ITEM EXPLANATION: On September 16, 1998, the Planning Commission conducted a public hearing and una recommended approval of the Hoehn Motors Mercedes Benz project, which is proposed for located on the west side of Car County Drive in Car County Carlsbad. No citizens provid testimony on the project. The project site is located within the Coastal Zone as well Facilities Management Zone 3. The applications propose the development of an approximately 49,500 square foot cot automobile dealership on a vacant and previously graded 5.84 acre site (two lots). The pr consist of automobile sales, display, inventory storage, and service. The site has beer relatively level and all frontage improvements, including landscaping, sidewalk, curb, ar have been provided along Car Country Drive. Only minor finish grading is necessarq proposed development. The proposed project has an architectural style generally desc Spanish motif with clay barrel tile roofs and slump block and stucco building walls. . Development Plan and Coastal Development Permit applications are required for the determine that the design complies with all City standards. The project is in compliance wit1 requirements. The permits require City Council approval as the project site is in the area subject to the ( Ranch Overlay Zone Urgency Ordinance. The urgency ordinance contains no a development or design standards. The effect of the urgency ordinance is to require cor projects subject to Planning Commission review to undergo City Council review and apprl compliance with the urgency ordinance the Planning Commission reviewed the project and deny the project as would be the case in the absence of the ordinance. The project as designed complies with all applicable plans, ordinances and policies. More information is included in the attached staff report to the Planning Commission. ENVIRONMENTAL REVIEW: The initial study prepared in conjunction with this project determined that the project would r a significant impact on the environment. In addition, the project qualifies as being within th of the City’s Master Environmental Impact Report for the General Plan (MEIR 93-01); there1 Planning Director issued a Negative Declaration for the project on July 17, 1998. All mitigation measures identified by the MEIR which are appropriate to this project hav incorporated into the site design. No additional mitigation measures in the form of r improvements are necessary. Chapter 3, Article 5, Section 15063 requires that the City co Environmental Impact Assessment to determine if a project may have a significant effec environment. The Environmental Impact Assessment appears in the following pages in the f checklist. This checklist identifies any physical, biological and human factors that might be by the proposed project and provides the City with information to use as the basis for deciding to prepare an Environmental Impact Report (EIR), Negative Declaration. or to rely on a pr approved EIR or Negative Declaration. A brief explanation is required for all answers except “No Impact” answers that are ad supported by an information source cited in the parentheses following each question. Impact” answer is adequately supported if the referenced information sources show impact simply does not apply to projects like the one involved. A “No Impact” answe be explained when there is no source document to refer to, or it is based on projects factors as well as general standards. “Less Than Significant Impact” applies where there is supporting evidence that the J impact is not adversely significant, and the impact does not exceed adopted general s and policies. “Potentially Significant Unless Mitigation Incorporated” applies where the incorpori mitigation measures has reduced an effect from “Potentially Significant Impact” to a “Le Significant Impact.” The developer must agree to the mitigation, and the City must desc mitigation measures, and briefly explain how they reduce the effect to a less than sig level. “Potentially Significant Impact” is appropriate if there is substantial evidence that an I significant . N/A b) c) 9 Rev. 03/28/96 ft 0 ENVIRONMENTAL SE ING: The project site consists of two vacant and pre-graded commercially (C-2) designated lots t approximately 5.8 acres in size. The site has been graded relatively level and all improvements, including landscaping, sidewalk, curb. and gutter have been provided along Car 1 Drive. The project site does not contain surface water or native habitat and is located adj; existing commercial automobile dealerships directly North, South, and West of the site. DISCUSSION OF ENVIRONMENTAL EVALUATION: There are no anticipated significant environmental impacts to the following categories of enviroi effects listed on the checklist: (1) land use and planning; (2) population and housing; (3) g (8) public services; (9) utilities and service systems; (10) aesthetics; and, (11) recreation, the1 detailed environmental analysis and explanation is not provided in this Initial Study. determination is based on the existing environmental setting for the following reasons: (1) the site has been disturbed by authorized grading; (2) the surrounding properties are developf dealerships and commercial land uses; (3) all the support utilities and service infrastructure h constructed; and, (4) the project is consistent with the approved Car Country Specific Plan (SP applies to the area. WATER: The project site is currently vacant, therefore, the increase in impermeable surfaces frc development of paved parking areas and buildings will increase the amount of pollutants in thc runoff from the site. To offset this increase in urban pollutant runoff, the pro-ject is desig incorporate oiUwater separators at the catch basins and the curb inlets would have a “fossil petroleum-based contaminant filtration system to remove urban pollutants from the runoff. The located in a non-useable groundwater basin so development will not have a significant imF groundwater in the area AIR QUALITY: The implementation of subsequent projects that are consistent with and included in the update( General Plan will result in increased gas and electric power consumption and vehicle miles tri These subsequently result in increases in the emission of carbon monoxide, reactive organic oxides of nitrogen and sulfur, and suspended particulates. These aerosols are the major contribu air pollution in the City as well as in the San Diego Air Basin. Since the San Diego Air Bas “non-attainment basin”, any additional air emissions are considered cumulatively significant: the continued development to buildout as proposed in the updated General Plan will have cum1 significant impacts on the air quality of the region. TO lessen or minimize the impact on air quality associated with General Plan buildout, a vari mitigation measures are recommended in the Final Master EIR. These include: 1) provisio