APPROVAL OF ADDITIONAL APPROPRIATIONS FOR FARADAY AVENUE GRADING AND DRAINAGE PROJECT PROJECT NO. 3593 RECOMMENDED ACTION: Adopt Resolution No. 94 - 3 13 appropriating additional funds for the construction of the grading and drainage improvements for Faraday Avenue, Project No. 3593. Adopt Resolution No. 9 ‘-? - 3 I 8 approving Amendment No. 1 to an Agreement for Geotechnical Services during the Rough Grading Faraday Avenue Grading and Drainage Project, Project No. 3593 with Leighton and Associates, Inc. Adopt Resolution No. 99 -3/y approving Amendment No. 4 to an Agreement for Design Services for Faraday Avenue Extension for Improvement Plans, Project Specifications and Cost Estimates, Project No. 3593, with O’Day Consultants, Inc. ITEM EXPLANATION: On April 27, 1999, the City Council awarded a contract in the amount of $1,580,057.72 to W. R. Connelly, Inc., for the grading and construction of the storm drain improvements for the Faraday Avenue extension from its current easterly terminus to future Cannon Road West. Several items recommended in the soils report were not identified in the contract and were ultimately required by the geotechnical engineer. These items include panel drains to be placed on the backcuts of the slopes to capture runoff from irrigation anticipated with the construction of the future park, horizontal drains to carry water captured from the panel drains to dedicated drainage structures, and additional buttress backcut required after unanticipated soils conditions were discovered during grading. Total cost for these additional is approximately $190,000. In addition, unanticipated subsurface soil conditions were encountered during grading and required additional removal of soil unsuitable for the roadway. Approximately 370,000 cubic yards of material was removed during the rough grading; the engineer’s estimate was 126,000 cubic yards. The additional cost for this work is estimated at $500,000. The additional remedial grading and the method of excavation used by the contractor to perform the work necessitated use of a full-time on-site geologist. In addition, survey services for quantification of the grading quantities was much greater than originally anticipated. The total estimated increase in project costs is $690,000. Contingency funds are available to cover the additional $190,000 increase, and therefore staff is requesting an additional $500,000 appropriation to pay for the estimated increase in grading costs. ENVIRONMENTAL REVIEW: The Planning Director has determined that the requested action is consistent with prior CEQA review. The project was reviewed in the Mitigated Negative Declaration, approved on September 8, 1998. Significant environmental impacts identified by those CEQA documents were determined to be mitigable to levels of less than significant. All permits from the resource agencies have been received. . RECITALS WHEREAS, the initial agreement, dated Auaust 26, 1999 identified a scope of work to provide the necessary services for preparation of as-graded plans and reports of the rough grading for Faraday Avenue; and WHEREAS, the parties to this aforementioned agreement desire to alter the scope of work as follows: Increase Task II to $61,870 an increase of $46,270 for observations during rough grading; and WHEREAS, the scope of work and fee schedule have been negotiated and agreed to between the parties hereto, and as shown on Exhibit “A” Scope of Services and Fee in the original agreement; NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, City and Contractor hereby agree as follows: 1. Contractor shall provide services as outlined on Exhibit “A” in the original agreement. 2.
