DEPT. grJ AND APPROPRIATE FUNDS CITY MGR.q - CITY OF CARLSBAD -AGENDA BILL RECOMMENDED ACTION: YfS Adopt Resolution No. %I- approving the acquisition of Lot 96 in the Carlsbad Research Center and appropriating funds. ITEM EXPLANATION: As authorized in closed session held according to the Brown Act, an agreement has been reached on the purchase of Lot 96 in the Carlsbad Research Center for the purpose of providing additional acreage for the Business Park Recreational Facility. The site is located on the corner of Faraday Avenue and Camino Hills Drive and consists of 2.93 gross acres, most of which is usable. The site is directly adjacent to the 10 acre site purchased by the City in August, 1998 for the Business Park Recreational Facility. The addition of the new site will provide a total of almost 13 acres for the development of the park. The purpose of this agenda bill is to report the status of the negotiations and to obtain Council appropriation of the purchase amount. A purchase price of $I,565000 has been agreed upon for the site. If Council approves the acquisition, it is anticipated that escrow will close on December 17, 1998. Staff is requesting Council’s approval of the purchase and appropriation of funds. In addition, staff is requesting that Council authorize the Mayor and/or the City Manager, with the approval of the City Attorney, to execute all documents necessary to complete the transaction. On December 2, 1998, the Planning Commission adopted Resolution No. 4446 which determined that the project is consistent with the City of Carlsbad’s General Plan. ENVIRONMENTAL REVIEW: The Planning Director has determined that the acquisition of the subject property for use as a park/recreational facility is exempt from CEQA as a Class 16 categorical exemption [Section 15316(a)]. This section includes the acquisition of land in order to establish a park where the land is undeveloped and the management plan for the park has not been prepared. FISCAL IMPACT: The purchase price has been agreed upon at $1565,000 for the 2.93 gross acres. Staff is requesting a total appropriation of $1,575,000 which includes a $10,000 contingency to cover any miscellaneous costs related with the close of escrow. There is $1,185,000 available in current appropriations, thus an additional appropriation of $390,000 is necessary. Map indicating location of Lot 96. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 98-415 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE ACQUISITION OF LOT 96 IN THE CARLSBAD RESEARCH CENTER AND APPROPRIATING FUNDS WHEREAS, the City Council of the City of Carlsbad, California, has previously adopted a park mitigation fee for industrial development in order to provide a recreation area for the industrial-based population; and, WHEREAS, The City Council has determined that the subject property could provide for the recreational needs of the industrial based population; and, WHEREAS, under Council direction, staff has negotiated the purchase price of $1565,000 for Lot 96 in the Carlsbad Research Center; and, WHEREAS, the negotiations are now complete and the owners and City staff are in agreement with the basic terms of the sale. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the purchase of Lot 96 in the Carlsbad Research Center from Real Estate 2, LLC for a price of $1565,000 is hereby approved. 3. That the Mayor and/or the City Manager, with the approval of the City Attorney, is authorized to execute any and all documents necessary to complete the purchase. 4.
