RECOMMENDED ACTION:
That the City Council ADOPT Resolution No. qq -2 0 APPROVING a Negative DI
and the amended Financing Plan for Local Facilities Management Zone 8 based on tht
therein.

The Local Facilities Management Plan for Zone 8 was originally adopted in 1984 and I
become outdated. The applicant's request is to update the Circulation, Water, Parks, a
collection sections to reflect current facilities needs (Exhibit 6) and to include a Finance Pla

Each of the 25 Local Facilities Management Zones is required to have a financing pl
identifies the sources of funding for all Zone Plan required improvements prior to developm
the zone.
In anticipation of development within Zone 8 a Finance Plan has been prepared. The
finance plan is in conformance with the Growth Management Ordinance (Chapter 21.1
Carlsbad Municipal Code) and related policies, standards, and guidelines. The Fina
provides acceptable financial guarantees for all required public facilities, assuring that tht
will be in place at time of need.
The financing provisions for the various facilities are outlined below.
City Administrative and Library Facilities
Community Facilities District (CFD) No. 1 was formed by the City in 1991 to finance a r
facilities for citywide benefit, including City Administrative and Library. All properties withi
are currently within CFD No. 1.
Wastewater Treatment Capacity
The Encina Water Pollution Control Facility has adequate capacity to serve the City for at
years into the future. Payment of normal sewer connection fees by all development within
the only financing mechanism required.
Parks The developers within Zone 8 will be required to pay park-in-lieu fees,
Circulation
Cannon Road will be financed through the Cannon Road West Assessment District. The I
will be responsible for construction and is eligible for reimbursement. Faraday Avenue
funded through the Capital Improvements Program.
Open Space No special financing mechanism is required for open space.
Schools
The developer has entered into an agreement with the Carlsbad School District for school f

Drainaqe, Water and Sewer
The developer will be required to construct drainage, water, and sewer facilities to serve 1
development pursuant to an improvement agreement with the City, and/or to pay the requirc

No environmental impacts have been identified and a Negative Declaration was issue
Planning Director and recommended for adoption by the Planning Commission.
FISCAL IMPACT:
Approval of the staff recommendation will provide guaranteed financing for public facilities
to serve new development within Zone 8. The proposed financing mechanisms are fully c
with all Growth Management requirements and related City policies. In the absence of an (
financing plan, funding for these facilitates could not be assured.

WHEREAS, KELLY LAND COMPANY has filed a verified applica

WHEREAS, said application constitutes a request for a Local
Management Plan Amendment for Zone 8 (dated September 24, 1998, on file in the
Department) and incorporated by this reference (collectively referred to as the “Local

Findings:

ENVIRONMENTAL IMPACTS
STATE CEQA GUIDELMS, Chapter 3, Article 5, Section 15063 requires that the Ci
conduct an Environmental Impact Assessment to determine if a project may have a significa
effect on the environment. The Environmental Impact Assessment appears in the followii
pages in the form of a checklist. Ths checklist identifies any physical, biological and hum,
factors that might be impacted by the proposed project and provides the City with information
use as the basis for deciding whether to prepare an Environmental Impact Report (EIR), Negati
Declaration, or to rely on a previously approved EIR or Negative Declaration.
e A brief explanation is required for all answers except “No Impact” answers that a
adequately supported by an information source cited in the parentheses following ea
question. A “No Impact” answer is adequately supported if the referenced informati
sources show that the impact simply does not apply to projects like the one involved.
“No Impact” answer should be explained when there is no source document to refer to,
it is based on project-specific factors as well as general standards.
“Less Than Significant Impact” applies where there is supporting evidence that t
potential impact is not adversely significant, and the impact does not exceed adopt
general standards and policies.
“Potentially Significant Unless Mitigation Incorporated” applies where the incorporati

AIR OUALITY:
The implementation of subsequent projects that are consistent with and included in the updatc
1994 General Plan will result in increased gas and electric power consumption and vehicle mill

organic gases, oxides of nitrogen and sulfur, and suspended particulates. These aerosols are tl

