RECOMMENDED ACTION:
That the City Council ADOPT Ordinance No. NS-455.
ITEM EXPLANATION:
At its meeting of August 4, 1998, the City Council approved (4-1 Mayor Lewis) the Gc
Amendment, Mitigated Negative Declaration and introduced the ordinance for the
Lucky Sav-On Shopping Center site. The Council amended the proposed ordinance
an option to restrict delivery hours to the service station and dedication of a poi
AMlPM convenience market for law enforcement purposes if determined to be nec
appropriate by the City Manager after review and recommendation by the Police (
attached ordinance has been amended to include these provisions. If it meets with tl
approval, your action is to adopt Ordinance No. NS-455.
ENVIRONMENTAL REVIEW:
The initial study (EIA-Part 11) prepared in conjunction with this project determined tt
the environmental effects which are peculiar to the property or to this project are
direct significant and adverse environmental impacts. The developer has agre
mitigation measures to the project to reduce those adverse effects to below
significance in accordance with the requirements of the California Environmental
(CEQA). The project's direct significant effects include impacts to traffic circula
quality, aesthetics, and hazards. Furthermore, the project has been either d
conditioned to incorporate all feasible and pertinent mitigation measures identified in
93-01. In consideration of the foregoing, on March 3, 1997 the Planning Dire
Mitigated Negative Declaration for the proposed project. On June 17, 1998, tb
Commission reviewed the environmental documents, heard public testir
recommended that the City council approve the Mitigated Negative Declaration.
FISCAL IMPACT:
The proposed project is located within Local Facilities Management Plan Zor
southeast quadrant. The Developer is required to offset impacts to public facilities
this project, including the payment of public facility impact fees and traffic improver
adjacent public roadways and intersections. Modernizing the shopping center an(
the retail square footage will increase the site's property value and potentially in(
sales, both resulting in economic benefits to the City.

CARLSBAD, CALIFORNIA, AMENDING TITLE 21 OF THE
CARLSBAD MUNICIPAL CODE BY AN AMENDMENT TO THE
ZONING MAP TO GRANT ZONE CHANGE, ZC 97-02 TO
CHANGE LAND USE DESIGNATIONS FROM PC TO C-1-Q AND
FROM C-2 TO C-1-Q FOR THE DEVELOPMENT OF A
NEIGHBORHOOD COMMERCIAL SHOPPING CENTER ON
PROPERTY GENERALLY LOCATED NORTH OF LA COSTA
AVENUE AND EAST OF EL CAMINO REAL IN LOCAL

SECTION I: That Title 21, Chapter 21.05, Section 21.05.030 of the
Municipal Code, being the Zoning Map, is amended to reflect zone changes as 5
