Fox Construction in the amount of $413,720.80. I ITEM EXPLANATION : On October 20, 1998, the City Council approved plans and specifications and authorized the advertising for bids for Carrillo Ranch Phase IA. The project consists of construction of perimeter walls, fencing, gates and landscaping around the 27 acre future park site. I On January 14, 1999, the following six sealed bids were received: 1. Accurate Excavating $328,648.00 4. Weir Construction $484360.90 2. R. Fox Construction $413,720.80 5. Pacific Alliance Contractors $488.488.00 3. Arbor Services $458,482.00 6. RIHA Construction $644,509.60 I Engineers Estimate $382,216 Subsequent to the bid opening, the apparent low bidder, Accurate Excavating, submitted a “Notice of Clerical Error and Withdrawal of Bid” letter (under section 5101 et seq. of the Public Contracts Code). The letter described a significant clerical error made in calculations of the unit prices of a major bid item. Based on the information provided, the Purchasing Officer reviewed and approved the withdrawal of bid. Therefore, lowest responsible bidder is R. Fox Construction in the amount of $413,720.80. This bid is $31,500 over the Engineers estimate (approximately 8%) and is considered by staff to be in an acceptable range. I ENVIRONMENTAL COMPLIANCE: This project was reviewed by the Planning Department and determined to be exempt from California Environmental Quality Act based on Section 15061 Sub-Section 3, that the activity will have no significant effect on the environment. I FISCAL IMPACT: Construction $413,721 Contingency (15%) +62,058 Inspection and Administration (5%) +23.789 TOTAL COST $499,568 Funds in the amount of $737,161 are available in the Carrillo Ranch Phase I project account. II WHEREAS, the lowest responsible bid was submitted by R. Fox Construction in the amount of $413,720.80; and WHEREAS, sufficient funds are available in the project account to cover the 14 15 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, the following: 16 17 18 19 20 21 1. That the above recitations are true and correct. 2. That the lowest responsible bid submitted by R. Fox Construction in the amount of $413,720.80 in hereby accepted and the Mayor is hereby authorized to execute a contract on behalf of the City for the Carrillo Ranch Phase IA, Project No. 3456-A. 22 23 24 25 26 27 3. That the award of contract is contingent upon R. Fox Construction executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution.
