RECOMMENDED ACTION:
Adopt Resolution No. 99 -17.3 for approval and execution of a quitclaim
pipeline easement over a portion of Lot 17, Carlsbad Ranch Units 2 & 3,
94-09, CMWD Project No. 94-504.
ITEM EXPLANATION:
This item is a request of Carlsbad Estate Holding, Inc., owner of Lot 17,
Units 2 & 3, Carlsbad Tract 94-09, located on the south east side of Can
owner has requested that the water line and access easement granted
Carlsbad recorded as Certificate of Compliance on March 3, 1998 as Docu
0125301 of Official Records which crosses over a portion of their property Lot
Ranch Units 2 & 3, Carlsbad Tract 94-09 should be quitclaimed to the
longer necessary because the water pipeline was relocated to the north alon
property line to Cannon Road. The engineering staff has reviewed the
concurs with the owner that the easement will no longer be necessary sin
pipeline has concurrently and adequately been provided for, and a new e
been granted within the new location. Therefor, the engineering staff is in
the owner that the original pipeline easement granted to the City of
quitclaimed to the owner.
FISCAL IMPACT:
This item has no fiscal impact. The original easement was acquired by a
Compliance for a no cost acquisition of the property, and the City of Carlsbad

A RESOLUTION OF THE CITY COUNCIL OF CARLSBAD,
CALIFORNIA FOR APPROVAL AND EXECUTION OF A
QUITCLAIM DEED OF A WATER PIPELINE EASEMENT
OVER A PORTION OF LOT 17, CARLSBAD RANCH
UNITS 2 & 3, CARLSBAD TRACT 94-09, CMWD
PROJECT NO. 94-504
WHEREAS, Carlsbad Estate Holding, Inc., owner of Lot 17, Carlsbad Ranch Units 2
& 3, Carlsbad Tract 94-09, have submitted a request for approval and execution of a
quitclaim deed of a water line and access easement granted to the City of Carlsbad
recorded as a Certificate of Compliance on March 3, 1998 as Document No. 1998-0125301
of Official Records over a portion of Lot 17, Carlsbad Ranch Units 2 & 3, Carlsbad Tract 94-
09, CMWD Project No. 94-504, located on the south east side of Cannon Road for pipeline
purposes that no longer contains water system.facilities and will no longer be necessary,
since the water pipeline was relocated to the north along the westerly property line to
Cannon Road, and the water pipeline has concurrently and adequately been provided for,
and a new easement has been granted within the new location; and
WHEREAS, the City Council of the City of Carisbad, California has determined it to
be in the public interest to quitclaim said easement; and
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Quitclaim Deed conveying a water line and access easement over a
portion of Lot 17, Carlsbad Ranch Units 2 & 3, Carlsbad Tract 94-09, CMWD Project No.
94-504, located on the south east side of Cannon Road for pipeline purposes granted to the
City of Carlsbad, no longer contains water system facilities and will no longer be necessary
since the water pipeline has concurrently and adequately been relocated to the north along
the westerly property line to Cannon Road, and a new easement has been granted within

the new location, which is on file with the City Clerk and is incorporated by this reference; is
approved.
3. That the Mayor is authorized to execute the quitclaim deed, and the City Clerk is
hereby authorized to cause the original deed to be returned to the original owner, Carltas
Company, 5600 Avenida Encinas #lOO, Carlsbad, California 92008, to be recorded in the
Office of the County Recorder of San Diego County, State of California.
