HomeMy WebLinkAbout1999-11-02; City Council; 15475; Amend Code Regarding Officers & Employee BondsCITY-.OF CARLSBAD - AGENM BILL AMENDMENT OF MUNICIPAL CODE REGARDING CITY ATTY c-r OFFICERS’ AND EMPLOYEES’ BONDS RECOMMENDED ACTION: Adopt Ordinance No. NS-510, amending Title 2, Section 2.08.040 of the Carlsbad Municipal Code to: allow the requirement for Officers’ and Employees’ bonds to be met by a master bond applicable to all city officers and employees; require faithful performance coverage for the City Clerk, City Treasurer, and Finance Director; and authorize annual premium payment. ITEM EXPLANATION Ordinance No. NS-5 10 was introduced and first read at the City Council meeting held on October 26, 1999. The second reading allows the City Council to adopt the ordinance which would then become effective in thirty days. The City Clerk will have the ordinance published within fifteen days, if adopted. NS-510 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING SECTION 2.08.040 OF THE CARLSBAD MUNICIPAL CODE PERTAINING TO OFFICERS’ AND EMPLOYEES’ BONDS The City Council of the City of Carlsbad, California does ordain as follows: SECTION I: That section 2.08.040 of the Carlsbad Municipal Code is amended to read as follows: “2.08.040 Officers and employees bonds. (a) Wherever individual bonds are required for specified officers or employees of the City, they may be provided in the form of a master official bond applicable to all other City officers and employees. (b) The City Clerk, City Treasurer and Finance Director, shall provide honesty and faithful discharge bonds regarding the duties imposed on their offices, . . . . . . . . . . . . . . . . . . .- T -- 1 2 3, 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 -. in the amount recommended by the City Attorney pursuant to Government Code section 36518 and as set forth in a resolution adopted by the City Council. (c) The Finance Director is authorized and directed to pay the premium annually for any official bonds authorized or required by this section.” EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption.
