RECOMMENDED ACTION:
That the City Council ADOPT Resolution No. 99-a/6 , APPROVING a request for Precise
Development Plan Amendment l(E) and Coastal Development Permit 98-82 to allow the
replacement of an existing pump station and construction of an electrical equipment building
within the Encina Water Pollution Control Facility on the east side of Avenida Encinas between
Palomar Airport Road and Poinsettia Lane.
ITEM EXPLANATION:
This is a request to allow the replacement of an existing pump station within the Encina
Wastewater Treatment site on the east side of Avenida Encinas between Palomar Airport Road
and Poinsettia Lane. The proposed pump station will replace an existing pump which delivers
secondary effluent from the Encina Water Pollution Control Facility through an existing pipeline
to Leucadia County Water District’s Gaffner Water Reclamation Facility where it undergoes
tertiary treatment for subsequent use by the Carlsbad Municipal Water District as reclaimed
water. The proposed pump station will be powered by a new 15 foot by 30 foot electrical
equipment building.
The Planning Commission heard this project at a public hearing held on April 21, 1999, and
recommended approval of the request unanimously.
ENVIRONMENTAL REVIEW:
The project was reviewed and found to be exempt from environmental review under CEQA
pursuant to Section 15301 (b) because the proposal consists of the operation, maintenance,
and minor alteration of an existing publicly-owned utility.
FISCAL IMPACT:
The proposed pump replacement and electrical equipment building will not generate any
additional vehicle trips nor will the proposal generate the need for any additional sewer or water
service. The project will be subject to traffic impact and bridge and thoroughfare fees for Local
Facility Management Zone 3 as required by the conditions of approval.

The City Council of the City of Carlsbad, California, does hereby resolve as
follows:
WHEREAS, pursuant to the provisions of the Municipal Code, the Planning
Commission did, on April 21, 1999, hold a duly noticed public hearing as prescribed by law to
consider a Precise Development Plan Amendment and Coastal Development Permit; and
WHEREAS, the City Council of the City of Carlsbad, on the 15 day of June
1999, held a duly noticed public hearing to consider said Precise Development Plan
Amendment and Coastal Development Permit and at that time received the recommendations,
objections, protests, comments of all persons interested in or opposed to PDP l(E)/CDP 98-82.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City
of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the City Council approves ENCINA EFFLUENT PUMP STATION -
PDP l(E)/CDP 98-82, and that the findings and conditions of the Planning Commission as set
forth in Planning Commission Resolutions No. 4544 and 4545, on file with the City Clerk and
made a part hereof by reference are the findings and conditions of the City Council.
3. This action is final the date this resolution is adopted by the City Council.
The Provisions of Chapter 1 .I6 of the Carlsbad Municipal Code, “Time Limits for Judicial
Review” shall apply:
“NOTICE TO APPLICANT”
“The time within which judicial review of this decision must be sought
is governed by Code of Civil Procedure, Section 1094.6, which has
been made applicable in the City of Carlsbad by Carlsbad Municipal
Code Chapter 1.16. Any petition or other paper seeking judicial
review must be filed in the appropriate court no later than the

ninetieth day following the date on which this decision becomes final;
however, if within ten days after the decision becomes final a request
for the record of proceedings accompanied by the required deposit in
an amount sufficient to cover the estimated cost of preparation of

which the record is either personally delivered or mailed to the party,

WHEREAS, Leucadia County Water District, “Developer”, has filed a verified
application with the City of Carlsbad regarding property owned by Encina Wastewater
Authority, “Owner”, described as
a portion of Section 20 of Township 12 South, range 4 West,
San Bernadino Meridian, according to the US Government
survey approved October 25,1875 and a portion of Lot “H” of
Ranch0 Agua Hedionda according to Map 823, filed November
16,1896,
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Precise
Development Plan Amendment as shown on Exhibit(s) “A” - ‘&D” dated April 21, 1999, on
file in the Planning Department, ENCINA EFFLUENT PUMP STATION, PDP l(E), as
provided by Chapter 21.36 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 21st day of April, 1999, hold a
duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to the Precise Development Plan Amendment.
WHEREAS, on May 25,1979, the City Council approved PDP 1, as described

