That the City Council ADOPT Resolution No. ciq-Iy< , APPROVING CUP 98-12 and CDP
98-56.
ITEM EXPLANATION:
On March 17, 1999, the Planning Commission conducted a public hearing and unanimously
recommended approval of a conditional use permit and coastal development permit for a second
Costco Wholesale monument sign located at 951 Palomar Airport Road in the C-2-Q zone and Mello
II Segment of Carlsbad’s Local Coastal Program. The project is subject to an Urgency Ordinance
requiring Council approval due to its location within the boundaries of the Carlsbad Ranch Overlay
Zone. In accordance with the City’s Sign Ordinance (Chapter 21.41 of the Municipal Code),
additional monument signs in the C-2 zone require approval of a conditional use permit.
The proposed installation of a second monument sign adjacent to the westerly COSTCO entry
driveway requires findings that the sign is appropriate for the use, compatible in design with
surrounding development, does not result in the proliferation of signs in the area, does not interfere
with the safety of the traveling public, and does not adversely affect the appearance of the area or
restrict any views. Based on staffs analysis (see pages 2 and 3 of the attached staff report), the
Planning Commission and staff are recommending that these findings be made since the proposed sign is compatible in design with the existing COSTCO monument sign and consistent with all Sign
Ordinance development standards regulating its location, spacing, size, and orientation.
ENVIRONMENTAL REVIEW:
The construction of an on-premise sign that is accessory to an existing commercial development is
categorically exempt from Section 15311 of the California Environmental Quality Act.
FISCAL IMPACT:
All public facilities to serve this development are in place.

The City Council of the City of Carlsbad, California, does hereby resolve as
WHEREAS, on March 17, 1999, the Carlsbad Planning Commission held a duly
noticed public hearing to consider a proposed Conditional Use Permit and .Coastal
Development Permit to allow the installation of a second Costco Wholesale monument sign,
and adopted Resolutions 4501 and 4502 recommending to the City Council that the Conditional
Use Permit and Coastal Development Permit be approved; and
WHEREAS, the City Council of the City of Carlsbad, ‘on I 26th day of ADril
1999, held a duly noticed public hearing to consider the recommendation and heard all persons
interested in or opposed to CUP 98-12 and CDP 98-56.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the recommendation of the Planning Commission for the approval of
Conditional Use Permit CUP 98-12 and Coastal Development Permit CDP 98-56 is approved
and that the findings and conditions of the Planning Commission contained in Planning
Commission Resolutions No. 4501 and 4502 on file with the City Clerk and incorporated herein
by reference, are the findings and conditions of the City Council.
3. This action is final the date this resolution is adopted by the City Council.
The Provisions of Chapter 1 .I6 of the Carlsbad Municipal Code, “Time Limits for Judicial
Review” shall apply:

“The time within which judicial review of this decision must be sought
is governed by Code of Civil Procedure, Section 1094.6, which has
been made applicable in the City of Carlsbad by Carlsbad Municipal

Findings:
That based on the evidence presented at the public hearing, the Commission
of COSTCO MONUMENT SIGN CUP 9%
12, based on the following findings and subject to the following conditions:
1. That the requested use is necessary or desirable for the development of the community, is
essentially in harmony with the various elements and objectives of the General Plan, and
is not detrimental to existing uses specifically permitted in the zone in which the
proposed use is located, in that as required by Section 21.41.075(b) of the Carlsbad
Municipal Code, the proposed second monument sign would not result in the
proliferation of signs since the Costco project has extensive (l,OOO’+) frontage and
the proposed monument sign would be located at the western end of the site
approximately 1,000’ from the existing monument sign. The proposed sign does not
adversely impact the area since it is consistent in appearance and size with the
existing monument sign, and its location adjacent to the second entry driveway is
appropriate in that it identifies the driveway as an entry to the Costco store. The 6’
high sign is situated perpendicular to the roadway and located 22’ from the face of
curb and setback 15’ from the driveway thereby avoiding any interference with
sight distance or obstruction of views.
2. That the site for the intended use is adequate in size and shape to accommodate the use, in
that ample area exists within the landscape setback along the extensive road frontage
for the installation of monument signage.
3. That all the yards, setbacks, walls, fences, landscaping, and other features necessary to
adjust the requested use to existing or permitted future uses in the neighborhood will be
provided and maintained, in that the proposed monument sign is consistent in
appearance and area to the existing Costco monument sign and landscaping around
the base of the sign will be provided.
4. That the street system serving the proposed use is adequate to properly handle all traffic
generated by the proposed use, in that the second monument sign will generate no
additional traffic.
5. That the Planning Director has determined that the project is exempt from the
requirements of the California Environmental Quality Act (CEQA) per Section 15311 of
the state CEQA Guidelines and will not have any adverse significant impact on the
environment.
Conditions:
1. Staff is authorized and directed to make, or require Developer to make, all corrections
and modifications to the Conditional Use Permit document(s) necessary to make them
internally consistent and in conformity with final action on the project. Development
shall occur substantially as shown in the approved Exhibits. Any proposed development
different from this approval, shall require an amendment to this approval.

