POL In pi--’ RECOMMENDED ACTION: Resolution No. 49-193 ratifying the Cost Sharing Agreement between the City of Carlsbad and Carlsbad Unified School District for the Drug Abuse Resistance Education (DARE) Program for the fiscal year 1998-99. ITEM EXPLANATION: The City has agreed to provide Carlsbad Unified School District with the DARE Program. The police department has staffed one DARE officer to Carlsbad and Encinitas elementary schools and one to Carlsbad junior high school. Each school district agrees to pay one-half the cost of their program. The cost of each of the two officers is $60,858. Carlsbad Unified School District’s cost-share for the DARE Program for the FY 98-99 school year is $31,444 (as shown in exhibit C of the Cost Sharing Agreement). FISCAL IMPACT: The cost sharing payment of $31,444 will be placed into the General Fund Expense Account and used to offset the cost of the DARE Program to the City. EXHIBITS: 1. Cost Sharing Agreement with Carlsbad Police Department 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9%19_3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, RATIFIYING THE COST SHARING AGREEMENT FOR THE DARE PROGRAM BETWEEN THE CITY OF CARLSBAD AND CARLSBAD UNIFIED SCHOOL DISTRICT WHEREAS, the City Council of the City of Carlsbad, California, finds that it would be mutually beneficial for the City and the Carlsbad Unified School District to share costs of the Drug Abuse Resistance Education Program; and 2 WHEREAS, the Cost Sharing Agreement has been acted upon by the parties although not previously approved by the City Council; NOW, THEREFORE, the City Council of the City of Carlsbad does hereby resolve as follows: 1. That the cost sharing agreement for the DARE Program, attached hereto as Exhibit 2, between the City of Carlsbad and Carlsbad Unified School District is hereby retroactively approved. 2. That the Mayor of the City of Carlsbad is hereby authorized and directed to execute said agreement for and on behalf of the City of Carlsbad, California on the 1st day of June , 1999, by the following vote to wit: AYES: Council Members Lewis, Hall, Finnila, Nygaard, Kulchin NoES' None. RAUTENKRANZ, City Clerk (SEAL) A d- COST SHARING AGREEMENT This agreement is made and entered into at Carlsbad, California, this 1 nt day of June, 193 by the City of Carlsbad, a mu&pal corporation hereinafter called “City,” and Carlsbad Unified School District, a unified school district, hereafter called “School District.” WHEREAS, the City and the School District find that it would be mutually beneficial to share costs of the Drug Abuse Resistance Education program, hereinafter caUed D.A.R.E. The parties agree as follows: The City agrees to provide the School District with an elementary and junior high school D.A.R.E. program as described in Exhibits *A” and “B” and the school District agrees to pay the City 50% tokrds the cost of the program. See Exhibit “C” for details. - MODIFICATIONS AND SCHEDULING The description of the program in Exhibits “A” and “B” is a general guideline only and minor modifications may be made by the City. Scheduling of the programs is at the discretion of the City. CONDITIONS This agreement is based on the following assumptions: 1) Carlsbad Unified School District agrees to provide 50% toward the cost of the elementary and junior high school D.A.R.E. program as outlined in Exhibit “C” attached. 2) School enrollment at School District is approximately the same in the 1998/ 1999 school year as in the 1997/ 1998 school year. If either of the two assumptions prove to be false, this agreement is VOID. TERM OF AGREEMENT The term of this agreement extends from July 1, 1998 to June 30, 1999. The School District agrees to pay the City in the following manner: One-half of the amount due will be paid no later than December 3 1, 1998. The remaining one-half will be paid no later than June 30, 1999. CITY EMPLOYEES City employees who perform duties under this agreement are not, foi any purposes whatsoever, employees of the School District.