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows:

Commission RECOMMENDS APPROVAL of ENCINA EFFLUENT PUMP

The Planning Commission finds that the project, as conditioned herein for PDP l(E) is
in conformance with the Elements of the City’s General Plan, based on the following:
A. Land Use - The proposed use is consistent with the City’s general plan in that
the subject site is designated for Public Utility uses and the proposed pump
replacement and electrical building is consistent with Land Use Element
Goal A.2 which requires that the City responsibly deals with the disposal of
solid and liquid waste.
B. Circulation - The existing circulation system is adequate to handle all traffic
generated by the existing use, and the proposed use will not generate
additional traffk.
The project is consistent with the City-Wide Facilities and Improvements Plan, the
applicable local facilities management plan and all City public facility policies and
ordinances since:
A. All necessary public improvements have been provided or are required as
conditions of approval.
This project has been conditioned to comply with any requirement approved as part of the
Local Facilities Management Plan for Zone 3.
That the Planning Director has determined that the project is exempt from the
requirements of the California Environmental Quality Act (CEQA) per Section 15301(b)
of the state CEQA Guidelines and will not have any adverse significant impact on the
environment.
The project is consistent with the P-U Zone regulations based on the following:
A. The proposed pump replacement and electrical building is consistent with
the City’s General Plan in that the subject site is designated for Public Utility

All potential environmental factors which might result from the project have
been considered, and it has been determined that there will be no
environmental factors resulting from the project.
The project is compatible with the surrounding development in that (1) the
proposal does not result in an expansion of the existing uses on the site, (2) it
will not generate any additional traffic, and (3) the electrical building will be
adequately screened from Avenida Encinas by existing and replaced mature
landscaping.
Conditions:
1. Staff is authorized and directed to make, or require the Developer to make, all corrections
and modifications to the Precise Development Plan Amendment documents, as
necessary to make them internally consistent and in conformity with the final action on
the project. Development shall occur substantially as shown on the approved Exhibits.
Any proposed development different from this approval, shall require an amendment to
this approval.
2. The conditions of approval contained herein shall be in addition to the previous
conditions of approval. All previous conditions of PDP l(C) and PDP l(D),
Planning Commission Resolutions 2830 and 3992, shall remain in effect and shall be
complied with in their entirety.
3. The Developer shall comply with all applicable provisions of federal, state, and local
ordinances in effect at the time of building permit issuance.
4. The Developer/Operator shall and does hereby agree to indemnify, protect, defend and
hold harmless the City of Carlsbad, its Council members, officers, employees, agents, and
representatives, from and against any and all liabilities, losses, damages, demands, claims
and costs, including court costs and attorney’s fees incurred by the City arising, directly
or indiiectly, from (a) City’s approval and issuance of this Precise Development Plan, (b)
City’s approval or issuance of any. permit or action, whether discretionary or non-
discretionary, in connection with the use contemplated herein, and (c)
Developer/Operator’s installation and operation of the facility permitted hereby,
including without limitation, any and all liabilities arising from the emission by the
facility of electromagnetic fields or other energy waves or emissions.
5. The Developer shall provide the City with a reproducible 24” x 36”, mylar copy of the Precise Development Plan Amendment as approved by the final decision making body.
The Precise Development Plan Amendment shall reflect the conditions of approval by
the City. The Plan copy shall be submitted to the City Engineer and approved prior to
building, grading, final map, or improvement plan submittal, whichever occurs first.
6. The Developer shall include, as part of the plans submitted for any permit plan check, a
reduced legible version of the approving resolution(s) on a 24” x 36” blueline drawing.
Said blueline drawing(s) shall also include a copy of any applicable Coastal Development
Permit and signed approved site plan.

