RECOMMENDED ACTION:
Adopt Resolution No. 4 9 -45? accepting the construction of the 1998 Street Sealing
Project, Project No. 36671, as complete and directing the City Clerk to record a Notice of
Completion and release bonds in accordance with State Law and City Ordinances and
transfer of funds.
ITEM EXPLANATION:
On, November 3, 1998, American Asphalt Repair and Resurfacing Company, Inc., was
awarded a contract in the amount of $514,991 for construction of the 1998 Street Sealing
Project.
American Asphalt Repair and Resurfacing Company, Inc. completed the work on June 23,
1999. City forces have inspected said work and found it to be satisfactory. Staff
recommends formal acceptance by the City Council.
FISCAL IMPACT:
The contingency amount originally appropriated for the project was exceeded by approximately
$8,000 due to overages in contract bid items for rubberized emulsion aggregate slurry and crack seal as well as change orders approved during construction. However, the administration and
inspection component is under by approximately $20,500 resulting in unused appropriations of
$12,500.

RESOLUTION NO. 99-453
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING THE CONSTRUCTION
OF THE 1998 STREET SEALING PROJECT, PROJECT NO. 36671 AND TRANSFER OF FUNDS.
WHEREAS, the construction of the 1998 Street Sealing Project has been satisfactorily
completed; and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
WHEREAS, insufficient funds in the construction budget require transfer of $15,000
from the administration/inspection budget to the construction budget.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carl&ad,
California, as follows:
1. That the above recitations are true and correct.
2. That the construction of the 1998 Street Sealing Project, specifically identified as
Project No. 36671, is deemed complete and hereby accepted.
3. The City Clerk of the City of Carlsbad is hereby authorized and directed to execute
the Notice of Completion and have same recorded.
4. That bonds will be released in accordance with State Law and City Or$inances.
5. That transfer of $15,000 from the administration/inspection budget to the
construction budget is approved.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 5 day of October , 1999 by the following vote, to wit:
