APPROVAL OF A LUMP-SUM REIMBURSEMENT TO
TRAFFIC SIGNAL INSTALLED AT THE INTERSECTION
OF ALGA ROAD AND MELROSE DRIVE
(CT 85-19)
RECOMMENDED ACTION:
Adopt Resolution No. 99- 11 s approving an immediate lump sum reimbursement to
CreeWCarlsbad, LLC for cost of a traffic signal at the intersection of Alga Road and Melrose C
ITEM EXPLAN AT1 ON :
As a condition of approval for the Meadowlands development (CT 85-19), the applicant,
CreeklCarlsbad, LLC, (Darby Creek), also known as the Jenna Group, was required to in
traffic signal at the intersection of Alga Road with Melrose Drive. Darby Creek was going to this traffic signal, with City reimbursement from CIP, during the third phase of construction fG project. Continental Homes was also required to install this traffic signal, with City reimbursc
from CIP, as a condition of approval for Rancho Carrillo. Continental Homes installed the
signal to serve three legs of the Alga Road/Melrose Drive intersection to facilitate the develol
of their project and to complete the construction of Melrose Drive. At the City’s direction, I
Creek accelerated their construction phasing schedule and installed the remaining portion I
traffic signal to lessen construction impacts to motorists on the newly opened Melrose Drive.
traffic signal installation had been approved as part of the 1997-98 Capital Improvement Prc
(CIP) budget to be funded by public facilities fees. Since the City requested that Darby t
accelerate their construction schedule and install their portion of the traffic signal before rea
phase three of their project and their conditions of approval allowed reimbursement, Darby Crt
entitled to reimbursement for their portion of the costs incurred.
Staff has reviewed the applicants request and recommends that the City Council authoriz
Finance Director to reimburse Darby Creek for their share of the cost of the traffic signal instal
in the amount of $39,500.00.
FISCAL IMPACT:
Funds in the amount of $39,500.00 are available in Account Number 320700009060-35781 -9
reimburse the applicant for cost of installing the traffic signal at Alga Road and Melrose Drive.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING IMMEDIATE LUMP SUM
REIMBURSEMENT TO DARBY CREEWCARLSBAD, LLC FOR
COST OF A TRAFFIC SIGNAL AT THE INTERSECTION OF ALGA
ROAD AND MELROSE DRIVE.
WHEREAS, the Darby CreeWCarlsbad, LLC, as a condition of approval fi
development of the Meadowlands, did complete the installation of the traffic signal
intersection of Alga Road and Melrose Drive; and
WHEREAS, the Darby CreeWCarlsbad, LLC has submitted detailed accounting rt
verified by City Staff, which show that the total audited cost to install the signal was $39,:

WHEREAS, adequate funds currently exist within Account Number 32070001
35781-900 to reimburse the developer for the stallation of their portion of the traffic signa
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ca

That the Finance Director is hereby directed to make an immediate or
reimbursement to the Darby CreeWCarlsbad, LLC in the amount of $39,500.00 for the insti

Dear Mr. Shirey:
Enclosed please find our submittal for reimbursement of $39,500.00 for our cost to signalize
the Melrose/Alga intersection.
The costs we are requesting to be reimbursed are solely pertaining to the design and the
construction of the signalization. As you know we have incurred a large cost expenditure
that we were not obligated to incur until our final improvement phase. We did this at the
request of the City to faciliate the opening of Melrose to Palomar Auport Road. By co-
operating with the City we have had to pay approximately $IOO,OOO.OO for construction not
covered by our current Phase 1 construction loan. Therefore, we respectfully request full
co-operation from the City in the prompt processing of this request for payment.

No. 15,125, and Resolution No. 99-1 15 These documents went before the City
Council on April 6, 1999, when the Resolution was adopted, approving the lumb
sum reimbursement of costs incurred for installation of a traffic signal at the
intersection of Alga Road and Melrose Drive.