7. This project shall comply with all conditions and mitigation measures which are required
as part of the Zone 3 Local Facilities Management Plan and any amendments made to
that Plan prior to the issuance of building permits.
8. Approval of PDP l(E) is granted subject to the approval of CDP 98-82. PDP l(E) is
subject to all conditions contained in Resolution No. 4545 for CDP 98-82.
9. Any landscape or irrigation that is damaged or destroyed during construction shall
be replaced to the satisfaction of the Planning Director.
General:
10. If any of the foregoing conditions fail to occur; or if they are, by their terms, to be
implemented and maintained over time, if any of such conditions fail to be so
implemented and maintained according to their terms, the City shall have the right to
revoke or modify all approvals herein granted; deny or further condition issuance of all
future building permits; deny, revoke or further condition all certificates of occupancy
issued under the authority of approvals herein granted; institute and prosecute litigation
to compel their compliance with said conditions or seek damages for their violation. No
vested rights are gamed by Developer or a successor in interest by the City’s approval of
this Precise Development Plan Amendment.
Standard Code Reminders:
The project is subject to all applicable provisions of local ordinances including, but not limited
to, the following code requirements:
11. This approval shall become null and void if building permits are not issued for this
project within 18 months from the date of project approval.
12. Approval of this request shall not excuse compliance with all applicable sections of the
Zoning Ordinance and all other applicable City ordinances in effect at time of building
permit issuance, except as otherwise specifically provided herein.
13. All roof appurtenances, including air conditioners, shall be architecturally integrated and
concealed from view and the sound buffered from adjacent properties and streets, in
substance as provided in Building Department Policy No. 80-6, to the satisfaction of the
Directors of Community Development and Planning.

Findings:
That based on the evidence presented at the public hearing, the Commission
RECOMMENDS APPROVAL OF ENCINA EFFLUENT PUMP STATION,
CDP 98-82, based on the following findings and subject to the following
conditions:
1. That the proposed development is in conformance with the Mello II segment of the
Certified Local Coastal Program and all applicable policies in that the site is designated
for Public Utility uses and the development consists of the replacement of an
existing pump station within the Encina Waste Water Treatment Plant. The
proposed pump replacement does not obstruct views or otherwise damage the visual
beauty of the coastal zone and no agricultural activities, sensitive resources, geologic
instability, or coastal access opportunities exist on the site.
2. The project is consistent with the provisions of the Coastal Resource Protection
Overlay Zone (Chapter 21.03 of the Zoning Ordinance) in that the project will
adhere to the City’s Master Drainage and Storm Water Quality Management Plan
and Grading Ordinance to avoid increased runoff and soil erosion, no steep slopes
or native vegetation is located on the subject property and the site is not located in
an area prone to landslides, or susceptible to accelerated erosion, floods or
liquefaction.
3. That the Planning Director has determined that the project is exempt from the
requirements of the California Environmental Quality Act (CEQA) per Section 15301(b)
of the state CEQA Guidelines and will not have any adverse significant impact on the
environment.
Conditions:
1. Staff is authorized and directed to make, or require Developer to make, all corrections
and modifications to the Coastal Development Permit document(s) necessary to make
them internally consistent and in conformity with final action on the project.
Development shall occur substantially as shown in the approved Exhibits. Any proposed
development different from this approval, shall require an amendment to this approval.
2. Approval of CDP 98-82 is granted subject to the approval of the PDP l(E). CDP 98-82
is subject to all conditions contained in Resolution No. 4544 for PDP l(E).
3. The applicant shall apply for and be issued building permits for this project within
eighteen (18) months of approval or this coastal development permit will expire
unless extended per Section 21.201.210 of the Zoning Ordinance.
4. Prior to the issuance of the building permit, Developer shall submit to the City a Notice
of Restriction to be filed in the office of the County Recorder, subject to the satisfaction
of the Planning Director, notifying all interested parties and successors in interest that the
City of Carlsbad has issued a Coastal Development Permit by Resolution No. 4545 on
the property owned by the Developer. Said Notice of Restriction shall note the property
description, location of the file containing complete project details and all conditions of

approval as well as any conditions of restrictions specified for inclusion in the Notice of
Restriction. The Planning Director has the authority to execute and record an amendment
to the notice which modifies or terminates said notice upon a showing of good cause by
the Developer or successor in interest.
5. Consistent with subsection 21.203.040 of the Carlsbad Municipal Code, no grading shall
be allowed during the winter season (October 1 - April 1).