CIRCULATION:

111. PROJECT DESCRIPTION AND BACKGROUND
The Zone 8 Local Facilities Management Plan was originally adopted in February 1989. Sir
“E”. The amendment will revise the assumptions of the four identified sections (parks, wat
circulation, and sewer) of the plan in accordance with the changes incurred by the approval

IV. ANALYSIS
Facilities Plan Amendment
The proposed Zone 8 Local Facilities Management Plan (LFMP) amendment is to reflect
reduction in land use density. Specifically, the 1989 LFMP projected 1,224 dwelling uni
within Zone 8 at buildout. This amendment projects 1,153 dwelling units (du) which is
reduction of 71 du. The reduction in units is as a result of approving 144 du in Village “I
versus the 215 du projected in the LFMP. The amended zone plan is based on an estimation 1
potential development capacity per existing ordinances and constraints. The impacts of tl
assumed development and financing to assure compliance with the adopted perfomant
standards are summarized below:

Parks
There currently exists a demand for 77.3 acres of park within Park District 1 (Northv
Quadrant) and there is an existing supply of 81.9 acres. The existing surplus is 4.6 acres. r

a 52.2 acre surplus. Park facilities will be satisfied through the payment of park-in-lieu fees an

Water
The Carlsbad Municipal Water District master plan updated in 1997 identifies sources ar
capacity for water supplies throughout Zone 8. The updated master plan has determined that tl
Evans Point water tank is no longer necessary because water supply and storage is availab
elsewhere. The requirement to dedicate land for the tank has been eliminated.
Circulation
The primary reason for amending this section is to update the existing circulation inventory a:
zone plan performance criteria. The original LFMP assumed development timing based on t
Kelly Ranch Master Plan approved in 1983. No development occurred and subsequeni
performance dates passed without circulation improvements being completed. The revis
Special Conditions are the best estimate of when circulation facilities must be completed bas
on the current assumptions.
Circulation facilities will be satisfied through the concurrent improvement of a portion
Cannon Road with the development of Kelly Ranch Village “E”; construction of Cannon Ro
between El Camino Real and Paseo Del Norte prior to 2000 or coincident with development
Kelly Ranch south of Cannon Road andor the Kirgis property; and the construction of Farad
Avenue prior to 2005 or concurrent with the development of Veteran’s Memorial Park. (TI
portion of Faraday is currently in the design and permitting process.)
Sewer
Similar to circulation facilities, the Zone Plan has been updated to include current Zone
development assumptions, and the Special Conditions have been modified to reflect thc
assumptions. Sewer facilities will be temporarily satisfied by available capacity in the No
Agua Hedionda Interceptor and ultimately through the construction of the South Agua Hedior
Interceptor.
Finance Plan
The financing provisions for the various facilities are outlined below.

Zone 8 is the only financing mechanism required.

The developers within Zone 8 will be required to pay park-in-lieu fees and PFF.
Circulation
Cannon Road will be financed through the Cannon Road West Assessment District.

Project Planner Christer Westman presented the staff report and described the project as follows: Tt
applicant, Kelly Land Company, has requested an amendment to the Local Facilities Management Plan fi
Zone 8. The reason for the request is that there was a recent approval for a project, within what is know
as the Kelly Ranch, that altered the number of total dwelling units within Zone 8. Because a change in th
number of dwelling units changes the number of required public facilities and fees, the applicant
requesting an amendment to the Zone Plan. It includes updates to certain facilities regarding circulatior
sewer, water, and parks. In addition, the amendment includes a financing plan as the document whic
identifies how all of the facilities will be paid for.
Paul Klukas, Planning Systems, representing Kelly Land Company, stated that the LFMP and financin
plan was a joint effort between Kelly Land Co. and staff.
Chairperson Noble opened Public Testimony and offered the invitation to speak. Seeing no one wishinl
to testify, Chairperson Noble closed Public Testimony.

