RECOMMENDED ACTION:
1. City Council hold a public hearing on COPS funding per AB 3229 (Brulte) Citizens
Option for Public Safety.
2. That the City Council adopt Resolution No. ?9- 66 accepting AB 3229 funds and
interest and appropriating the funds and interest to continue the funding of two full-
time police officers for the year-round bicycle patrol program.
ITEM EXPLANATION:
AB 3229 provides supplemental funding for local law enforcement. The law requires
that the funds be placed in a supplemental law enforcement services fund (SLESF). It
provides that those funds only be spent to provide “front line police services” and must
supplement and not supplant existing funding for front line police services.
It further provides that at public hearings, city councils appropriate existing and
anticipated AB 3229 monies including interest. AB 3229 funds for FY 1998-99 are
$165,229.12 plus interest earned.
The City of Carlsbad has funded a year-round bicycle patrol for the past two years with
the AB 3229 funds. The program has proved very popular and effective and a
significant improvement over the previous seasonal part-time bicycle patrol. The Chief of
Police is requesting that fiscal year 1998-99 AB 3229 funds including interest be
appropriated for the continued funding of two full-time police officers and the
equipment necessary to field a full-time bicycle patrol in the City of Carlsbad.
FISCAL IMPACT:
The total program cost for FY 1998-99 is $165,299.12 and would come from AB 3229
funding.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING AB 3229 FUNDING FOR
1998-99 YEAR-ROUND POLICE OFFICER BICYCLE PATROL
WHEREAS, the City Council of the City of Carlsbad held a public hearing on Februaru,
16 t 1999, to accept comments for the appropriation of AB 3229 (Brulte) Citizens Options for
Public Safety (COPS) funding and interest earned to continue the support the 1998-99 year-
round bicycle patrol program; and
WHEREAS, the City Council selected the year-round bicycle patrol program and funding
allocations following the public hearing on February 16 , 1999; and
WHEREAS, the City Council has taken all public testimony and comments into account.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. The City Council hereby appropriates COPS funding of $166,229.12 plus interest
to the Police Department COPS bicycle patrol fund.

Attached are the materials for you to notice the COPS grant item for a public
hearing before the City Council. Please notice the item for the Council meeting
of ;3-l(p-44
This public hearing does not require a ten-day notice. It requires the standard
notice for a general public hearing, similar to the Community Development
Block grant program. A 72-hour notice in the newspaper will be sufficient to
meet the regulations of the grant program.

Notice of Public Hearing
The citizens of Carlsbad are hereby notified that Carlsbad’s City Council will
hold a public hearing on Tuesday, February 16 ,. 1999, at 6 p.m. in the Council Chambers located at 1200 Carlsbad Village Drive to accept public
comments and consider for approval: 1) the acceptance of Senate Bill 3220
(Brulete) funds and earned interest; and, 2) appropriating the funds to support
to continue the funding of two full-time police officers for the year-round
bicycle patrol program.
SB 3229 provides supplemental funding for local law enforcement. The law
requires that the funds be placed in a supplemental law enforcement services
fund (SLESF). It provides that those funds only be spent to provide “front-line
police services” and must supplement and not supplant existing funding for
front-line police services.
It further provides that at public hearings, city councils appropriate existing
and anticipated SB 33229 moneys including earned interest. SB 3229 funds
for FY 199899 are $165,229.12 plus interest earned.

years with the SB 3229 funds. The program has proved very popular and
effective and a significant improvement over the fiscal year 199899 SB 3229
funds including interest be appropriated for the continued funding of two full-
time police officers and the equipment necessary to field a full-time bicycle
patrol in the City of Carlsbad.
These proposed expenditures comply with the requirements of SB 3220
appropriation funding.
