ITEM EXPLANATION:
On September 16, 1998, the Planning Commission conducted a public hearing and una
recommended approval of the Hoehn Motors Mercedes Benz project, which is proposed for
located on the west side of Car County Drive in Car County Carlsbad. No citizens provid
testimony on the project. The project site is located within the Coastal Zone as well
Facilities Management Zone 3.
The applications propose the development of an approximately 49,500 square foot cot
automobile dealership on a vacant and previously graded 5.84 acre site (two lots). The pr
consist of automobile sales, display, inventory storage, and service. The site has beer
relatively level and all frontage improvements, including landscaping, sidewalk, curb, ar
have been provided along Car Country Drive. Only minor finish grading is necessarq
proposed development. The proposed project has an architectural style generally desc
Spanish motif with clay barrel tile roofs and slump block and stucco building walls. .
Development Plan and Coastal Development Permit applications are required for the

requirements.
The permits require City Council approval as the project site is in the area subject to the (
Ranch Overlay Zone Urgency Ordinance. The urgency ordinance contains no a
development or design standards. The effect of the urgency ordinance is to require cor
projects subject to Planning Commission review to undergo City Council review and apprl
compliance with the urgency ordinance the Planning Commission reviewed the project and
deny the project as would be the case in the absence of the ordinance.
The project as designed complies with all applicable plans, ordinances and policies. More
information is included in the attached staff report to the Planning Commission.
ENVIRONMENTAL REVIEW:
The initial study prepared in conjunction with this project determined that the project would r
a significant impact on the environment. In addition, the project qualifies as being within th
of the City’s Master Environmental Impact Report for the General Plan (MEIR 93-01); there1
Planning Director issued a Negative Declaration for the project on July 17, 1998. All
mitigation measures identified by the MEIR which are appropriate to this project hav
incorporated into the site design. No additional mitigation measures in the form of r
improvements are necessary. With regard to air quality and circulation impacts, the City’

The City Council of the City of Carlsbad, California, does hereby re
follows:
WHEREAS, on September 16, 1998 the Carlsbad Planning Commissic
duly noticed public hearing to consider a Negative Declaration, Site Development F
Coastal Development Permit for the development of an approximately 49,500 squ
automobile dealership on a 5.84 acre site, and adopted Resolutions No. 4369, 4370, a
recommending to the City Council that the Negative Declaration, Site Development P
Coastal Development Permit be approved; and
WHEREAS, the City Council of the City of Carlsbad, on 20 th
October , 1998 held a duly noticed public hearing to consider the recommz
and heard all persons interested in or opposed to the Negative Declaration, SDP 98-

NOW THEREFORE, BE IT RESOLVED by the City Council of the

STATE CEQA GUIDELINES. Chapter 3, Article 5, Section 15063 requires that the City co
Environmental Impact Assessment to determine if a project may have a significant effec
environment. The Environmental Impact Assessment appears in the following pages in the f
checklist. This checklist identifies any physical, biological and human factors that might be
by the proposed project and provides the City with information to use as the basis for deciding
to prepare an Environmental Impact Report (EIR), Negative Declaration. or to rely on a pr
approved EIR or Negative Declaration.
A brief explanation is required for all answers except “No Impact” answers that are ad
supported by an information source cited in the parentheses following each question.

improvements, including landscaping, sidewalk, curb. and gutter have been provided along Car 1
Drive. The project site does not contain surface water or native habitat and is located adj;

DISCUSSION OF ENVIRONMENTAL EVALUATION:
There are no anticipated significant environmental impacts to the following categories of enviroi
effects listed on the checklist: (1) land use and planning; (2) population and housing; (3) g

CIRCULATION:
The implementation of subsequent projects that are consistent with and included in the updatl
General Plan will result in increased traffic volumes. Roadway segments will be adec
accommodate buildout traffic; however, 12 full and 2 partial intersections will be severely imp;
regional through-traffic over which the City has no jurisdictional control. These generally inc
freeway interchange areas and major intersections along Carlsbad Boulevard. Even \?