1. PERFORMANCE STANDARD
No road segment or intersection in the zone nor any road
segment or intersection out of the zone which is impacted by
development in the zone shall be projected to exceed a service
level C during off-peak hours, nor service level D during peak
hours. Impacted means where twenty percent or more of the
traffic generated by the Local Facility Management Zone will use
the road segment or intersection.
FACILITY PLANNING AND ADEQUACY ANALYSIS
This analysis determines whether or not the circulation system
within Zone 8 continues to conform in this updated LFMF to the
adopted performance standard. The analysis also addresses all
Circulation Element roads and intersections outside of Zone 8
impacted by 20 percent or more of the traffic generated in Zone8
to ensure conformance with the standard.

A Existing Inventorv - 1997
El Camino Real to the north east edge of Zone 8, is a partially
improved six lane primary arterial with only four lanes existing
between Tamarack Avenue and College Blvd. to the south.
Cannon Road presently stubs to the west-central boundary of the
Zone, just westerly of Macario Canyon. This roadway is planned
to be constructed through the Zone as a four lane major arterial
from its current terminus, easterly to El Camino Real and
beyond.
Kelly Drive extends southwest from El Camino Real and forms
the northerly boundary of the Zone. It is designated as a
collector street, striped with two lanes, to Park Drive. It is built

to four lane collector street width, but does not currently have
sufficient traffic volume to justify striping with four lanes. Park
Drive is a two lane collector street that extends northerly of the
Zone, and intersects Tamarack Avenue to the north, well
beyond the Zone boundary.
Tamarack Avenue, not within Zone 8 and to the north, varies in
width as a collector street from four lanes between 1-5 and
Adams Street, two lanes between Adams and High Ridge
Avenue, then four lanes again between High Ridge and El
Camino Real.
Table I-L and Exhibit A demonstrate the existing average traffic
volumes and levels of service for the street segments
surrounding the Zone.

These assigned trips were then added to available existing traffic
volumes factored upward to account for area-wide growth. The
combined traffic volumes (i.e., Existing and Area Growth and
Zone 8) were then used to determine the future short-term
(called Phase I in this study) and long term (Buildout) impact
and mitigation.
The traffic circulation network and the projected impacts,
resulting from traffic generated from Zone 8 were analyzed by
utilizing data from the Transportation Analysis for Zone 8 and
Kellv Ranch prepared by Urban Systems Associates, Inc., dated
September 23,1997.
Exhibit A demonstrates the directional distribution percentages
of Zone 8 traffic at buildout of the zone.
As mentioned, development within the first two years of
phasing (1998-99) is anticipated to occur within Planning Areas
A, C and E (Phase I). During this period, Cannon Road will be
constructed only from the Planning Area E access road (Frost
Street) to El Camino Real. Exhibit B demonstrates the roadway
configurations planned and traffic volumes projected with this
first two years of development. An examination of street
segment average daily traffic volumes with these initial
planning areas traffic added leads to the conclusion that street
segments would continue to operate within the performance
standard (Tables 1-0). The only improvements recommended
for this phase would be the construction of Cannon Road along
the Planning Area E frontage between El Camino Real and Frost
Street.

The extension of Cannon Road through Zone 8 to El Camino
Real and the Cannon Road/I-5 interchange improvements
planned have been designed to accommodate City buildout
traffic projections including Zone 8. The Cannon Road and 1-5
interchange improvements are scheduled for completion by the
City in the years 2000 through 2001, coinciding with the
anticipated development of the final three years of development
phasing of Zone 8.

