ‘consistent with’ means ‘agreement with or harmonious with’. The term ‘conformity’ mea harmony therewith or agreeable to.” This means land uses specified for all land use categories ir Zoning Ordinance must all be consistent with the land uses specified in the General Plan’s text and or diagram of proposed land uses. A primary objective of this project is to bring the General Plan and zoning land use designations conformity on individual parcels located within the City, in accordance with the requirements of law, as illustrated in Table 1.
