ITEM EXPLANATION:
The drainage easement on Lot 230 of Laguna Riviera has never been utilized. During construction
of the Laguna Riviera project, the storm drain facilities were placed in a drainage easement on the adjacent Lot 229.
The drainage easement on Lot 230 is no longer necessary and staff recommends that Council
approve the quitclaim requested by Mr. & Mrs. Ronald J. Mello.

RESOLUTION NO. 99-478
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING QUITCLAIM FOR A
DRAINAGE EASEMENT OVER LOT 230 OF CARLSBAD TRACT
73-5. MAP NO. 7927.
WHEREAS, Ronald J. Mello and Margery G. Mello have submitted a request for quitclaim
of a drainage easement originally dedicated to the City per Carlsbad Tract No. 73-5 over a
portion of their property located at 4902 Neblina Drive; and
WHEREAS, said easement was never utilized for the purpose for which it was granted
and is not now nor is it contemplated to be needed for drainage purposes; and,
WHEREAS, the City Council of the City of Carlsbad has determined it to be in the public
interest to quitclaim said easement; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Quitclaim Deed conveying a drainage easement over a portion of Lot
230, Map No. 7927 of Carlsbad Tract No 73-5, to Ronald J. Mello & Margery G. Mello, which is
on file with the City Clerk and is incorporated by this reference, is approved.
3. That the Mayor is authorized to execute the deed and the City Clerk is hereby
authorized to release the original Quitclaim Deed to Ronald J. Mello and Margety G. Mello.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 2nd day of November , 1999 by the following vote, to wit:
AYES: Council Members Lewis, Hall, Finnila, Nygaard and Kulchin