SUBJECT: PDP l(E)/CDP 98-82 - ENCINA EFFLUENT PUMP STATION - Request for
a recommendation of approval for a Precise Development Plan Amendment and a
Coastal Development Permit to allow the replacement of an existing pump station
and construction of an associated electrical equipment building within the Encina
Water Pollution Control Facility on the east side of Avenida Encinas between
Palomar Airport Road and Poinsettia Lane and within Local Facilities
Management Zone 3.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolutions No. 4544 and 4545,
RECOMMENDING APPROVAL of Precise Development Plan Amendment (PDP l(E)) and
Coastal Development Permit (CDP 98-82) based on the findings and subject to the conditions
contained therein.
II. INTRODUCTION
The application consists of a request to replace an existing pump station within the Encina Water
Pollution Control Facility (EWPCF). Facilities to be constructed within the EWPCF site include
pumps, piping and appurtenances, and a 15 foot by 30 foot electrical building. The project site is
zoned P-U (Public Utility) and requires approval of an amendment to the Precise Development
Plan as discussed under the analysis section of this report. The site is also located within the
Coastal Zone and a Coastal Development Permit is required. Precise Development Plans, and
subsequent amendments thereto, require that the City Council have final review and approval.
Therefore, the Planning Commission is being requested to make a recommendation of approval
on the project for the City Council.
III. PROJECT DESCRIPTION AND BACKGROUND
The existing EWPCF site is located on the east side of Avenida Encinas between Palomar
Airport Road and Poinsettia Lane. The proposed area of work is surrounded by the Effluent
Pump Station and Operations Building to the north, an access driveway to the south, a parking
lot and Chlorination Building to the east, and Avenida Encinas to the west.
The proposed pump station will replace an existing pump which delivers secondary effluent from
the EWPCF through an existing pipeline to Leucadia County Water District’s (LCWD) Gaffner

Water Reclamation Facility where it undergoes tertiary treatment for subsequent use by the
Carlsbad Municipal Water District as reclaimed water. Facilities to be constructed as part of this
application include two vertical turbine pumps, piping and appurtenances to connect the pumps
to existing lines, and a 450 square foot electrical equipment building. The proposed pump
station design capacity is 800 gpm (1.15 mg) and does not exceed the capacity of the existing
temporary pump station. The new pump station will supply water for reclamation purposes in a
manner which is more efficient and reliable than the means by which reclaimed water is currently
produced.
The proposed pump station will be powered by the new electrical building located north of an
existing parking lot. The proposal does not result in any additional square footage of office
space and no additional parking will be required for this proposal. Some of the existing
landscaping will be demolished due to the construction. However, replacement of the land-
scaping, including trees for screening the building from Avenida Encinas, will be required as a
condition of approval.
Two future pumps shown on the proposed plans are & part of the current proposal. These
future pumps would allow secondary effluent to be delivered to the Gaffher Water Reclamation
Facility over a flow range of 1 .O to 4.0 mgd. To achieve this flow, two additional pumps would
be installed within the pump cans and additional electrical equipment would be installed in the
electrical building. Four pump cans (two for this phase and two for the future phase) are
proposed in this phase of the project and the electrical building is designed to accommodate both
the initial and future phase electrical equipment. No other upgrades to the facilities within the
EWPCF site would be required. The timing of the need for the future increase in capacity for the
pump station is unknown and will be governed by the demand for reclaimed water supplied by
the Leucadia County Water District to the Carlsbad Municipal Water District. Additional
environmental review will be required to evaluate the potential impact of the future pumps.

IV. ANALYSIS
The recommendation for approval of this project was developed by analyzing the project’s
consistency with the applicable policies and regulations listed above. Therefore, this section will
cover the project’s compliance with each of the regulations listed above in the order in which
they are presented.
A. General Plan
The proposed project is consistent with the applicable goals, objectives and policies of the
General Plan. The existing land use is consistent with the Public Utility (II) General Plan Land
Use Designation. The proposal is consistent with Land Use Element Goal A.2 which requires
that the City responsibly deals with the disposal of solid and liquid waste in that the proposed
pump replacement will provide for a more efficient and reliable delivery of secondary effluent.