The installation of shrubs that are a minimum of 12 inches in height shall be
installed and maintained at all times around the entire base of the monument sign
for the purpose of enhancing the overall appearance of the monument structure.
Prior to issuance of a sign permit for the second monument sign, the approved Sign
Program, PS 91-73(B), shall be amended in conformance with Exhibit “B” dated
March 17, 1999, thereby ensuring that the aggregate project signage shall not
exceed the area permitted by the sign program.
This Conditional Use Permit is granted for a period of 10 years. This Conditional Use
Permit shall be reviewed by the Planning Director on a yearly basis to determine if all
conditions of this permit have been met and that the use does not have a substantial
negative effect on surrounding properties or the public health and welfare. If the
Planning Director determines that the use has such substantial negative effects, the
Planning Director shall recommend that the Planning Commission, after providing the
permittee the opportunity to be heard, add additional conditions to reduce or eliminate the
substantial negative effects. This permit may be revoked at any time after a public
hearing, if it is found that the use has a substantial detrimental effect on surrounding land
uses and the public’s health and welfare, or the conditions imposed herein have not been
met. This permit may be extended for a reasonable period of time not to exceed 10 years
upon written application of the permittee made no less than 90 days prior to the
expiration date. The Planning Commission may not grant such extension, unless it finds
that there are no substantial negative effects on surrounding land uses or the public’s
health and welfare. If a substantial negative effect on surrounding land uses or the
public’s health and welfare is found, the extension shall be denied or granted with
conditions which will eliminate or substantially reduce such effects. There is no limit to
the number of extensions the Planning Commission may grant.
The Developer/Operator shall and does hereby agree to indemnify, protect, defend and
hold harmless the City of Carlsbad, its Council members, officers, employees, agents, and
representatives, from and against any and all liabilities, losses, damages, demands, claims
and costs, including court costs and attorney’s fees incurred by the City arising, directly
or indirectly, from the City’s approval and issuance of this Conditional Use Permit.
Approval of CUP 98-12 is granted subject to the approval of CDP 98-56. CUP 98-12 is
subject to all conditions contained in Planning Commission Resolution 4502 for the
CDP 98-56.
If any of the foregoing conditions fail to occur; or if they are, by their terms, to be
implemented and maintained over time, if any of such conditions fail to be so
implemented and maintained according to their terms, the City shall have the right to
revoke or modify all approvals herein granted; deny or further condition issuance of all
future building permits; deny, revoke or further condition all certificates of occupancy
issued under the authority of approvals herein granted; institute and prosecute litigation to
compel their compliance with said conditions or seek damages for their violation. No
vested rights are gained by Developer or a successor in interest by the City’s approval of
this Conditional Use Permit.

two (2) years of approval or this coastal development permit will expire unless

subject to all conditions contained in Planning Commission Resolution 4501 for CUP
98-12.

Request for a recommendation of approval of a Conditional Use Permit and
Coastal Development Permit to allow the installation of a second Costco
monument sign located at 951 Palomar Airport Road in the Coastal Zone and
Local Facilities Management Zone 5.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolutions No. 4501 and 4502
RECOMMENDING APPROVAL of CUP 98-12 and CDP 98-56 based on the findings and
subject to the conditions contained therein.
II. INTRODUCTION
The applicant is requesting approval of a conditional use permit and coastal development permit
to allow a second monument sign located adjacent to the westerly driveway entry to the Costco
retail facility at 951 Palomar Airport Road. As designed and conditioned, the proposed sign is
consistent with all applicable zoning regulations and Mello II LCP regulations for a second
monument sign to serve a commercial facility. The project is subject to the Carlsbad Ranch
Overlay Zone Urgency Ordinance which requires that the City Council have final review and
approval of all commercial projects that would otherwise receive final approval from the
Planning Commission.
III. PR OJECT D
The applicant is requesting that the Planning Commission recommend approval of a conditional
use permit and coastal development permit to allow the installation of a second monument sign
to serve the existing Costco retail facility located at 951 Palomar Airport Road. The Costco site
is zoned C-2-Q and in accordance with the Q (Qualified Overlay) Zone, Site Development Plan
90-05 was approved on May 21, 1991. An amendment to SDP 90-05 to allow screened roof
equipment on the existing structure is currently scheduled for City Council hearing. Existing
signage for the Costco facility, which was administratively approved as part of the project’s
required sign program, includes a monument sign located adjacent to the easterly Palomar
Airport Road entry driveway. The proposed second monument sign does not require that SDP
90-05 be amended since signage is approved under a separate sign program. In accordance with
the City’s Sign Ordinance (Section 21.41.075 of the Carlsbad Municipal Code), additional

monument signs in the C-2 zone require approval of a conditional use permit. Additionally,
since the project is located within the Mello II Segment of Carlsbad’s Local Coastal Program, a
coastal development permit is required.
The proposed location of the second monument sign is approximately 15’ east of the existing
westerly Palomar Airport Road entry driveway. The proposed 6’ x 8’ monument structure
consists of a gray aggregate stucco base designed to simulate concrete. The actual double faced
sign, which is located near the top of the monument structure, is 2.5’ x 8’ with “Costco
Wholesale” graphics pre-finished in red and blue on a gray background. The sign will be similar
in appearance to the existing Costco monument sign, although, the existing sign has a concrete
base.
The proposed project is subject to the following plans, ordinances, and standards:
A. Regional Commercial (R) General Plan Land Use Designation;
B. General Commercial, Qualified Overlay Zone (C-2-Q)/ Sign Ordinance, Carlsbad
Municipal Code, Chapter 21.41, Section 21.41.075;
C. Mello II Segment of the Local Coastal Program and the Coastal Resource
Protection Overlay Zone - Carlsbad Municipal Code, Chapter 21.203;
D. Carlsbad Ranch Overlay Zone Urgency Ordinance (Urgency Ordinance No. NS-
424).
IV. ANALYSIS
The recommendation of approval for this project was developed by analyzing the project’s
consistency with the applicable policies and regulations listed above. The following analysis
section discusses compliance with each of these regulations utilizing both text and tables:
A. General Plan
The proposed sign is consistent with the applicable land use objective for commercial
developments which requires consistency with the Sign Ordinance to ensure compatibility with
surrounding land uses. The sign is auxiliary to the existing Costco retail development which is
consistent with the site’s Regional (R) Commercial land use designation.
B. C-2-Q Zone/Sign Ordinance
Due to the site’s C-2-Q zoning, a second monument sign is permitted by the Sign Ordinance
upon approval of a conditional use permit through which findings must be made that the sign is
appropriate for the use, compatible in design with the retail development and surrounding
development, does not result in the proliferation of signs in the area, does not interfere with the
safety of the traveling public, and does not adversely affect the appearance of the area or restrict

since the Costco project has extensive (l,OOO’+) frontage and the proposed monument sign

The addition of the second monument sign would require Planning Director approval of an
amendment to the approved Costco Sign Program (PS 91-73(B)). As indicated by the above
Sign Ordinance Compliance table, the proposed second monument sign is consistent with the
City’s Sign Ordinance. The Planning Director has determined that the applicant’s proposed
redistribution of signage (Exhibit “B”) to accommodate the second monument sign and remain
within the aggregate area of signage permitted by the approved Costco Sign Program is
acceptable. The project is therefore conditioned to require an amendment to the approved sign
program in conformance with Exhibit “B” prior to issuance of a sign permit for the second
monument sign.
C. Mello II LCP
The Mello II LCP Land Use Plan restricts monument sign height in the coastal zone to 8’,
however, all other size, area, and locational requirements are regulated by the Sign Ordinance.

As shown in the above table, the proposed sign is 6’ in height and complies with all applicable
Sign Ordinance development standards.
D. Carlsbad Ranch Overlay Zone Urgency Ordinance
The Carlsbad Ranch Overlay Zone Urgency Ordinance applies to an area generally bordered by
Cannon Road on the north, Poinsettia Lane on the south, Hidden Valley Road and Aviara
Parkway on the east, and Carlsbad Boulevard on the west. The urgency ordinance contains no
additional development or design standards. The effect of the urgency ordinance is to require
commercial projects subject to Planning Commission review to undergo City Council review and
approval. In compliance with the urgency ordinance, the Planning Commission will be making a
recommendation to the City Council on the project instead of taking the final action.
V. JLN-VIRONMENTAL REVIEW
The project, which consists of the construction of an on-premise sign that is accessory to an
existing commercial development, is categorically exempt from the requirement for further
environmental review per Section 153 11 of the California Environmental Quality Act.
