ITEM EXPLANATION: On March 10, 1998, Council approved ah agreement with the City of Vista to prepare a preliminary alignment for Melrose Drive north of Palbmar Airport Road and to include an environmental review. On the same night, a consultant agreement with Rick Engineering was approved. The preliminary alignment and initial environmental work for Melrose Drive have been completed. However, the initial studies determined that a least Bell’s vireo study and a cultural resources study should be done. Staff recommends that these studies be done now so as not to delay the Melrose Drive project later. In addition to Melrose Drive, Amendment No. 1 was added to Rick Engineering’s agreement to do a preliminary study for a detention basin just east of the Melrose Drive fill. The purpose of this basin will be to reduce potential flooding in the Ranch0 Carlsbad Mobile Home Park. The least Bell’s vireo study will cover both projects as will the cultural resources study. The latter study consists of a number of one-meter square pits and some shovel pits to determine if there are any archaeological items of significance on the site. ENVIRONMENTAL IMPACT: The Planning Department has indicated that these two studies will be required prior to the construction of Melrose Drive and the basin and suggests that they be done at any early stage in project development. FISCAL IMPACT: The cost of these two studies is $19,911 and sufficient funds are available. EXHIBITS: 1. Resolution No. 99-208 approving Amendment No. 2. 2. RESOLUTION NO. 99-208 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AMENDMENT NO. 2 TO CONSULTANT AGREEMENT WITH RICK ENGINEERING TO ADD ENVIRONMENTAL STUDIES TO MELROSE DRIVE AND DETENTION BASIN PRELIMINARY DESIGN. PROJECT NO. 3338. WHEREAS, the City Council on March 10, 1998 approved an agreement with 6 Rick Engineering Company for a preliminary alignment of Melrose Drive; and 7 WHEREAS, the initial environmental study identified the need for a least Bell’s vireo study 8 and a cultural resources study; and 9 WHEREAS, these studies are an extension of work currently being performed by ,r, Rick Engineering or their subconsultants, making them uniquely qualified to perform this additional work. 11 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 12 California, as follows: 13 1. That the above recitations are true and correct. 14 2. That Amendment No. 2 to the consultant agreement with Rick Engineering 1s Company for additional environmental studies as described in the attached contract is hereby 16 approved and the Mayor is hereby authorized and directed to execute said amendment. 3. 17 Following the Mayor’s signature of the agreement, the City Clerk is further authorized and directed to forward copies of said agreement to Rick Engineering and to the 18 Engineering Department for their files. 19 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council 20 held on the 8th day of June , 1999 by the following vote, to wit: 21 AYES: Council Members Lewis, Nygaard, Finnila, Hall & Kulchin 22 23 24 25 2s ATTEST: (SEAL) AMENDMENT NO. 2 TO AGREEMENT This Amendment is entered into and effective as of the day of a th June . 1999, amending the agreement dated March 11, 1998 by and between the City of Carlsbad, a municipal corporation, hereinafter referred to as “City”, and Rick Engineering Company, hereinafter referred to as, “Contractor” for preliminary design, environmental, and other services for Melrose Drive, Project No. 3598. Contractor shall provide services as outlined on the attached Exhibit “A”. 2. City shall pay Contractor for all work associated with Paragraph 1 above, on a time and materials basis not-to-exceed $19,911. Contractor shall provide City on a monthly basis, copies of invoices sufficiently detailed to include hours performed, hourly rates, and related activities and costs for approval by City. Z/2/98 3. Contractor shall complete all work outlined on the attached Exhibit “A” by expiration of the agreement amended hereby. 4. All other provisions of the aforementioned agreement entered into on March 11,1998, by and between City and Contractor shall remain in full force and effect. 5. All requisite insurance policies to be maintained by the Contractor shall include coverage for the amended assignment and scope of work. As we dis-ussed, the cm-r&t environmental biological surveys have determined that the existing-vegetation and habitat which was, originally assumed to be not suitable for the Least Bell’s Vireo, has developed into a potential site for this endangered species. Our subconsultant, Recon, has determined that the United States Fish and Wildlife Service will require this Technical Report to be a part of the environmental document for tbis project. In addition, Recon’s Cultural Resources Field Survey has identified some cultural sites : that will require additional studies and testing to determine their importance. In discussions that Recon had with Christer Westman with your Environmental Department at the City of Carlsbad, it was agreed that Recon should perform the additional cultural evaluations in concurrence with the other environmental technical reports for this project. The proposed additional scope of work includes: 1. Additional meetings, coordination, and exhibits. (Rick Engineering Cows) $ 2,100.00 2. Least Bell’s Vireo Technical Report. (Recon) $ 3,050.oo A. Send pre-survey notification to USFWS. Provide the USFWS Carlsbad Office with the location for the site on a 75foot USGS topographic map and the names and permit numbers of the biologists who will conduct the surveys. B. Conduct a directed search for the Least Bell’s Vireo in the riparian vegetation on-site. The directed search methodology will follow the USFWS Least Bell’s Vireo Survey Guidelines dated February, 1992, Mr. Richard Allen April 14,1999 Page 2 of 3 which require searching all appropriate habitat within the survey areas eight times between April 1 and July 3 1, with searches separated by intervals of at least a week. C. Submit survey results to the client as an addendum to the biological technical report for the Melrose project. D. Submit the report to USFWS within 45 days of completing surveys. 3. This is because the survey season for this endangered species has already begun and therefore it is critical to begin the survey as soon as possible. The cultural resource significance evaluations will require a backhoe on the project site. Therefore, we will need permission from the property owner to enter their property and perform the required environmental testing.
