RECOMMENDED ACTION: Adopt Ordinance No. NS-487, adopting an amendment to the Carlsbad Corporate Plaza Specific Plan, SP 23 (H), to establish allowed uses and development standards on property generally located south of Paseo De1 Norte and west of Camino De1 Parque, in Local Facilities Management Zone 4. ITEM EXPLANATION Ordinance No. NS-487, was introduced and first read at the City Council meeting held on May 18, 1999. The second reading allows the City Council to adopt the ordinance which would then become effective in thirty days. (Not withstanding the preceding, this ordinance shall not be efective within the City’s Coastal Zone until approved by the California Coastal Commission.) NS-487 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING THE CARLSABD CORPORATE PLAZA SPECIFIC PLAN AMENDMENT RELATIVE TO ALLOWED USES AND DEVELOPMENT STANDARDS ON PROPERTY GENERALLY LOCATED SOUTH OF PASEO DEL NORTE AND WEST OF CAMINO DEL PARQUE IN LOCAL FACILITIES MANAGEMENT ZONE 4. CASE NAME: CARLSBAD CORPORATE PLAZA CASE NO.: SP 23(H) WHEREAS, the City Council of the City of Carlsbad, California has reviewed and considered a Specific Plan Amendment to establish allowed uses and development standards for the site; and WHEREAS, SP 23 was adopted by City Council Ordinance No. 9293 on March 07, 1972, and constitutes the zoning for the subject property; and WHEREAS, SP 23 has been amended a total of seven times since original adoption, most recently for SP 23(G) through City Council Ordinance No. NS-437 on December 16,1998; and WHEREAS, after procedures in accordance with requirements of the law, the City Council has determined that the public interest indicates that said plan amendment be approved. NOW, THEREFORE, the City Council of the City of Carlsbad, California, does ordain as follows: SECTION I: That SP 23 as amended to date is further amended by the Specific Plan Amendment relative to the Carlsbad Corporate Plaza Exhibit “A”, dated April 7, 1999, attached hereto and incorporated by reference herein, is approved. Development standards are hereby established as those found in Section 21.34.070 of the Carlsbad Municipal Code. The Specific Plan Amendment shall constitute the zoning for this property and all development and use of the property shall conform to the plan. SECTION II: That the findings and conditions of the Planning Commission as set forth in Planning Commission Resolutions No. 4517 shall also constitute the findings and conditions of the City Council. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in a publication of general circulation in the City of Carlsbad within fifteen days after its adoption. (Not withstanding fhe preceding, this ordinance shall not be effective within the City’s Coastal Zone until approved by the California Coastal Commission.)