B. Zoning,
The project site is zoned P-U (Public Utility) which permits wastewater treatment, disposal, or
reclamation facilities. An approved Precise Development Plan (PDP) is required for any
development in the P-U Zone and there is an approved PDP on the subject site (PDP l(D)). The
purpose of the PDP requirement is to ensure compatibility of development with the General Plan
and surrounding development, to ensure consideration of environmental factors, and to provide
for public improvements and other conditions of approval necessitated by the development.
The P-U Zone development standards include a minimum lot area of 7,500 square feet and a
maximum lot coverage of 50%. The project complies with both of these regulations and with the
zone requirements for parking/loading areas and landscape requirements.
Staffs review of the proposed pump station indicates that the proposal is consistent with the
General Plan and compatible with the surrounding development. The proposed pump station
will replace an existing secondary effluent pump station which is a permitted use in the P-U Zone
and the U General Plan Land Use Designation. The proposed pump station and electrical
building are compatible with the surrounding similar uses in that: 1) the building will be a one-
story (12.6 foot) building painted to match other structures within the EWPCF, 2) the building
will be adequately screened from Avenida Encinas by existing and replaced landscaping, and 3)
the proposal will not generate any additional traffic.
Historically, for the purposes of determining parking demand, the parking calculations have been
based on approximately 52,900 square feet of building area. About 60% of this total consists of
“unoccupied” areas which contain electrical equipment, engines, and structures to contain odors,
noise, etc., but which do not provide employee work areas. The “occupied” 40% (21,450 sq. ft.)
includes the administration building (9,670 sq. ft.) and maintenance/warehouse areas (11,780 sq.
fi). Based upon current parking regulations, the “occupied” use areas on site would require
approximately 60 parking spaces. The site currently provides 79 parking spaces, 19 more than
required. The proposed electrical building does not create a demand for additional parking
spaces. Therefore, staff has concluded that the parking currently provided on site is adequate for
the existing and proposed uses.
C. Mello II Segment of the Carlsbad Local Coastal Prouram
The project site is located in the Mello II Local Coastal Program Segment. The LCP Land Use
Plan designates the subject site as a P-U (Public Utilities) Zone which is compatible with the
current use of the site. The proposed pump station does not represent a new use or change of use
on the subject site. The project complies with all applicable policies and provisions of the
Certified Local Coastal Program including Mello II Land Use Policy 5-2 which requires the City
to participate in meeting growth demands for reclaimed water beyond the coastal zone. The
proposed pump station will provide a more reliable source for the continued provision of
reclaimed water.
The proposed pump station will be located on the inland side of Avenida Encinas. Dense
landscaping along Avenida Encinas provides screening for many of the buildings and structures
within the site. The proposed one story structure is consistent with the surrounding development

of offices and structures within the EWPCF site and will not obstruct views or otherwise damage
the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are
there any sensitive resources. The site is not located in an area of known geologic instability.
No public opportunities for coastal access are available from the subject site and no public access
requirements are conditioned for the project.
The subject site is located in the Coastal Resource Protection Overlay Zone (Chapter 21.03 of the
Carlsbad Municipal Code). However, due to its location and the absence of slopes equal to or
steeper than 25% inclination and/or native vegetation, additional submittals, standards or
requirements do not apply. The project does not require a grading permit, Construction of the
project will adhere to the City’s Master Drainage and Storm Water Quality Management Plan
and Grading Ordinance to avoid increased runoff and soil erosion The site is not located in an
area prone to landslides, susceptible to accelerated erosion, floods or liquefaction.
D. Growth Management
Power and communication services for the proposed pump station and electrical building will be
supplied from the existing power/telephone grids which provide service to the treatment plant.
The proposed pump station will not have water or sewer service nor will it generate any
additional trips. The project is conditioned to comply with the requirements of the Zone 3 Local
Facilities Management Plan. The installation of the pump station and electrical equipment
building does not impact any of the growth management performance standards, therefore, an
analysis of each growth management facility is not necessary.
V. ENVIRONMENTAL REVIEW
The proposed project has been reviewed and found to be exempt from environmental review
under CEQA pursuant to Section 15301 (b) because the proposal consists of the operation,
maintenance, and minor alteration of an existing publicly-owned utility. Therefore, the Planning
Director will issue a Notice of Exemption upon project approval.

