RECOMMENDED ACTION:
That City Council INTRODUCE Ordinance No. &S- 48 ? APPROVING an amendment to Specific Plan SP 23.
ITEM EXPLANATION:
The City approved SP 23 in 1972, and has approved several amendments to the plan since then.
The current request has been initiated by the Planning Staff. The goal is to establish land uses and
development standards for the Carlsbad Corporate Plaza.
Identification of land uses and development standards are typical components of a Specific Plan,
however, the many iterations of SP 23, up to this point in time, did not include land use and
development standards. This amendment will have these two necessary Specific Plan components.
The Planning Commission heard the request on its April 7, 1999, agenda and recommended approval by a vote of 5-O. Two commissioners were absent.
FISCAL IMPACT:
Approval of the requested amendment will not have any fiscal impact on the City.
ENVIRONMENTAL:
The physical development of the property was reviewed in previous documents. No significant
environmental impacts are associated with the proposed amendment. A notice of prior compliance
was issued by the Planning Director.

WHEREAS, the City Council of the City of Carlsbad, California has reviewed and
considered a Specific Plan Amendment to establish allowed uses and development standards
for the site; and
WHEREAS, SP 23 was adopted by City Council Ordinance No. 9293 on March
07, 1972, and constitutes the zoning for the subject property; and
WHEREAS, SP 23 has been amended a total of seven times since original
adoption, most recently for SP 23(G) through City Council Ordinance No. NS-437 on December
16, 1998; and
WHEREAS, after procedures in accordance with requirements of the law, the
City Council has determined that the public interest indicates that said plan amendment be
approved.
NOW, THEREFORE, the City Council of the City of Carlsbad, California, does
ordain as follows:
SECTION I: That SP 23 as amended to date is further amended by the
Specific Plan Amendment relative to the Carlsbad Corporate Plaza Exhibit “A”, dated April 7,
1999, attached hereto and incorporated by reference herein, is approved. Development
standards are hereby established as those found in Section 21.34.070 of the Carlsbad
Municipal Code. The Specific Plan Amendment shall constitute the zoning for this property and
all development and use of the property shall conform to the plan.
SECTION II: That the findings and conditions of the Planning Commission as
set forth in Planning Commission Resolutions No. 4517 shall also constitute the findings and
conditions of the City Council.

EFFECTIVE DATE: This ordinance shall be effective thirty days after its
adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be
published at least once in a publication of general circulation in the City of Carlsbad within
fifteen days after its adoption. (Not withstanding the preceding, this ordinance shall not be
effective within the City’s Coastal Zone until approved by the California Coastal Commission.)

I WHEREAS, the City of Carlsbad has initiated an application for a Specific
1 Plan Amendment regarding property owned by Carlsbad Corporate, LLC, “Owner”,

Parcel 3 of Parcel Map No. 3415, in the City of Carlsbad,
County of San Diego, State of California, filed in the office of

WHEREAS, said verified application constitutes a request for a Specific Plan

The Planning Commission finds that the project, as conditioned herein for SP 23(H), is
in conformance with the City’s General Plan, because the proposed land uses will
contribute to the balance of land use so that local residents may work in the community in
which they live.
The proposed plan amendment will not be detrimental to the public interest, health,
safety, convenience or welfare of the City.
The proposed uses will be appropriate in location to the purpose intended. The design
and development standards are such as to create an environment of sustained desirability
and stability
The proposed land uses and development standards are consistent with the development
on the site and substantially compatibility with the area surrounding the development.
The amendment has no new significant environmental effect not analyzed as significant
in the prior Negative Declaration.
That the proposed amendment is in conformance with the Certilied Local Coastal
Program and all applicable policies in that the amendment clearly designate which
uses may be allowed within an approved development. The LCP Land Use Plan
designates the subject site for N (Neighborhood Commercial) and that designation
has not been changed.

1. Staff is authorized and directed to make, or require Developer to make, all corrections
and modifications to the Specific Plan document(s), as necessary, to make them internally
consistent and in conformity with final action on the project. Any proposed uses
substantially different from this approval, shall require an amendment to this approval.

and are incorporated herein by reference.

The development standards for the Carlsbad Corporate Plaza site are hereby
established as those found in Section 21.34.070 of the Carlsbad Municipal Code.
Any change to the buildings or site plan as shown on exhibits “A” - “N” dated
October 15, 1997 for the Carlsbad Corporate Plaza or Exhibit “B” dated April 7,
1999, both for the Carlsbad Corporate Plaza, shall be subject to Section 21.34.070 of
the Carlsbad Municipal Code.
The uses allowed within the Carlsbad Corporate Plaza as shown on Exhibits “A” -
“N” dated October 15, 1997 or Exhibit “B” dated April 7, 1999 are hereby
established as those described in Exhibit “A” Carlsbad Corporate Plaza, Allowed

