RECOMMENDED ACTION:
Adopt Resolution No. 94 - 3 13 appropriating additional funds for the construction of the grading and drainage improvements for Faraday Avenue, Project No. 3593.
Adopt Resolution No. 9 ‘-? - 3 I 8 approving Amendment No. 1 to an Agreement for Geotechnical
Services during the Rough Grading Faraday Avenue Grading and Drainage Project, Project No.
3593 with Leighton and Associates, Inc.
Adopt Resolution No. 99 -3/y approving Amendment No. 4 to an Agreement for Design
Services for Faraday Avenue Extension for Improvement Plans, Project Specifications and Cost
Estimates, Project No. 3593, with O’Day Consultants, Inc.
ITEM EXPLANATION:
On April 27, 1999, the City Council awarded a contract in the amount of $1,580,057.72 to
W. R. Connelly, Inc., for the grading and construction of the storm drain improvements for the Faraday Avenue extension from its current easterly terminus to future Cannon Road West.
Several items recommended in the soils report were not identified in the contract and were
ultimately required by the geotechnical engineer. These items include panel drains to be placed on
the backcuts of the slopes to capture runoff from irrigation anticipated with the construction of the
future park, horizontal drains to carry water captured from the panel drains to dedicated drainage
structures, and additional buttress backcut required after unanticipated soils conditions were
discovered during grading. Total cost for these additional is approximately $190,000.
In addition, unanticipated subsurface soil conditions were encountered during grading and required
additional removal of soil unsuitable for the roadway. Approximately 370,000 cubic yards of material
was removed during the rough grading; the engineer’s estimate was 126,000 cubic yards. The additional cost for this work is estimated at $500,000.
The additional remedial grading and the method of excavation used by the contractor to perform the
work necessitated use of a full-time on-site geologist. In addition, survey services for quantification
of the grading quantities was much greater than originally anticipated.
The total estimated increase in project costs is $690,000. Contingency funds are available to cover
the additional $190,000 increase, and therefore staff is requesting an additional $500,000
appropriation to pay for the estimated increase in grading costs.
ENVIRONMENTAL REVIEW:
The Planning Director has determined that the requested action is consistent with prior CEQA review. The project was reviewed in the Mitigated Negative Declaration, approved on September 8, 1998. Significant environmental impacts identified by those CEQA documents were determined to be mitigable to levels of less than significant. All permits from the resource agencies
have been received.

FISCAL IMPACT:
Staff recommends an additional appropriation of $500,000 from CFD #I to fund increased costs
incurred during the rough grading construction phase of the project. Sufficient CFD#l funds are
available for this appropriation.

5 WHEREAS, the City Council of the City of Carlsbad, California, has determined
6 it necessary and in the public interest to approve and accept an agreement with Leighton and
7 Associates, Inc., for geotechnical services during the rough grading of the Faraday Avenue
8 Grading and Drainage Project; and
WHEREAS, Leighton and Associates, Inc., is the geotechnical engineer of record for the
9 Faraday Avenue Grading and Drainage project and was selected as best qualified during the
10 design of the project, staff is recommending Leighton and Associates, Inc., as the best qualified
” firm to perform the geotechnical services during the construction of the Faraday Avenue project
I2 based on their experience and expertise on similar types of project; and
13 WHEREAS, an agreement has been previously executed for $24,950; and
14 WHEREAS, additional work was required due to the nature of the soils encountered
l5 during the rough grading; and
16 WHEREAS, total project cost estimated for the geotechnical services is $74,950; and
17 WHEREAS, additional funds in the amount of $46,270 are available; and
WHEREAS, the Mayor is hereby authorized to execute the proposed Amendment No. 1 to 18
agreement for geotechnical services during the rough grading of Faraday Avenue with Leighton
19 and Associates, Inc.

AMENDMENT NO. 1 TO AGREEMENT FOR
GEOTECHNICAL SERVICES DURING ROUGH GRADING
FARADAY AVENUE GRADING AND DRAINAGE PROJECT
PROJECT NO. 3593
This Amendment is entered into and effective as of the 14 th day of
SerAernber I 199A, amending the agreement dated Auaus t 26. 1 qqq by and
between the City of Carlsbad, a municipal corporation, hereinafter referred to as “City”, and
Leighton and Associates, Inc., a California corporation, hereinafter referred to as, “Contractor”
for preparation of as-graded plans and reports of the rough grading for Faraday Avenue.
RECITALS
WHEREAS, the initial agreement, dated Auaust 26, 1999 identified a scope
of work to provide the necessary services for preparation of as-graded plans and reports of the
rough grading for Faraday Avenue; and
WHEREAS, the parties to this aforementioned agreement desire to alter the
scope of work as follows: Increase Task II to $61,870 an increase of $46,270 for observations
during rough grading; and
WHEREAS, the scope of work and fee schedule have been negotiated and
agreed to between the parties hereto, and as shown on Exhibit “A” Scope of Services and Fee
in the original agreement;
NOW, THEREFORE, in consideration of these recitals and the mutual covenants
contained herein, City and Contractor hereby agree as follows:
1. Contractor shall provide services as outlined on Exhibit “A” in the original
agreement.
2. City shall pay Contractor for all work associated with Paragraph 1 above,
on a time and materials basis not-to-exceed $46,270. Contractor shall provide City on a monthly
basis, copies of invoices sufficiently detailed to include hours performed, hourly rates, and
related activities and costs for approval by City.

3. Contractor shall complete all work outlined on Exhibit “A” in the original
agreement by expiration of the agreement amended hereby.
4. All other provisions of the aforementioned agreement entered into on
Auaust 26, 1999 , by and between City and Contractor shall remain in full force and effect.
5. All requisite insurance policies to be maintained by the Contractor shall
include coverage for the amended assignment and scope of work.

scope of work as follows: provide additional surveying and survey support services to
determine earthwork volumes during the rough grading of Faraday Avenue; and
WHEREAS, a supplemental scope of work and fee schedule have been
negotiated and agreed to between the parties hereto, and as shown on Exhibit “D” Scope of
Services and Fee attached to Amendment No. 3 and incorporated herein by reference;
NOW, THEREFORE, in consideration of these recitals and the mutual covenants