Subject: Leucadia County Water District Water Recycling Program
The Leucadia County Water District (LCWD) is in the process of implementing permanent facilities at the Encina Wastewater Authority (EWA) to divert secondary treated effluent to its
Gafner Water Reclamation Facility. It is our understanding that LCWD is presently coordinating
with your office on the permitting aspect of this effort.
The purpose of this letter is to confirm that the EWA and its Member Agencies have consented
to LCWD’s project as it relates to our plant property.
To provide some background, the EWA is a public agency located in Carlsbad, California that
provides wastewater treatment services to approximately 250,000 North San Diego County
residents. The EWA is a joint powers authority that is owned by six member agencies including:
LCWD, City of Carlsbad, City of Vista, Vallecitos Water District, Buena Sanitation District and
the City of Encinitas. The City of Carlsbad holds title of the EWA plant property on behalf of
the Member Agencies.
In July 1998, the EWA approved LCWD’s plan to permanently transfer up 1 .O million gallons
per day of secondary eMuent from the EWA plant for the purpose of water recycling. LCWD’s
plan was subsequently approved by each of the EWA’s Member Agencies as of February 1999.
Approval was granted under the assumption that LCWD would obtain all necessary approvals
for the project. The EWA and LCWD are currently developing a Memorandum of
Understanding to establish the terms and conditions for the diversion facility’s operation.

The Precise Development Plan ensures the compatibility of the project with the City's General Plan because:

All previous conditions of PDP l(A), City Council Resolution
No. 6926 and Planning Commission Resolution No. 2113 are no longer applicable and shall be superseded by the conditions of approval contained herein.
In addition to the approval of the development indicated in the exhibits noted in Condition No. 1, all other requirements listed in this approval shall be indicated on the final Precise Development Plan. All subsequent Communication concerning this project shall, when applicable, reference this Resolution Number and conditions contained herein.
PRIOR TO ISSUANCE OF BUILDING PERMITS:
a) Final landscape and irrigation construction drawings shall be submitted to the Planning Director for the entire facility and be subject to the approval of the Planning Director. The landscaping shall be designed to significantly screen facilities from Views from I-5, and surrounding properties to the north, east and south. The drawings shall include fast growing tall and wide trees, as well as a combination of shrubs and ground cover. Plants shall be irrigated with reclaimed water to the
maximum extent possible. Screening landscaping shall be installed upon completion of grading. Landscape and irrigation adjacent to building shall be installed
immediately upon completion of any building construction.
b) A final lighting plan shall be subject to the approval of the Planning Director. All lighting shall be designed in a manner that will not adversely affect nearby residences or public roadways.
0) The applicant shall provide evidence that the retaining wall at the southeast corner of the site shall use a colored concrete mix which when dry shall be a color which blends in'to the surrounding background. This color mixture shall be reviewed and approved by the Planning Director. The intent of the colored concrete retaining wall is to allow the wall to better blend into the surrounding landscaping.
d) The applicant shall submit a reproducible.copy of Precise Development Plan l(C) which incorporates all requirements of the approval to the City Manager fOr.signature. Prior to signing the final Precise Development Pian, the City Manager shall determine that all applicable requirements have been incorporated into the plan and that all conditions of approval have been satisfactorily met or
otherwise guaranteed. The final signed Precise Development Plan shall be the official site layout plan

for the property and shall be attached to any application for a permit on the subject property.
e) The applicant shall submit to the Planning Director for approval of an environmental mitigation monitoring and reporting program according to Section 21.081.6 of the Public Resources Code. This program shall be a part of this Precise Development Plan Amendment. The program shall include monitoring and reporting to the Planning Director the progress of all mitigation identified in the Final Environmental Impact Report for the project dated August 1988.
5. PRIOR TO FINAL INSPECTION OF TBE SITE:
a) The placement of equipment oa any roof tops shall be screened from views along I-5 and from adjacent properties consistent with Building Policy 80-6 and subject to the approval of the Planning Director.
b) All landscaping as indicated in this approval shall be in place and in a condition to 'assure healthy growth as determined by the Planning Director.
0) The site's aeration basins shall be covered and odors from the basins controlled based on the best available technology.