SUBJECT: SP 23(H) - CARJSBAD CORPORATE PLAZA - Request for approval of an
amendment to Specific Plan 23 to establish allowed uses and development
standards for previously-approved office buildings at the southwest comer of
Paseo De1 Norte and Camino De1 Parque in the Planned Community zone within
Local Facilities Management Zone 4.
I. COMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 45 17
RECOMMENDING APPROVAL of Specific Plan Amendment SP 23(H) based on the
findings and subject to the conditions found therein.
II. JNTRODUCTION
This proposal is a request for an amendment to a previously-approved site plan and architectural
elevations for two office buildings of approximately 75,000 square feet on a 4.59 acre site. This
City initiated amendment is to establish allowed land uses and development standards for the
previously-approved office project and the addition of 6 parking spaces.
III. PROJECT DESCRIPTION AND BACKGROUND
Specific Plan 23 was adopted in 1972 for a 50 acre residential development. At that time it was
known as Campobello, today the area is called Altamira. Later that same year amendment (A)
was adopted to expand the Specific Plan area by 3.05 acres to create a total of 8 acres of
Neighborhood Commercial Zoning within the Specific Plan and to include “M” zoned properties
north on Paseo De1 Norte. Amendment (B) was also adopted in 1972 to approve Phase C of Alta
Mira. The California 6 Motel was removed from the Specific Plan in 1981 by amendment “C”.
Amendment “D” was denied.
In 1985 amendment “E” to SP 23 was approved to include specific development plans for an
office complex on the southern portion of the Neighborhood Commercial 8 acres and a self
storage facility on the northern portion. Regarding the office portion, amendment “E” was not
specific as to the types of “office” uses that would be allowed. In 1993 the City Council
approved amendment “F” to separate the self storage facility from the office project and the self-
storage project was constructed. The office component was not built until the property was
purchased by the current owner who amended the site plan and building design by amendment
“G” in January 1998. The office building is now under construction.

Although the Specific Plan was amended to reflect new architecture and site design (SP23G in
January 1998), the plan did not address allowed uses once the project was built. This amendment
(SP23H) identifies allowed uses and development standards for the 4.59 acre site.
SPECIFIC PLAN 23
Office use was determined to be appropriate for this site with the adoption of Specific Plan
Amendment SP 23(E). At that time both a mini-warehouse and an office complex were
approved for the 8 acres of Neighborhood Commercial within the Specific Plan. However, there
is a wide variety of potential uses that may be proposed as tenants for this project. Before
occupancy begins it is important to identify permitted uses, conditionally permitted uses, and
uses not permitted.
Staff has determined that the intent of the Specific Plan is to guarantee some buffer between the
residential development of Alta Mira and the commercial properties north on Paseo De1 Norte.
A buffer will shield the residential development from some of the impacts related to commercial
uses such as parking lot activity and evening hours of operation. Therefore, uses which maintain
a typical “office” character have been recommended. Staffs definition of typical “office”
character are those uses which are in operation during standard business hours, 8 a.m. to 5 p.m.
Monday through Friday, are not dependent on either street or freeway frontage for signage
identification, and usually limit client visits through appointments. The recommended allowed
uses are attached as Exhibit “A”.
No development standards for the site were established by Specific Plan SP 23(E) other than the
site plan itself. Approval of this amendment will establish the development standards for the site
as those found in the Planned Industrial Zone (Section 21.34.070) of the Carlsbad Municipal
Code. The building project, as approved, is consistent with these Planned Industrial Zone
development standards. The building height is limited to 35 feet at its highest point and setbacks
from property lines are at least 20 feet from side and rear property lines. Overall, parking has
been provided at just over one space per 250 square feet of gross floor area resulting in 306
spaces, which is consistent with the Parking Ordinance.
A component of the amendment is the addition of six parking spaces. This is within the intent of
the specific plan in that adequate parking must be provided for the eventual users of the site, and
medical office has been mentioned as potential tenants. It should be noted that all uses are
subject to the Parking Ordinance (Chapter 21.44) and all uses will be required to provide
evidence that parking is available onsite. The addition of six parking spaces will provide the
necessary parking (12) for up to 6,000 square feet of “medical” users.
V. ENVIRONMENTAL REVIEW
A Negative Declaration was issued for SP 23(E) in October 1984 for an office development on
the site. The Planning Director determined that the subsequent amendment was within the scope

development standards nor the addition of parking spaces for the Specific Plan will have any
environmental impacts. Therefore a notice of prior compliance has been issued for SP23(H).

NOTICE IS HEREBY GIVEN that the City Council of the City of Carlsbad will hold a public hearing at
the City Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, at 6:00 p.m., on Tuesday
May 18, 1999, to consider a request for approval of an amendment to Specific Plan 23 to establish
allowed uses and development standards for previously-approved office buildings at the southwest
corner of Paseo De1 Norte and Camino De1 Parque in the Planned Community Zone within Local
Facilities Management Zone 4 and more particularly described as:
Parcel 3 of Parcel Map No. 3415, in the City of Carlsbad, County
of San Diego, State of California, filed in the office of the County
Recorder of San Diego County, January 2 1, 1975 a tile No. 75-O 142 12
of official records.
Those persons wishing to speak on this proposal are cordially invited to attend the public hearing.
Copies of the staff report will be available on or after May 14, 1999. If you have any questions regarding
this matter, please contact Christer Westman in the City of Carlsbad Planning Department at (760) 438-

If you challenge the Specific Plan Amendment in court, you may be limited to raising only those issues