5. MITEATION:
The original Zone 8 LFMP analysis assumed a certain level of
development intensity and phasing. The purpose of this
updated analysis is to evaluate impacted road segments and
intersections serving Zone 8, and assess whether the impacted
road segments and intersections. Zone 8 will continue to meet
the adopted performance standard when the revised
development scenario and phasing of the Zone is added to the
equation.
The Zone 8 LFMP land use assumptions associated with this
amendment are less intense than those assumed in the 1988
Zone 8 LFMP. The currently designed improvements for
Cannon Road between 1-5 and El Camino Real, including 1-5
interchange improvement designs, have taken into account
anticipated Zone 8 traffic. Therefore, no changes to the currently
designed Cannon Road improvements are recommended in
conjunction with this LFMP amendment.
Year 2000 and beyond development within Kelly Ranch is
planned to coincide with the construction of Cannon Road
through the zone. Traffic signals are recommended at the
Faraday Avenue and Frost Street intersections on Cannon Road
during this period.
4. SPECIAL CONDITIONS (Modified)
The proposed mitigation for Zone 8 circulation is based upon the
phasing of development and anticipated impacts afier Zone 8
buildout. The mitigation measures presented below will ensure
that the adopted performance standard will be maintained
through buildout of Zone 8. It should be understood that all cost
estimates presented in this LWP Amendment are preliminary
in nature and will need further refinement as the actual scope of
work, utility needs, and right-of-way requirements are
determined.
1. An on-going monitoring program shall be established to
evaluate the aspects of improvement, development, and
demand on circulation facilities. The required timing of
improvements is based upon the projected demand of
development in the zone and the surrounding region.
This timing may be modified without amendment to this
plan, however, any deletions or additions to the
improvements will require amending this local plan.

C. SEWER COLLECTION SYSTEM
I, PERFORMANCE STANDARD:
Trunk-line capacity to meet demand as determined by the
appropriate sewer district must be provided concurrent

2. ADEQUACY ANALYSIS:
CHANGES FROM THE APPROVED LFMP:
In accordance with the Approved 1988 Zone 8 LFMP, the
ultimate plan for the Zone 8 region of Carlsbad involves
the construction of a master plan sewer project, called the
South Agua Hedionda Interceptor (SAHI) Sewer, which
will incorporate a pump station and force main to carry
the wastewater from the western-flow gravity sewer at the
edge of the Zone 8 Agua Hedionda wetlands parallel to
future Cannon Road. a
The SAHI sewer is a regional facility which is planned to
serve a large area of the City of Carlsbad, the vast majority
of which lies upstream from Zone 8. For this reason, the
line is planned to be a 24" trunk line, greatly in excess of
that required for Zone 8 development.
The Approved Zone 8 LFMP dictates that all development
within the Zone, with the exception of Areas "A and "C
(which are located on the north shore of Agua Hedionda
Lagoon), will access a fully-installed SAHI Trunk line for
sewer connection to the Wastewater Treatment Plant.

Although sufficient capacity in the NAHI Line exists to
accommodate projected Area A, C and E development, it
is unknown at the time of this report whether capacity
will be available to accommodate the full Kelly Ranch
project at buildout. Other future EDU’s committed to the
North Agua Hedionda Interceptor Sewer are estimated by
the Carlsbad Municipal Water District as development
occurs:

In 1997, the Carlsbad Municipal Water District evaluated
the theoretical flow rate currently tributary to the existing
North Agua Hedionda Interceptor Sewer and compared
that estimate to the capacity of the sewer pigeline and the
Foxes Lift Station. Foxes Lift Station pumps all sewage
tributary to the NAHI Sewer. From the analysis, it was
concluded that approximately 0.5 mgd of additional
capacity remains. This flow rate equates to an additional
1100 EDU’s, approximately, that can be accommodated
above the existing number of connections.
Based on the resulting projected flow rate of 0.9 mgd, the
Carlsbad Municipal Water District cannot guarantee that
adequate capacity exists in the North Agua Hedionda
Interceptor Sewer for all phases of Kelly Ranch (beyond
Area E) and Kirgis development, and additional
development will need to be evaluated by the District on a
case-by-case basis.

