ENG C;;v OF CARLSBAD - AGENDAiLL TITLE- -- APPROVING SUPPLEMENT NO. 030 TO STATE AND LOCAL TRANSPORTATION PARTNERSHIP PROGRAM AGREEMENT SLTPP-5308 CITY MGR. 6 RECOMMENDED ACTION: Adopt Resolution No. 99 * 17 L approving Supplement No. 030 to the State and Local Transportation Partnership Program (SLTPP) Agreement No. SLTPP-5308 providing funding for various transportation projects and authorizing the Mayor to execute the documents. ITEM EXPLANATION: In 1991, the City entered into a SLTPP Master Agreement with the State, which permits the City to apply for funds for transportation projects. The State contribution rate is based on the prorata share of funds allocated by the State legislature relative to all projects being funded. Supplements are made to the Master Agreement to authorize the funding of individual projects. Supplement No. 030, which is attached as Exhibit 3, will provide funding for the construction of Reaches 1 C, 1 D, 1 E, 1 F and 2A of Cannon Road West from Armada Drive to El Camino Real. The contract for construction of Reach 2B of Cannon Road West from Faraday Ave to approximately Frost Avenue has not been awarded as yet. A separate supplement will apply to Reach 2B after it is awarded in approximately mid-June 1999. ENVIRONMENTAL REVIEW: The Planning Director has determined that the requested action is consistent with prior CEQA review. The project was also reviewed in the Kelly Ranch Environmental Impact report and the Mitigated Negative Declaration for Reach 2 of Cannon Road. Significant environmental impacts identified by those CEQA documents were determined to be mitigable to levels of less than significant. Permits from the resource agencies were received prior to construction. FISCAL IMPACT: This project is in Cycle 9 of the SLTPP. The reimbursement rate for Cycle 9 is 16.59 percent of eligible costs. Based on current cost estimates, this will amount to $2,197,900 of State funding for this project as shown in Exhibit 3. To date, the City has received over $5 million in State funds for all of the City projects with only minor administrative effort required. EXHIBITS: 1. Location Map 2. SLTPP-5308 AND AUTHORIZING THE MAYOR TO EXECUTE DOCUMENTS. WHEREAS, the City Council finds that the Mitigated Negative Declaration for Cannon Road which were prepared and published reflects the independent judgment of the City Council of the City of Carlsbad; and WHEREAS, the City and State have previously entered into State and Local Transportation Partnership Program Master Agreement No. SLTPP-5308; and WHEREAS, the City has applied for and been granted approval for the construction of Reaches 1 C, 1 D, 1 E, 1 F and 2A of Cannon Road West from Armada Drive to El Camino Real; and WHEREAS, the City Council finds that receipt of this supplemental funding is beneficial to II the transportation system for both the City and the State. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. The total amount of State-Local Transportation Partnership funds payable by the State shall not exceed the sum of the "State Share Funds" column on page 1 of this Program Supplement. The funds to be encumbered and reimbursed are according to the schedule shown under the aforementioned column. Any increase in State Partnership funds will require a revised ,: program supplement. In accordance with the State-Local Transportation Partnership Program Guidelines dated June 8, 1994, project eligibility is limited to contract items plus locally funded State or Local Entity furnished materials and Supplemental Work. Supplemental Work eligibility is further defined under the Project Eligibility section of the Guidelines as limited to certain maximum costs and to non-early reimbursement projects of $300,000 or less.