6. The developer shall obtain a grading permit prior to the
commencement of any clearing or grading of the site.
7. The grading for this project is defined as "controlled grading" by Section 11.06.170(a) of the Carlsbad Municipal
Code. Grading shall be performed under-the observation of a civil engineer whose responsibility it shall be to coordinate site inspection and testing to ensure compliance of the work
with the approved grading plan, submit required reports to the City Engineer and verify compliance with Chapter 11.06 of the
Carlsbad Municipal Code.

Prior to hauling dirt or construction materials to any proposed construction site within this project the developer
shall submit to and receive approval from the City Engineer
for the proposed haul route. The contractor shall comply with
all conditions and requirements the City Engineer may impose

Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
W That based on the evidence presented at the public hearing, the Commission
RECOMMENDS APPROVAL of Precise Development Plan Amendment
PDP l(D), based on the following findings and subject to the following
conditions:

1. The Planning Commission finds that the project, as conditioned herein, is in
conformance with the Elements of the City’s General Plan, based on the following:
a. Land Use - The proposed use (modular offke unit) is consistent with the
City’s General Plan in that the subject site is designated for Pubiic Utility
uses.
b. Circulation - The existing circulation system is adequate to handle all
traffic generated by the existing use, and the proposed use will not
generate significant additional traffic.
2. The project is consistent with the City-Wide Facilities and Improvements Plan, the
applicable local facilities management.plan, and all City public facility policies and
ordinances since:
a. All necessary public improvements have been provided or are required as
conditions of approval.
3. This project has been conditioned to comply with any requirement approved as part of
the Local Facilities Management Plan for Zone 3.
4. The Planning Director has determined that the project is exempt from the
requirements of the California Environmental Quality Act (CEQA) per Section
15301(c) of the State CEQA Guidelines and will not have any adverse significant
impact on the environment.
5. The project is consistent with the P-U Zone regulations based on the following:

the modular building will be painted to match the existing adjacent office
building, (2) it will be low in scale (12’ maximum height), (3) it will be
adequately screened from Avenida Encinas by an existing fence and
landscaping, and (4) it will not generate any additional traffic.

The conditions of approval contained herein shall be in addition to the previous
conditions of approval. All previous conditions of PDP l(C), Planning Commission
Resolution No. 2830, shall remain in effect and shall be complied with in their
entirety.
The Planning Commission does hereby RECOMMEND APPROVAL of the Precise
Development Plan Amendment for the modular office project entitled Encina
Modular Offrce (Exhibits “A” - “B” dated October 2, 1996, on file in the Planning
Department and incorporated by this reference), subject to the conditions herein set
forth. Staff is author&d and directed to make, or require Developer to make, all
corrections and modifications to the Precise Development Plan Amendment
documents, as necessary, to make them internally consistent and in conformity with
final action on the project. Development shall occur substantially as shown in the
approved Exhibits. Any proposed development substantially different from this
approval, shall require an amendment to this approval.
The Developer shall comply with all applicable provisions of federal, state and local
ordinances in effect at the time of building permit issuance.
The Developer shall provide the City with a reproducible 24” x 36”, mylar copy of
the Precise Development Plan Amendment as approved by the final decision
making body. The Precise Development Plan Amendment shall reflect the
conditions of approval by the City. The Plan copy shall be submitted to the City
Engineer and approved prior to building, grading, final map or improvement plan
submittal, whichever occurs first.
The Developer shall include, as part of the plans submitted for any permit plan check,
a reduced legible version of the approving resolution on a 24” x 36” blueline
drawing. Said blueline drawing(s) shall also include a copy of any applicable Coastal
Development Permit and signed approved site plan.
This project shah comply with all conditions and mitigation measures which are
required as part of the Zone 3 Local Facilities Management Plan and any amendments
made to that plan prior to the issuance of building permits.
No outdoor storage of material shall occur onsite unless required by the Fire Chief. In
such instance a storage plan will be submitted for approval by the Fire Chief and the
Planning Director. *

