ENG ESTABLISH A PRIMA FACIE SPEED LIMIT UPON A PORTION OF BATIQUITOS DRIVE RECOMMENDED ACTION: Introduce Ordinance No. fls- 4 6 2 to establish a prima facie 30 mile per hour speed limit upon Batiquitos Drive from Poinsettia Lane to Camino de las Ondas. ITEM EXPLANATION: The Carlsbad Police Department requested that a prima facie speed limit be established upon Batiquitos Drive from Poinsettia Lane to Camino de las Ondas. Although located in a residential area, this road segment does not qualify as a residence district according to the California Vehicle Code. Consequently, the road does not have a prima facie 25 mile per hour speed limit and the speed limit must be established based upon the results of an Engineering and Traffic Survey. Batiquitos Drive is unclassified on the Circulation Element of the General Plan and functions as a collector road. This portion of Batiquitos Drive has a curb-to-curb width of 40 feet. It has full street improvements on both sides of the road. Sections 22357 and 22358 of the California Vehicle Code authorizes local authorities to establish a prima facie speed limit on the basis of the results of an Engineering and Traffic Survey. The Engineering and Traffic Survey considers such factors as the number of collisions that have occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight distance, and conditions that may not be readily apparent to the driver. Staff presented the results of the Engineering and Traffic Survey to the Traffic Safety Commission at their November 2, 1998 meeting. By a 3-O vote, the Commission recommended establishing a 30 mile per hour prima facie speed limit upon Batiquitos Drive from Poinsettia Lane to Camino de las Ondas. The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic Engineer. FISCAL IMPACT: Installation of two (2) speed limit signs will cost about $250. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended by the revision of Section 10.44520 to read as follows: “10.44.520 Batiauitos Drive: a. Upon Batiquitos Drive from Aviara Parkway to its intersection with Golden Star Lane, the prima facie speed limit shall be thirty-five miles per hour. b. Upon Batiquitos Drive from Kestrel Drive to its intersection with Golden Star Lane, the prima facie speed limit shall be forty miles per hour. C. Upon Batiquitos Drive from Poinsettia Lane to its intersection with Kestrel Drive, the prima facie speed limit shall be forty miles per hour. d. Upon Batiquitos Drive from Poinsettia Lane to its intersection with Camino de las Ondas, the prima facie speed limit shall be thirty miles per hour.” EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its adoption.