roadway and intersection improvements prior to or concurrent with development; 2) measures to I vehicle trips through the implementation of Congestion and Transportation Demand Manageme provisions to encourage alternative modes of transportation including mass transit servicc conditions to promote energy efficient building and site design; and 5) participation in regional g management strategies when adopted. The applicable and appropriate General Plan air q problems; (4) biological and cultural resourcts; (5) energy and mineral resources; (6) hazards; (; 10 Rev. 03/28/96 e e mitigation measures have either been incorporated into the design of the project or are inclL conditions of project approval. Operation-related emissions are considered cumulatively significant because the project is within a “non-attainment basin”, therefore, the “Initial Study” checklist is marked “PC Significant Impact”. This project is consistent with the General Plan, therefore. the preparati EIR is not required because the certification of Final Master EIR 93-01, by City Council Resoh 94-246, included a “Statement Of Overriding Considerations” for air quality impacts. This “S Of Overriding Considerations” applies to all subsequent projects covered by the General Plar Master EIR. including this project, therefore, no further environmental review of air quality in required. This document is available at the Planning Department. CIRCULATION: The implementation of subsequent projects that are consistent with and included in the updatl General Plan will result in increased traffic volumes. Roadway segments will be adec accommodate buildout traffic; however, 12 full and 2 partial intersections will be severely imp; regional through-traffic over which the City has no jurisdictional control. These generally inc freeway interchange areas and major intersections along Carlsbad Boulevard. Even \? implementation of roadway improvements, a number of intersections are projected to fail thc adopted Growth Management performance standards at buildout. To lessen or minimize the impact on circulation associated with General Plan buildout, nL mitigation measures have been recommended in the Final Master EIR. These include 1) mea! ensure the provision of circulation facilities concurrent with need; 2) provisions to develop altt modes of transportation such as trails, bicycle routes, additional sidewalks, pedestrian linkag commuter rail systems; and 3) participation in regional circulation strategies when adoptec diversion of regional through-traffic from a failing Interstate or State Highway onto City streets impacts that are not within the jurisdiction of the City to control. The applicable and appr General Plan circulation mitigation measures have either been incorporated into the design project or are included as conditions of project approval. Regional related circulation impacts are considered cumulatively significant because of the fai intersections at buildout of the General Plan due to regional through-traffic, therefore, the ’ Study” checklist is marked “Potentially Significant Impact”. SDP 98-061 CDP 98-33 - HOEHN MOTORS MERCEDES BEN2 - Request for a Nega Declaration, Site Development Plan, and Coastal Development Permit to develop a 49,573 squ foot commercial automobile dealership on a vacant and previously graded 5.84 acre site (two IC located On the West side of Car Country Drive between Cannon Road and Paseo del Norte, wit Local Facilities Management Zone 3. Assistant Planning Director, Gary Wayne introduced this item and stated that Associate Planner, . Gibson, would present the staff report. Chairperson Noble asked if the Hoehn Motors representative wished to have this item continued tc future meeting when all seven Commissioners are present. The Hoehn Motors representa, tive indiGa\ that he wished to have the item heard at this meeting. Project Planner, Jeff Gibson, presented the staff report and described the project as follows: 7 proposed project is for the development of a commercial automobile dealership on a vacant & previou. graded site in Car Country Carlsbad. The site consists of two vacant pre-graded commercially designat lots which total approximately 8.8 acres in area. The site is graded, relatively level, and all fronta improvements including landscaping, sidewalk, curb, gutter, etc., have been provided along Car Coun Drive. The project site is located adjacent to existing commercial automobile dealerships directly to t north, south, and west of the site. This site is zoned C-2 and is within the Car Country Specific Plan a the Coastal Zone. The proposed project has an architectural style generally described as Spanish rnc with clay barrel tile roofs, slump block and stucco block walls and it consists of a two-story, 26,000 squa foot main display and sales building. There is a 1,900 square foot service drive-up structure, 21, 31 square feet of automobile repair and detail space. There are three driveways leading from Car Country the site and 472 total parking spaces for customers, employees, sales, inventory, and repair. The proje requires the approval of a Site Development Plan and a Coastal Development Permit. As previous mentioned, the site is located in the Coastal Zone and is subject to the policy requirements of the Mellc Segment. In this case, the site is not located near any coastal bluff, shoreline stream, lagoon, or tr ocean, and essentially will not impact any coastal or agricultural resources. Due to the City Couni Urgency Ordinance, NS 24, for commercially designated properties in that area, this project must 1: reviewed by the Planning Commission and finally approved by the City Council. The project complies wi City standards, is consistent with Car Country’s Specific Plan, and all of the necessary findings can t made for the approvals being requested. Staff believes the project has addressed all issues ai therefore warrants a recommendation of approval from the Planning Commission to the City Council. Commissioner Compas asked if the current sales operation will be moved to this new location. Mr. Gibson deferred the Commissioner’s question to the applicant, Applicant, Richard Bokal, Bokal & Sneed Architects, 244 9th Street, Del Mar, responded to Comrnissionc Compas’ question by stating that it is Hoehn Motors’ intention to move their Mercedes operation to thi new building but he has no information as to what will occupy the current Mercedes store. Chairperson Noble opened the Public Hearing. Seeing no one wishing to testify, Chairperson Nobl closed the Public Hearing. ACT1 0 N : Motion by Commissioner Compas, and duly seconded, to adopt Plannin Commission Resolution No. 4369, recommending approval of a Negativt Declaration, and Planning Commission Resolutions No. 4370 and 4371 recommending approval of SDP 98-06 and CDP 98-33, based upon the finding! and subject to the conditions contained therein.