The project is located in the Coastal Zone and is subject to the policy requirements of the Me
I1 Segment. The project is not located near a coastal bluff, shoreline, stream, lagoon or t
ocean, and will not impact public access to any coastal resources. The project site is alrea
graded, contains no native habitat, and the project will not impact agricultural resources
operations in the area. Even though the site has been rough graded, the minor proposed c
amount of 6,350 cubic yards and the fill amount of 5,800 cubic yards to prepare the site .
construction will require the issuance of a building permit. The site is not located in any coas
viewshed area and will not negatively impact coastal view resources. The project must com]
with the City’s Storm Water Management Ordinance and meet all standards of the Cit
NPDES Permit to reduce urban pollutant runoff from the site. Therefore, the project is
compliance with the Mello I1 Segment policies and will not negatively impact the resources
the Coastal Zone.

F. Growth Management
The proposed project is located within Local Facilities Management Zone 3 in the northwc
quadrant of the City. The impacts on public facilities created by the project, and its complim
with the adopted performance standards, are summarized in Table D below.

V. ENVIRONMENTAL REVIEW
The initial study (EIA-Part 11) prepared in conjunction with this project determined that tl
project would not have a significant impact on the environment. The project is considered i
infill type of development that is consistent with the General Plan and zoning. The project fa’

certified in September, 1994, in which a Statement of Overriding Considerations was adopted
cumulative impacts to air quality and traffic. An ADT of 1,949 would be generated by
proposed project. This ADT is consistent with the generation rate analyzed for the site in
MEIR. All feasible mitigation measures identified by the MEIR which are appropriate to
project have been incorporated into the site design. No additional mitigation measures in
form of roadway improvements are necessary. The project site has also been disturbed
authorized grading. The surrounding properties are developed with dealerships and comer
land uses and all the support utilities and service infrastructure has been constructed. Please
the Environmental Assessment Form-Part I1 for a detailed description of the justification
recommend approval of the Negative Declaration. In consideration of the foregoing, on July
1998 the Planning Director issued a Negative Declaration for the proposed project. :

foot commercial automobile dealership on a vacant and previously graded 5.84 acre site (two IC
located On the West side of Car Country Drive between Cannon Road and Paseo del Norte, wit

Assistant Planning Director, Gary Wayne introduced this item and stated that Associate Planner, .
Gibson, would present the staff report.
Chairperson Noble asked if the Hoehn Motors representative wished to have this item continued tc
future meeting when all seven Commissioners are present. The Hoehn Motors representa,tive indiGa\
that he wished to have the item heard at this meeting.
Project Planner, Jeff Gibson, presented the staff report and described the project as follows: 7
proposed project is for the development of a commercial automobile dealership on a vacant & previou.
graded site in Car Country Carlsbad. The site consists of two vacant pre-graded commercially designat
lots which total approximately 8.8 acres in area. The site is graded, relatively level, and all fronta
improvements including landscaping, sidewalk, curb, gutter, etc., have been provided along Car Coun
Drive. The project site is located adjacent to existing commercial automobile dealerships directly to t
north, south, and west of the site. This site is zoned C-2 and is within the Car Country Specific Plan a
the Coastal Zone. The proposed project has an architectural style generally described as Spanish rnc with clay barrel tile roofs, slump block and stucco block walls and it consists of a two-story, 26,000 squa
foot main display and sales building. There is a 1,900 square foot service drive-up structure, 21, 31
square feet of automobile repair and detail space. There are three driveways leading from Car Country
the site and 472 total parking spaces for customers, employees, sales, inventory, and repair. The proje
requires the approval of a Site Development Plan and a Coastal Development Permit. As previous
mentioned, the site is located in the Coastal Zone and is subject to the policy requirements of the Mellc
Segment. In this case, the site is not located near any coastal bluff, shoreline stream, lagoon, or tr
ocean, and essentially will not impact any coastal or agricultural resources. Due to the City Couni
Urgency Ordinance, NS 24, for commercially designated properties in that area, this project must 1:
reviewed by the Planning Commission and finally approved by the City Council. The project complies wi
City standards, is consistent with Car Country’s Specific Plan, and all of the necessary findings can t
made for the approvals being requested. Staff believes the project has addressed all issues ai
therefore warrants a recommendation of approval from the Planning Commission to the City Council.
Commissioner Compas asked if the current sales operation will be moved to this new location.
Mr. Gibson deferred the Commissioner’s question to the applicant,
Applicant, Richard Bokal, Bokal & Sneed Architects, 244 9th Street, Del Mar, responded to Comrnissionc Compas’ question by stating that it is Hoehn Motors’ intention to move their Mercedes operation to thi
new building but he has no information as to what will occupy the current Mercedes store.
Chairperson Noble opened the Public Hearing. Seeing no one wishing to testify, Chairperson Nobl
closed the Public Hearing.
