ESTABLISHMENT OF PRIMA FACIE

RECOMMENDED ACTION:
Adopt Ordinance No. NS-5 11, amending Title 10, Chapter 10.44, of the Carlsbad Municipal
Code, by the amendment of Section 10.44.070, to establish a 55 mile per hour prima facie
speed limit upon La Costa Avenue fkom Interstate Highway 5 to its intersection with El
Camino Real.
ITEM EXPLANATION
Ordinance No. NS-511 was introduced and first read at the City Council meeting held on
October 26, 1999. The second reading allows the City Council to adopt the ordinance which
would then become effective in thirty days. The City Clerk will have the ordinance published
within fifteen days, if adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION 10.44.070 TO ESTABLISH A PRIMA FACIE 55 MILE PER HOUR SPEED LIMIT UPON LA COSTA AVENUE FROM INTERSTATE HIGHWAY 5 TO ITS INTERSECTION WITH EL CAMINO REAL.
6 The City Council of the City of Carlsbad, California, hereby ordains as follows:
7 SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
8 by the revision of Section 10.44.070 to read as follows:
9 “10.44070 La Costa Avenue:
Upon La Costa Avenue from El Camino Real to a point one 10 kousand feet easterly the prima facie speed limit shall be thirty-five miles per hour.

b. Upon La Costa Avenue from a point one thousand feet easterly of El Camino Real to its intersection with Camino de 10s Caches the prima facie speed limit shall be forty-five miles per hour.
Upon La Costa Avenue from Interstate Highway 5 to its itersection with El Camino Real the prima facie speed limit shall be fifty-five miles per hour.”
15 EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption
16 and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to
17 be published at least once in a newspaper of general circulation in the City of Carlsbad within
16 fifteen (15) days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the
19 26th day of October , 1999, and thereafter,
20 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
21 held on the 2nd day of November , 1999 by the following vote, to wit:
