TITLE: CLOSED SESSION TO CONSIDER DEPT. HD.
INITIATION OF LITIGATION CITY ATTY.
That the City Council, by motion, authorize a closed session to receive advice from its legal
counsel regarding pending litigation since discussion in open session would prejudice the
position of the City in the litigation as follows:
Based on existing facts and circumstances, I move that the City Council
hold a closed session to decide whether or not to initiate litigation
involving the San Diego Gas & Electric, Co. at the Encina Power Plant
site and its associated properties, and their acquisition pursuant to
Government Code Section 54956.9(c).
