CITY MGR h That the Council INTRODUCE Ordinance No. NS- 50s , CommercialNisitor- amending the Serving Overlay Zone, and ADOPT Resolution No. 59 -322, APPROVING the Local Coastal Program Amendment to accept and administer the Coastal Commission’s suggested modifications. ITEM EXPLANATION: On May 18, 1999, the City Council approved the Commercial/Visitor-Serving Overlay Zone. All of the Overlay Zone’s affected properties are also in the City’s Coastal Zone. In order to effectuate the Overlay Zone ordinance, the companion local coastal program amendment was submitted to, and processed by, the California Coastal Commission. At the August 12, 1999 Coastal Commission hearings in Los Angeles, action was taken to approve the Overlay Zone with one suggested modification. The modification affects the wording of one sentence in the ordinance as shown on attached Exhibit 2. The Coastal Commission felt it necessary to modify the wording because the existing wording appeared to lower the priority for commercial/visitor-serving uses in the coastal zone by limiting them to conditional uses as opposed to permitted uses. Staff countered that by making commercial/visitor-serving uses conditional, the city was able to apply new permit procedures and development standards and that similar wording to that proposed by the Commission was contained in the next subsection of the ordinance. Nevertheless, the Coastal Commission voted unanimously to approve the Overlay Zone with the suggested modification. Upon Council’s approval of the modification, Coastal Commission staff will be notified so that the Coastal Commission may acknowledge the City’s modification acceptance at the September Coastal Commission hearings. At that time, the Executive Director will report to the Coastal Commission that the City’s actions conform to the provisions of the Coastal Commission’s action to certify the LCPA with suggested modifications. The Overlay Zone ordinance will then become effective as the standard for review of all City issued coastal development permits within the overlay zone. FISCAL IMPACT: The approval and processing of the Coastal Commission’s suggested modification will not have any fiscal impacts other than staff time to process the item with the Coastal Commission and their staff. CASE NAME: COASTAL COMMISSION MODIFICATIONS TO THE COMMERCIALNISITOR-SERVING OVERLAY ZONE CASE NO.: LCPA 98-05(A)/ZCA 98-01 (A) WHEREAS, California State law requires that the Local Coastal Program, General Plan and Zoning designations for properties in the Coastal Zone be in conformance; and WHEREAS, the City approved LCPA 98-05 and ZCA 98-01 to establish a Commercial/Visitor-Serving Overlay Zone within certain portions of the City’s coastal zone on May 18,1999; and WHEREAS, on August 12, 1999, the California Coastal Commission approved said LCP/ZCA amendment with “suggested modifications”; and WHEREAS, the City of Carlsbad has received “suggested modifications” from the California Coastal Commission for the Commercial/Visitor-Serving Overlay Zone as set forth in this resolution; and WHEREAS, acceptance of the Coastal Commission’s “suggested modifications” and the agreement to administer them is necessary to comply with the California Coastal Act and California Administrative Code; and WHEREAS, a verified application for an amendment to Carlsbad’s Local Coastal Program and zone code are on file with the City’s Planning Department; and WHEREAS, said application constitutes a request for a local coastal program and zone code amendment as shown on Exhibit “LCPA 98-05(A) and ZCA 98-01(A)” dated September 14, 1999, attached herein, as provided in Public Resources Code Section 30574 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Article 15 of Chapter 8, Subchapter 2, Division 5.5, Title 14 of the California Code of Regulations (California Coastal Commission Administrative Regulations) and; WHEREAS, the City Council did on the 14thday of September , 1999, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the City Council considered all factors relating to the Local Coastal Program Amendment. follows: The City Council of the City of Carlsbad, California, does hereby resolve as 1. That the above recitations are true and correct. 2. That based on the evidence presented at the public hearing, the Council APPROVES Local Coastal Program Amendment LCPA 98-05(A), and Zone Code Amendment ZCA 98-01 (A), dated September 14, 1999, attached hereto as a new ordinance, which effectuates City acceptance of the Coastal Commission’s “ suggested modifications” based on the following findings: Findinqs: 1. That the proposed Amendments are required in order to accept the suggested modifications approved by the California Coastal Commission on August 12, 1999. 2. That acceptance of the proposed “suggested modifications” is necessary by the City in order to comply with the California Administrative Code Segments 13544 and 13551. 3. That the proposed amendment will retain consistency between the City zone code and its Local Coastal Program. 4. Such a document does not exist because the Coastal Commission staff report for the Overlay Zone dated July 19 and received by Planning on July 26, 1999, recommends that the Coastal Commission approve the LCP amendment a sm; modifications were not part of the initial staff recommendation as reflected on their distributed staff report. The modification was first presented by Deborah Lee as part of the staff presentation at the Coastal Commission hearing and she acknowledged that no modifications w8r8 SUggeSted in the Staff report but that a last minute issue led staff to propose the modification. The only written acknowledgment that I received about th8 modification was a two page fax transmittal wherein the prOpOS8d wording changes were hand written in. I will fax these two pages to you asap. Given the above, and per Michael’s concurrence, I will not be preparing an overhead unless you/Michael direct me otherwise. In its action, the Commission adopted the addition to the Carlsbad Implementation Plan with a modification addressing the amendment’s conformance with the certified Local Coastal Program Land Use Plan. The attached modification contains the specific changes adopted by the Commission. Before the amendment request can become effectively certified, the Executive Director must determine that implementation of the approved amendment will be consistent with the Commission’s certification order. This is necessary because the amendment was eertifkd with suggested modifications. In order for the Executive Director to make this determination, the local government must formally acknowledge receipt of the Commission’s resolution of certification, including any terms or suggested modifications; and take any formal action which is required to satisfy them, such as rezonings or other ordinance revisions. As soon as the necessary documentation is received in this office and accepted, the Executive Director will report his/her determination to the Commission at its next regularly scheduled public hearing.