9. This project is approved for a time period of seven (7) years or until the existing
office facility is remodeled, whichever occurs first.

10. If any of the foregoing conditions fail to occur; or if they are, by their terms, to be
implemented and maintained over time; if any of such conditions fail to be so
implemented and maintained according to their terms, the City shall have the right to
revoke or modify all approvals herein granted; deny or further condition issuance of
all future building permits; deny, revoke or further condition all certificates of
occupancy issued under the authority of approvals herein granted; institute and
prosecute litigation to compel their compliance with said conditions or seek damages
for their violation. No vested rights are gamed by Developer or a successor in interest
by the City’s approval of this Precise Development Plan Amendment.

approval for a Precise Development Plan Amendment and a Coastal Development Permit to allow
the replacement of an existing pump station, and construction of an associated electrical
equipment building within the Encina Water Pollution Control Facility on the east side of Avenida
Encinas between Palomar Airport Road and Poinsettia Lane, and within Local Facilities
Management Zone 3.
Commissioner Welshons stated that she had received some additional information upon which she would
be basing her vote. She stated that she had asked staff whether there is an operational risk of an
overflow, is there a catch basin, is there a possibility of an accidental spill, and asked Mr. Wayne to please
state the answer she was given.
Mr. Wayne replied that staff had received a letter from the Engineer in charge, stating that this is treated
sewage (not raw sewage) that goes through this pump station. Actually, this pump station is an upgrade
of an existing temporary pump station. In the case of a failure of the pump or a break in the line, the entire
wet well would fill up and then would empty back into the source and therefore not spill out.
Commissioner Welshons stated that Mr. Wayne’s explanation satisfied her concerns regarding any risk.
Mr. Wayne announced that the Commission’s action on this item is not final and will be forwarded to City
Council for its consideration.
ACTION: Motion by Commissioner Welshons, and duly seconded, to adopt Planning
Commission Resolutions No. 4544 and 4545, recommending approval of Precise
Development Plan Amendment (PDP l(E)) and Coastal Development Permit
(CDP 98-82) based upon the findings and subject to the conditions contained
therein, including the errata sheet dated April 16, 1999.

DESCRIPTION:
Request for Precise Development Plan Amendment and a Coastal Development Permit to
allow the replacement of an existing pump station and construction of an associated
electrical building within the Encina Water Pollution Control Facility.
LOCATION:
This project is within the City of Carlsbad’s Coastal Zone located on the east side of
Avenida Encinas between Palomar Airport Road and Poinsettia Lane and within Local
Facilities Management Zone 3.

A public hearing on the above proposed project will be held by the City Council in the Council
Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, on DATE? at 6:00 p.m.
Persons are cordially invited to attend the public hearing and provide the decision makers with
any oral or written comments they may have regarding the project. The project will be described
and a staff recommendation given, followed by public testimony, questions and a decision.

APPEALS
The time within which you may judicially challenge this Precise Development Plan Amendment
and Coastal Development Permit, if approved, is established by state law and/or city ordinance,
and is very short. If you challenge the Precise Development Plan Amendment and/or Coastal
Development Permit in court, you may be limited to raising only those issues you or someone
else raised at the public hearing described in this notice, or in written correspondence delivered
to the City of Carlsbad prior to the public hearing.
1. Anneals to the Citv Council: Where the decision is appealable to the City Council,
appeals must be filed in writing within ten (10) calendar days after a decision by the
Planning Commission.
2. Coastal Commission Appealable Project:

Where the decision is appealable to the Coastal Commission, appeals must be filed with the
