dedicated to the City of Cartsbad, located south of Palomar Airport Road.
ITEM EXPLANATION:
This is a request by Continental Ranch, Inc., a Delaware corporation, to quitclaim the City’s interest
in an open space easement located on their property south of Palomar Airport Road. The
easement was originally dedicated to the City of Carlsbad. The reason for this quitclaim is to match
as-built slopes as stated in a letter by Rick Engineering to the City Engineer on January 13, 1999.
This open space easement is not part of the required open space for the subdivision. The
easement is not being utilized and has no use scheduled now or in the future.
The above easement is no longer necessary and staff recommends that Council approves the
quitclaim requested by Continental Ranch, Inc., a Delaware corporation.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A QUITCLAIM FOR AN
OPEN SPACE EASEMENT ORIGINALLY DEDICATED TO THE
CITY OF CARLSBAD.
WHEREAS, Continental Ranch, Inc., a Delaware corporation, has submitted a request for
quitclaim of an open space easement which was originally dedicated to the City of Carlsbad over
a portion of their property located south of Palomar Airport Road ; and
WHEREAS, said easement was never utilized for the purpose for which it was granted

and is not now nor is it contemplated to be needed for the purpose of an open space easement;
and
WHEREAS, the City Council of the City of Carlsbad has determined it to be in the public
interest to quitclaim said easements;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
14 1. That the above recitations are true and correct.
15 2. That the Quitclaim Deed of an open space over a portion of APN 222-600-04 to
1s Continental Ranch, Inc., a Delaware corporation, which is on file with the City Clerk and is
17 incorporated by this reference; is approved.

3. That the Mayor is authorized to execute the original Quitclaim Deed and the City
Clerk is hereby authorized to cause the original Quitclaim Deed to be released to the property
owners to be recorded in the office of the County Recorder of San Diego County, State of
California.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
leld on the 1st dayof June , 1999 by the following vote, to wit:
