CLK OR SOLICITATION OF MATERIALS ON SIDEWALKS 3ECOMMENDED ACTION: 67 iiiFqT CITY ATTY - CITY MGR. - Adopt Ordinance No. NS-499, amending Title 8, Chapter 8.28 of the Carlsbad Municipal Code, by the addition of Section 8.28.070 to specify the location and conditions for distribution or solicitation of materials on sidewalks. ITEM EXPLANATION Ordinance No. NS-499 was introduced and first read at the City Council meeting held on July 13, 1999. The second reading allows the City Council to adopt the ordinance which would then become effective in thirty days. (This section will remain in efict for one yearporn its effective date, and shall sunset automatically unless extended or amended by the City Council prior to that time.) The City Clerk will have the ordinance published within fifteen days, if adopted. FISCAL IMPACT See Agenda Bill No. 15,3 15 on file with the City Clerk. EXHIBITS 1. NS-499 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING CHAPTER 8.28 SPECIFYING THE LOCATION AND CONDITIONS FOR DISTRIBUTION OR SOLICITATION OF MATERIALS ON SIDEWALKS. WHEREAS, the City Council, at its meeting of September 28, 1998, considered a request by the North County Times to amend Chapter 8.28 of the 6 Carlsbad Municipal Code to permit the hawking of newspapers under certain g circumstances at certain locations; and 10 WHEREAS, the City Council referred the request to staff for a report and 11 recommendation; and 12 13 WHEREAS, the City Council considered the report and recommendation at its regular meeting of March 9, 1999 and, at that meeting, formed an ad hoc 14 15 subcommittee of the City Council consisting of Council Members Kulchin and Nygaard 16 to further study and make recommendations; and 17 WHEREAS, the ad hoc subcommittee held a meeting with persons 16 interested in this issue to consider their recommendations; and 19 20 WHEREAS, the ad hoc subcommittee has completed its study and deliberations and makes its recommendations in the agenda bill associated with this 21 22 I/ item, 23 NOW, THEREFORE, the City Council of the City of Carlsbad Code does 24 ordain as follows: 25 SECTION 1: That section 8.28.070 is added to the Carlsbad Municipal to 26 read as follows: 27 26 1 2 3 4 5 6 7' 6 9 10 11 12 2 g mwo, 227 280 8 13 OWgj AILCJ SOS4 14 &fE 9 CrqB 15 st;g# oZJ? 16 ccoc=n 03a k m aW2 g-3 l7 u 18 19 20 21 22 23 24 25 26 27 28 “8.28.070 Distribution or solicitation of materials on sidewalks. A. Notwithstanding sections 8.28.050 and 8.28.060, the distribution or soliciting materials to vehicles shall be permitted in the following locations and under the following conditions: 1. On the sidewalks adjacent to those roadways with speed limits of 35 miles per hour or less as shown on Exhibit “A”. 2. That where those roadways intersect another roadway where the speed limit is greater than 35 miles per hour, such activity shall be prohibited within 100 feet of that location. 3. That such activity shall be prohibited within the commercial visitor serving overlay zone as shown on Exhibit “B”. 4. Prohibited anywhere on La Costa Avenue. B. There shall not be more than one person conducting such activity at the quadrant of any intersection specified above. C. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption.
