ENG CITY MGR. 3 AWARD OF CONSTRUCTION CONTRACT PROJECT NO. 3615 RECOMMENDED ACTION: Adopt Resolution No. 98 *33? accepting bids and awarding a contract for the Demolition the Split Pavilion, Project No. 3615. ITEM EXPLANATION: On August 4, 1998, the City Council approved the plans and specifications for tl demolition of the Split Pavilion, and directed the City Clerk to advertise for construction bids. ( September 21, 1998, the following three (3) sealed bids were received: 1. Excavating Engineers, Inc. $1 15,552.00 2. J.C. Baldwin Construction Company $123,362.00 3. T.R. Mulligan, Inc. $1 46,842.74 The Engineer's Estimate for this project is $100,000. Bids for the project have been revieb and analyzed. The third bidder, T.R. Mulligan, Inc., has submitted a protest letter requesti that the City Council declare the first and second low bidder non-responsive due to defects their bids. Q 9 2 8 tz Q z G L Staff has analyzed all three bids and believes that the low bidder's failure to include 1 addendum in its bid causes it to be non-responsive and if awarded to the low bidder would g it material advantage over the other bidders, therefore, staff recommends that the low submitted by Excavating Engineers, Inc., be declared non-responsive. However, staff does believe that the insurance issues raised by the highest bidder gives the second low bidder i material advantage over the other bidders and recommends that the City Council WE the minor irregularities in the second low bid submitted by the J.C. Baldwin Construcl Company, and declare J. C. Baldwin Construction Company's bid of $123,362 as the low responsive bid and award the contract to J. C. Baldwin Construction Company. ENVIRONMENTAL COMPLIANCE: This project is categorically exempt from the environmental review process and August 20, 1998 the Planning Department issued a Notice of Exemption under the provision the California Environmental Quality Act (CEQA) Section 15301 (1)(4). This project is in Housing and Redevelopment area and a Coastal Development Permit approval will be on Housing and Redevelopment Board agenda on October 8, 1998. State Parks Departn approved this project on 9/9/98.
