RECOMMENDED ACTION:
Adopt Resolution No. 99 -304 accepting bids and awarding a contract for the traffic signal at Aviara Parkway and Poinsettia Lane, Project No. 3588.
ITEM EXPLANATION:
On May 18, 1999, the City Council approved the plans and specifications for the traffic signals at Aviara Parkway and Poinsettia Lane, and directed the City Clerk to advertise for construction bids. On July 22, 1999, the following four (4) sealed bids were received:
1. HMS Construction $108,980 2. Lekos Electric, Inc. $120,000
3. DBX. Inc. $121 .ooo
4. T&M’Electric, Inc. DBA Perry Electric 1 $127,000 1
The Engineer’s Estimate for the traffic signal is $100,000. Currently, traffic signal contractors are very busy and in heavy demand due to numerous traffic signals being installed throughout San Diego County, resulting in higher bid prices. Bids for the project have been reviewed and
analyzed. The lowest responsible bidder is HMS Construction, at $108,980. Staff, therefore,
recommends the award of the contract to HMS Construction.
ENVIRONMENTAL REVIEW:
This project is categorically exempt from the environmental review process under the provisions of the California Environmental Quality Act (CEQA) Section 15301 Class l(f). A Notice of Exemption has been issued by the Planning Director on June 22, 1998.
FISCAL IMPACT:
The project cost breakdown is as follows:

The original estimate for this project allocated $125,000 for the total project. To date, funds in the amount of $123,147 are available for this project. Total additional funding required for this project is $13,078. Thus, staff is requesting an additional appropriation of $13,078 from the Public Facilities
Fees Fund (PFF).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS, AWARDING
A CONTRACT AND APPROPRIATING ADDITIONAL FUNDS FOR
THE TRAFFIC SIGNALS AT AVIARA PARKWAY AND
POINSETTIA LANE. PROJECT NO. 3588.
WHEREAS, the City Council of the City of Carlsbad, California, has determined it
6 necessary, desirable, and in the public interest to construct the traffic signal at Aviara Parkway
7 and Poinsettia Lane; and
8 WHEREAS, four (4) sealed bids were received on July 22, 1999 for the project; and
9 WHEREAS, the lowest responsive, responsible bid for the project was submitted by HMS
10 Construction, in the amount of $108,980; and
11 WHEREAS, additional funds in the amount of $13,078 are required to cover the cost of
,2 the project; and
13 WHEREAS, additional funds in the amount of $13,078 are available in the Public Facilities
,4 Fees Fund (PFF).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 15 California, as follows:
16 1. That the above recitations are true and correct.
17 2. That the low bid submitted by HMS Construction in the amount of $108,980 is
l8 hereby accepted and the Mayor is hereby authorized to execute a contract on behalf of the City
19 for the traffic signal at Aviara Parkway and Poinsettia Lane.
20 3. That the City Manager is hereby authorized to approve construction change
21 orders up to $16,347.

4. That the award of this contract is contingent upon the bidder submitting the lowest
responsive bid executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within twenty (20) days of adoption of this resolution. The
City Manager may grant reasonable extensions of time.
5. That the Finance Director is authorized to appropriate $13,078 from the Public
Facilities Fees Fund (PFF).
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 14 day of September , 1999 by the following vote, to wit:
