ENG RECOMMENDED ACTION: ESTABLISH A PRIMA FACIE SPEED LIMIT UPON LAGUNA DRIVE Y’ DEPT. HD! ‘T5 CITY ATTY. & CITY MGR. Introduce Ordinance No. /1/s-*30 establish a prima facie 30 mile per hour speed limit upon Laguna Drive from State Street to Jefferson Street. ITEM EXPLANATION: The Carlsbad Police Department requested that a prima facie speed limit be established upon Laguna Drive from State Street to Jefferson Street. Although located in a residential and business area, this road segment does not qualify as a residence district according to the California Vehicle Code. Consequently, the road does not have a prima facie 25 mile per hour speed limit and the speed limit must be established based upon the results of an Engineering and Traffic Survey. Jefferson Street is unclassified on the Circulation Element of the General Plan and functions as a collector road. This portion of Laguna Drive has a curb-to-curb width that varies between 32 and 40 feet. At this time, some portions of the south side of the road have not been widened to its full width. The north side of the road has curb and gutter, sidewalks and street lights that were installed about five years ago. Sections 22357 and 22358 of the California Vehicle Code authorizes local authorities to establish a prima facie speed limit on the basis of the results of an Engineering and Traffic Survey. The Engineering and Traffic Survey considers such factors as the number of collisions that have occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight distance, and conditions that may not be readily apparent to the driver. Staff presented the results of the Engineering and Traffic Survey to the Traffic Safety Commission at their August 3, 1998 meeting. By a 4-O vote, the Commission recommended establishing a 30 mile per hour prima facie speed limit upon Laguna Drive from State Street to Jefferson Street. The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic Engineer. FISCAL IMPACT: Installation of two (2) speed limit signs will cost about $250. NS 457 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTION 10.44.580 TO ESTABLISH A PRIMA FACIE 30 MILE PER HOUR SPEED LIMIT UPON IAGUNA DRIVE FROM STATE STREET TO ITS INTERSECTION WITH JEFFERSON STREET. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended by the addition of Section 10.44.580 to read as follows: “10.44.580 Laauna Drive: Upon Laguna Drive from State Street to its intersection with Jefferson Street, the prima facie speed limit shall be thirty miles per hour.” EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the 22nd day of September ,1998, and thereafter, PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the of day I 1998 by the following vote, to wit: AYES: NOES: ABSENT: CLAUDE A.
