originally dedicated to the City of Carlsbad at Aviara Planning Area 26 South Unit 1.

ITEM EXPLANATION:
This is a request by Taylor Woodrow Homes California Limited to quitclaim portions of existing
open space easements located at Aviara Planning Area 26 South Unit 1 at the back of the
properties along Corvidae Street and Calidris Lane. These properties are all presently developed and privately owned.
The open space easements were originally dedicated as part of the final map for Carlsbad Tract
CT 90-36 Unit 1. The subject open space easements were delineated to follow the top of graded slopes for maintenance purposes by the Aviara Master Association. The open space is not part of
the City designated open space, it does not contain any habitat, and was not required by the Coastal Commission. During the grading operation, the top of the slopes were located as close to
the designed location as grading precision allows. The perimeter fencing at the rear of the
residential lots was installed to match the top of slope location. The quitclaims are necessary
because the perimeter fencing, as installed, encroach slightly into the open space easements at
25 locations. The total area of the encroachments is 2,409 square feet or 0.055 acres. The total
area of the existing open space easements is 489,353 square feet or 11.234 acres. Demolition and
relocation of the fence at this time is not a reasonable option since these properties are occupied.
Planning and Engineering staff has reviewed the requested quitclaims. Staff recommends approval
of the open space quitclaims requested by Taylor Woodrow Homes California Limited.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING QUITCLAIM DEEDS
FOR PORTIONS OF EXISTING OPEN SPACE EASEMENTS
ORIGINALLY DEDICATED TO THE CITY OF CARLSBAD AT AVIARA PLANNING AREA 26 SOUTH UNIT 1.
WHEREAS, Taylor Woodrow Homes California Limited has submitted a request for
quitclaims for portions of existing open space easements originally dedicated to the City of
7 Carlsbad over a portion of Aviara Planning Area 26 South Unit 1; and
8 WHEREAS, the open space is not part of the City designated open space, does not
9 contain any habitat, and was not required by the Coastal Commission; and
IO WHEREAS, the quitclaims are necessary because the existing perimeter fencing at the
11 rear of the residential lots have been installed slightly within the open space easement in 25
12

locations; and
WHEREAS, the demolition and relocation of the fence at this time is not a reasonable
14 option since these properties are already occupied; and,
WHEREAS, the City Council of the City of Carlsbad has determined it to be in the public
15 interest to quitclaim said portions of easements;
16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
17 California, as follows:
18 1. That the above recitations are true and correct.
19 2. That the 25 quitclaim deeds quitclaiming portions of the existing open space
20 easements to the current property owners, which are on file in the City Clerk’s office and are