This LFMP Amendment anticipates (graphically in
Exhibits C through F)the opportunity for much of Zone 8

FACILITY FINANCING PLAN
A. INTRODUCTION
1. Purpose of Document
This Facilities Financing Plan has been prepared in conjunction with the LC
Facilities Management Plan for Zone 8, in satisfaction of the requirements I
the City of Carlsbad Growth Management Program (Municipal Code Sectii
21.90.010 et seq.).
This Plan provides financing information based on the facilities projected t
the Zone 8 Local Facilities Management Plan (LFMP), and its Amendment
No. 1, and based on the Carlsbad Growth Management Program performa
standards. Sources of funds and methods of guaranteeing funding are fou
in this plan. Also found are Special Conditions as provided in the Zone 8
LFMP, as Amended.
2. Sources of Information
In addition to the Zone 8 LFMP document and Zone 8 LFMP Amendment
No. 1, sources used in this plan are the Carlsbad Capital Improvement
Document (1998-99), various public facilities master plans, and direct
conversations with city staff.
3. Ownership Circumstances in LFMP Zone 8
The ownership of property within Zone 8 consists of three landholdings; tl
432.8 acre Kelly Land Company property, the 21.9 acre Kirgis property, an
276.5 acres owned by the City of Carlsbad, known as Macario Canyon.

4. Finance Method
Section 21.90.080 of the Municipal Code requires a "financing guarantee" fc
sources and as such the use of these funds to implement provision of publi
facilities constitutes that guarantee.
Developer Funding
Under this method, the developer will fund and construct certain required
facilities prior to or concurrent with development of his particular propert

Citv of Carlsbad Communitv Facilities District No. 1
A Mello-Roos community facilities district has been formea by the City of
Carlsbad and approved on May 7,1991 by an affirmative vote of land owr
to fund construction of certain Citywide facilities, including a number of
facilities which are required by the Zone 8 LFMP.
The financing guarantee required by the growth Management Ordinance
any of the facilities to be funded by Carlsbad CFD No. 1 is satisfied by
annexation to and participation in the district.
Development Impact Fees
Capital Improvement Program of the City of Carlsbad and special district
contain plans to construct certain facilities including a number of facilities
which are required by the Zone 8 LFMP. Sources of funds for these facilit
are development impact fees which are collected at issuance of building
permit.

That sufficient, unobligated funds are available;
That the reimbursement is consistent with the priority of project
funding within the most recent adopted Capital Improvement
Program; and
That the reimbursement shall not exceed the maximum amount
budgeted in the most recent adopted Capital Improvement
Program.
B. TIMING OF DEMAND
Demand for various facilities is based on the type of development, its locatior
within the zone and when new development will be "on line". This analysis u
the Phasing projection identified on Exhibit A of this Financing Plan for
projections regarding type, location and timing of new development. The LR
and its Amendment No. I, which modifies the analysis for Parks, Circulation
Sewer Collection Facilities, analyzes the impact of new development on the
eleven identified public facilities categories and shows specific public facilitie
requirements over time. The financing plan demonstrates how the projected
facilities requirements will be funded over time.
C. FINANCING
Public facilities funding sources and funding responsibilities, based on Zone
development projections identified through the Zone 8 LFMP, are described
this section. Special Conditions which deal with facilities and funding are
provided as found in the LFMP. The following are sections which deal with
of the identified public facilities categories.

9. SCHOOL FACILITIES
Facility
The following Special Conditions are contained in the Zone 8 LFMP:
Prior to the recordation of any residential final map, issuance of grading pern
or building permit, whichever occurs first, in Zone 8, an agreement shall be
entered into between Carlsbad Unified School District and the affected prope
owner(s> that shall provide for the following:
1. The deeding of an acceptable school site to the Carlsbad Unified Schoc
District if it is determined by the District a school within Zone 8 is
warranted.
2. A financing plan approved by the City and Carlsbad Unified school
District guaranteeing the construction of necessary elementary school
facilities in Zone 8 pursuant to condition #l.
If any reimbursements and/or school fee credits are to be given, the school
agreement/financing plan shall provide a mechanism to do so.
School Agreement -
A Carlsbad Unified School District School Facilities Mitigation Agreement
between the Kelly Ranch developer and the Carlsbad Unified School District
executed on November 20,1997, which provides that a school site will not be
necessary within Zone 8, and that annexation of the property into Carlsbad
Unified CFD No. 3 will satisfy the funding of school facilities, This agreemen
in compliance with the LFMP condition which requires deeding of a school sj
