RECOMMENDED ACTION:
Adopt Ordinance No. NS-502, amending Section 21.05.030 of the Carlsbad Municipal Code,
by amending the zoning map to grant a zone change and local coastal program amendment to
change the zoning from L-C to R-1-7,500-Q on property generally located on the east side of
Black Rail Road, south of Poinsettia Lane and north of Aviara Parkway, in Local Facilities
Management Zone 20.
ITEM EXPLANATION
Ordinance No. NS-502 was introduced and first read at the City Council meeting held on
August 10, 1999. The second reading allows the City Council to adopt the ordinance which
would then become effective in thirty days. (Noth withstanding the preceding, this ordinance
shall not be eflective within the City’s Coastal Zone until approved by the California Coastal
Commission.) The City Clerk will have the ordinance published within fifteen days, if
adopted.

AMENDMENT CHANGING THE PROPERTY’S ZONING

The City Council of the City of Carlsbad, California, does ordain as follows:
SECTION I: That Section 21.050.30 of the Carlsbad Municipal Code, being the
zoning map, is amended as shown on Exhibit “BB” attached hereto and made a part hereof.
SECTION 2: When effective, this ordinance will also constitute an amendment
to the Local Coastal Program Land Use Map as shown on Exhibit “CC” attached to Planning
Commission Resolution No. 4575 and made a part hereof.
EFFECTIVE DATE: This ordinance shall be effective thirty days after its
adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be
published at least once in a publication of general circulation in the City of Carlsbad within
fifteen days after its adoption. (Not withstanding the preceding, this ordinance shall not be
effective within the City’s Coastal Zone until approved by the California Coastal Commission.)
INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City
Council on the 10th day of August 1999, and thereafter.
