Adopt Resolution No.99 0 /‘I3 for approval and execution of a quitclaim deed of a water
pipeline easement over a portion of Parcel 1, Lot 1, Tract 57 of Hotaling Lands, CMWD
Project No. 98-COON.
ITEM EXPLANATION:
This item is a request of Ada A. Allen, owner of Parcel 1, Lot 1, Tract 57, of Hotaling Lands
located east of Hunsaker Street, south of California Street in the City of Oceanside. The
owner has requested that the portion of a water pipeline easement granted to Oceanside
Mutual Water Company, to which Carlsbad Mutual Water Company became successor in
interest, and to which the City of Carlsbad is successor in interest, recorded June 10, 1936
in Book 516, page 424 of Official Records which crosses over a portion of her property
Parcel 1, Lot 1, Tract 57 of Hotaling Lands, and should be quitclaimed to her since it
contains a deteriorated, abandoned, water pipeline. The engineering staff has reviewed
the request and concurs with the owner that the water pipeline will not be used because of
its deteriorated condition, and the well water supply for which is was used has been
abandoned. Therefor, the District is in agreement with the owner that the original pipeline
easement to which the City of Carlsbad in successor in interest can be quitclaimed to the
owner.
FISCAL IMPACT:
Approval of this quitclaim deed will result in approximately 1,275.g square feet of land
being returned to tax rolls. The City will quitclaim the easement for a no cost return of the
property. The owner has paid the standard $200 fee for processing of a quitclaim.
ENVIRONMENTAL REVIEW:
The Planning Director has determined that this item is exempt in accordance with CEQA
Guidelines Section 15061 (b)(3) (the “General Rule”). The activity is covered by the
general rule that CEQA applies only to project which have the potential for causing a
significant effect on the environment. Where it can be seen with certainty that there is no
possibility that the activity in question may have a significant effect on the environment, the
activity is not subject to CEQA.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD FOR APPROVAL AND EXECUTION OF A
QUITCLAIM DEED OF WATER PIPELINE EASEMENT OVER
A PORTION OF PARCEL 1, LOT 1, TRACT 57 OF
HOTALING LANDS. CMWD PROJECT NO. 98-C.OON
WHEREAS, Ada A. Allen, owner of Parcel 1, Lot 1, Tract 57, of Hotaling Lands, has
submitted a request for approval and execution of a quitclaim deed of a portion of a water
pipeline and access easement granted to the Oceanside Mutual Water Company, to which
Carlsbad Mutual Water Company became successor in interest, and to which the City of
Carlsbad is successor in interest, recorded June 10, 1936 in Book 516, page 424 of Official
Records, which crosses over a portion of Parcel 1, Lot I, Tract 57 of Hotaling Lands,
located east of Hunsaker Street and south of California Street in the City of Oceanside,
California, for pipeline purposes, since the water pipeline has deteriorated, is no longer used
and will no longer be necessary, because the well water supply has been abandoned; and
WHEREAS, the City Council of the City of Carlsbad, California has determined it to
be in public interest to quitclaim said easement.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Quitclaim Deed conveying a water pipeline and access easement over
a portion of Parcel 1, Lot 1, Tract 57 of Hotaling Lands, located east of Hunsaker Street and
south of California Street in the City of Oceanside, California, for pipeline purposes granted
to the Oceanside Mutual Water Company, to which Carlsbad Mutual became successor in
interest, and to which City of Carlsbad is successor in interest, that contains a water pipeline
that will not be used because of its deteriorated condition and abandoned well water supply,
which is on file with the Secretary and is incorporated by this reference; is approved.
3. That the Mayor is authorized to execute the quitclaim deed, and the City Clerk is
hereby authorized to cause the original deed to be returned to the original owner, Ada A.

Enclosed for your reference are copies of Agenda Bill No. 424 and Resolution No. 1030
which went before the Carkbad Municipal Water District Board of Directors on
November 10, 1998, when the Resolution was adopted. Resolution No. 1030 approved
the execution of two deeds which quitclaim pipeline easements, which are no longer
needed, to the Carlsbad Unified School District, (CUSD).
Also enclosed are two original and fully executed Quitclaim Deeds. As these deeds
benefit the CUSD, and they were prepared with CUSD under the “Recording Requested
By” area, they will need to be processed for recordation by your agency.
