ITEM EXPLANATION: The traffic signal maintenance easement is no longer necessary as the Armada Drive right-of-way has been dedicated to the City of Carlsbad and covers the area of the easement. The easement was originally needed because Armada Drive was not a public right-of-way at the time the traffic signal on Palomar Airport Road was constructed. ENVIRONMENTAL REVIEW: None. WHEREAS, Lego Carlsbad AG (Lego Carlsbad Inc.) a Swiss company has submitted a request for Quitclaim of Easement for traffic signal maintenance purposes; and WHEREAS, there is now a dedicated public road, Armada Drive, overlaying the traffic signal maintenance easement; and WHEREAS, staff has determined that the traffic signal maintenance easement is no longer needed; and WHEREAS, the City Council of the City of Carlsbad has determined it to be in the public interest to quitclaim said easement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Quitclaim Deed conveying Partnership Grant Deed of Easement to Lego Carlsbad AG (Lego Carlsbad Inc.) a Swiss company, which is on file with the City Clerk and is incorporated by this reference; is approved. 3. That the Mayor is authorized to execute the deed and the City Clerk is hereby authorized to cause the original Quitclaim Deed to be recorded in the Office of the County Recorder of San Diego County, State of California.
