CMWD CMWD PROJECT NO. 86-504 CITYATTY. - RECOMMENDED ACTION: Adopt Resolution No. 99 -80 for approval and execution of a quitclaim deed of a water pipeline easement over a portion of Lot 7, Mariners Point, CMWD Project No. 86-504. ITEM EXPLANATION: This item is a request of Stephen D. Doan and Tahra D. Doan, owners of Lot 7, Mariners Point, located between Lemon Leaf Drive and Aviara Parkway. The owners have requested that the portion of a water easement granted to the City of Carlsbad by Final Order of Condemnation, Superior Court Case No. N69945, recorded November 15, 1996 as File No. 1996-9578777 0. R., attached as Exhibit 2 be quitclaimed. The engineering staff has reviewed the request which resulted in the following conclusion. The condemnation order was issued in the interest of public and general welfare for the “Alga Road Project.” The easement was obtained by the City to temporarily relocate an existing water pipeline around the roadway construction. The water pipeline has since been relocated to a public road right-of-way, and the easement is no longer necessary since the water pipeline has concurrently and adequately been provided for within the public right-of-way. The City of Carlsbad did not pay for the easement, however, the City did grant road credits to the Developer of Tract 91-12. In view of the small portion of the water pipeline easement being requested for quitclaim by the home owner, the staff recommends the Council waive the cost of the refund of the roadway credit to quitclaim the easement to the homeowner. Therefor, the staff advocates it would be in the best interest of public relations to grant the homeowner’s request. FISCAL IMPACT: This item has no fiscal impact. The quit claim deed is a small portion of the original easement obtained by the aforementioned Order of Condemnation, and the engineering staff recommends the small portion of the Order of Condemnation be quitclaimed to the home owners in the best interest of pubic relations. The Developer of Tract 91-12 has paid the standard $200 fee for processing of a quitclaim. ENVIRONMENTAL REVIEW: The Planning Director has determined that this item is exempt in accordance with CEQA Guidelines Section 15061 (b)(3) (the “General Rule”). The activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. EXHIBITS: 1.
