RECOMMENDED ACTION:
Approval of Resolution No. 98-295 approving the Stipulations with Request for Award which
authorizes the payment of $29,750.00 to Elias Martinez.
ITEM EXPLANATION
Mr. Martinez is an Equipment Mechanic II who has been employed by the City of Carlsbad since
December 7, 1977. Mr. Martinez’ claim is for injury to his neck, shoulders, arms and upper back as
a result of working under vehicles and working under a dashboard.
Mr. Martinez was declared permanent and stationary on March 27, 1997, with permanent work
restrictions of no heavy lifting with either upper extremity above shoulder level.
The Stipulations with Request for Award (on file in the Risk Management office) is based on the
disability rating provided by the State of California, Office of Benefit Determination and
recommended by TRISTAR, the City’s third party administrator.
FISCAL IMPACT /
The cost of the settlement is $29,750.00 payable at the rate of $170.00 per week and the provision of
future medical treatment.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AUTHORIZING THE
EXPENDITURE OF FUNDS FOR SETTLEMENT OF THE
WORKERS’ COMPENSATION CLAIM OF ELIAS MARTINEZ
WHEREAS, TRISTAR, Third Party Administrator for the City of Carlsbad, has
recommended a settlement of the Workers’ Compensation claim of Elias Martinez; and
WHEREAS, there are sufficient funds available in the Workers’ Compensation Self-
Insurance Fund to pay the settlement,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as foIlows:
1. That the above recitations are true and correct.
2. That the expenditure of $29,750.00 from the Workers’ Compensation Self-Insurance
Fund is authorized for the settlement of said claim.
3. That the Council Accept the Stipulations with Request for Award on file in the Risk
Management office.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the
