CM DEPT. HD. RECOMMENDED ACTION: Receive presentation by Mr. Dick High, Publisher of the North County Times, on the sale of newspapers in Carlsbad by street vendors. ITEM EXPLANATION: Mr. Dick High has requested that he be allowed to address the City Council regarding the sale of newspapers by vendors on Carlsbad streets. EXHIBITS: 1. September 3, 1998 Ray Patchett Carlsbad City Manager 1200 Carlsbad Village Drive Carlsbad, CA 92008-1989 Dear Ray: 1 write to reqJe.st an item be p!aced on the City Council’ 5 agenda, as the naxi step in finding an acceptable way to permit our Alpha Program newspaper venders to continue sales in Carlsbad. Specifically, we propose that the City Council act to permit safe street sales of newspapers in the city. This can be done through a limited exception to Municipal Code Section 8.28.050, which currently prohibits the distribution or solicitation of printed material to any person riding in a vehicle in use on any public street in the city for purposes of travel. The exception would permit street sales of newspapers by those who comply with reasonable safety conditions set by the city, to include the following: 1. Soliciting only at controlled intersections when traffic is stopped. 2. Solicitation limited to streets with speed limits of 40 mph or less. 3. Solicitors prohibited from impeding traffic flow by pushing crosswalk buttons. 4. Solicitors must wear high-visibility clothing. 5. Solicitation could occur only during daylight hours. 6. Solicitor conduct could not unduly distract drivers’ attention while traffic is moving. 7. We also recommend the city require any soliciting organization to have strong training programs with emphasis on safety. We agree that concerns about safety expressed by you, Mayor Bud Lewis, Vice Mayor Ramona Finnila and other city officials are legitimate and should be resolved. The North County Times will work with you and the Alpha Project to find solutions. As you know, my particular interest is to ensure the continued excellent progress of the Alpha Project’s formerly homeless residents of Casa Raphael in rebuilding their lives through newspaper street sales. This North County program has earned a national reputation for its success in turning desperate homeless men into productive citizens. 1 am personally committed to finding a way to save this wonderful local program while meeting Carlsbad’s reasonable concerns for traffic safety. My hope is that the Carlsbad City Council and city staff will take our proposal as a starting point, and find a way to meet both the community’s need for traffic safety and its desire to help the homeless transform their own lives. Leilani Hines says she thinks that the Alpha Project may have applied for CDBG funding in 1994, but did not receive funding. Records of applications for 1994 are in permanent storeage and it would be very difficult, if not impossible, to find what we are looking for before the meeting tonight. I I / Honorable Mayor Lewis 1200 Carlsbad Village Drive Carlsbad, California Dear Mayor Lewis: ’ c - ’ ’ ’ * I am a Carlsbad native of 30 years. I grew up in this fine city - went to Magnolia Elementary, Carlsbad Valley Jr. High and Carlsbad High School. My father owned a local gas station and our family was very much a part of Cartlsbad. Nine years ago, after experiencing the progressive loss of dignity and the worsening consequences associated with my alcoholism - I gave up on myself For the next eight years I lived in the bushes behind Vons on El Camino Real and Hacienda. My life was a living hell, but I was too ashamed of myself to do anything about it. I won’t go into the details of my self defeating life during these eight years of being homeless in Carlsbad. I will say that I am grateful to be alive today. Several months ago a representative from Alpha Project-Casa Raphael came into our camp, as they often did, and offered us a way out. For some reason on this particular day when this Alpha worker looked at me and said “It doesnt have to be like this, it doesnt have to end like this...you are somebody Greg” I made a decision right there to change. Selling the North County Times vv;as my st$rt, it was the first job I had in a dozen years. Since then I have steadily prbgressed and have completed every job assignment that Casa gave me. I am currently working full time and am actively involved in self-help programs -- I have not used alcohol or drugs in nine months. I wish I could be here tonight, but I am working until 11 p.m. Please accept this letter and please allow the Alpha Project to continue their program in Carlsbad.
