RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA APPROVING A REQUEST TO
PREPARE AN AMENDMENT TO THE ZONE 8 LOCAL
FACILITIES MANAGEMENT PLAN BY THE KELLY LAND
COMPANY
CASE NAME: ZONE 8 AMENDMENT “B”

The City Council of the City of Carlsbad, California, does hereby re
follows:
WHEREAS, Carlsbad Municipal Code Section 21.90.1 20 indicates for
which joint submission by all property owners of a facilities management plan is not
any owner may petition the City Council to allow the owner to prepare the plan; and
WHEREAS, there are three property owners within the boundaries of
who are Kelly Land Company, Kirgis Trust and City of Carlsbad; and
WHEREAS, repeated attempts to gain written agreement from Kirgis
Kelly Land Company have not been successful; and
WHEREAS, Kelly Land Company has formally petitioned the City Cc
authorize preparation of an amendment to the Zone 8 Local Facilities Management Plar
NOW THEREFORE BE IT RESOLVED by the City Council of the
Carlsbad as follows:
1. The above recitations are true and correct.
2. The City Council authorizes the Kelly Land Company to prep
amendment to the Zone 8 Local Facilities Management Plan.

RE: Zone 8 Local Facilities Management Plan Amendment
Kelly Land Company
Dear Ray,
Kelly Land Company recently commissioned the preparation of a second amendment to
the Zone 8 Local Facilities Management Plan. This amendment was determined to be
necessary to accommodate updated information regarding buildout and other assumption:
of the original LFMP and Amendment No. 1 to that LFMP. Our proposed amendment
has been reviewed by Staff and is now ready for action by the Planning Commission and
City Council.
Three property owners exist within Zone 8, Kelly Land Company, Kirgis Trust, and the
City of Carlsbad. We have again tried to receive written ageement to proceed with this
amendment from the Kirgis Trust. Mr. Charles Kirgis has been provided with copies of
the proposed amendment. We have assured him that Kelly Land Company is providing
full funding for the professional tasks necessary to prepare the amendment. To date, we
have still not received any response from Kirgis on this matter.
In compliance with Section 21.90.120(d) of the Carlsbad Municipal Code, Kelly Land
Company hereby requests that the City Council permit Kelly Land Company to prepare
the subject Zone 8 Local Facilities Management Plan Amendment on behalf of the Zone
8 landowners.
Please schedule this request for the earliest possible City Council hearing.
