RECOMMENDED ACTIONS:
1. Adopt Resolution No. 97- $f+ forming the Citizens Committee to Study the Tree
Policy.
2. Adopt Resolution No. 97-98’’ forming the citizens Committee to Study the
Sidewalk and Street Improvement Program.
3. Amend Council Policy No. 4 prohibiting the removal of any trees from El Camino Real west
to the Ocean between Agua Hedionda and Buena Vista Lagoons (the “study area”) without
the approval of the City Council pending action on the Citizens Committee reports and
recommendations.
4. Adopt Urgency Ordinance No. /Vs-s/$ pursuant to Government Code section
36937(b) by a four-fifihs vote of the City Council prohibiting the issuance of building or
grading permits and requirement of improvements under Title 18.
5. Introduce Ordinance No. Ns-s/f prohibiting the issuance of building or grading
permits and requirement of improvements under Title 18.
ADDITIONAL CONSIDERATION
If the Council wishes to extend the moratorium to the issuance of building or grading permits
for other discretionary approvals under Titles 20 and 21, adopt Urgency Ordinance No.
pursuant to Government Code section 65858 by four-fifths vote of the City
Council prohibiting the issuance of building or grading permits for subdivisions in the study
area.

ITEM EXPLANATION:
At its meeting of October 19, 1999, after careful consideration of the report and
recommendations regarding the issues raised by the Citizens for the Preservation of Olde
Carlsbad, the City Council directed the City Attorney to return with documents implementing
the Council’s decisions. At that meeting the Council determined the following:
0 To appoint a citizens committee to review existing tree policies and make
recommendations for appropriate revisions.
0 To form a citizens committee to review the sidewalk and street improvement program and
propose a list of streets to receive special designations and unique design treatment.

Until the Committee to Study the Tree Policy has completed its work, to prohibit the
removal of any street tree within the study area without approval of the City Council.
Amend Chapter 18.40 prohibiting the issuance of building or grading permits and the
requirement of improvements until the Citizens Committee to Study Sidewalks and Street
Improvement Program has completed its work and the Council has received and acted on
its recommendations.
TREE POLICY
After having received public testimony at its meetings of September 28, 1999 and October
19, 1999, and having considered the staff recommendation at its meeting of October 19,
1999 the City Council determined that the 1970 tree policy needed review and further
determined to appoint a citizens committee to review it and make recommendations for
appropriate changes.
It further determined that, for the study area (El Camino Real west to the Ocean between
Agua Hedionda and Buena Vista Lagoons), that no tree would be removed without its
approval. The Council adopted a minute motion amending the Council Policy Statement ##4
for Street Trees. A copy of the revised document is attached as Exhibit 3.
The Council further determined that the Citizens Committee should be appointed to
expeditiously study and make recommendations to the Council for revisions in that policy.
The Committee is to be provided the necessary and appropriate resources and staff
personnel to complete its work and make its report to the City Council early next year.
The attached resolution specifies the duration, powers and duties of that committee.
SIDEWALKS PROGRAM:
At this meeting, the City Council reviewed its Pedestrian Action Plan adopted in 1988. This
plan identified the need to inventory sidewalks and identify missing segments throughout the
City. A program to construct missing critical sidewalk links was adopted by the City Council
in 1989 and funds have been budgeted each year to construct priority critical links. The
Council further reviewed the Carlsbad Sidewalk Program (Agenda Bill 15,446, dated
10/19/99, Exhibit 2) indicating the sidewalks that have been constructed in the study area (El
Camino Real west to the ocean between Agua Hedionda and Buena Vista Lagoons). In
many cases the additional sidewalks constructed were being done so between already
existing improvements; for example, providing access to Carlsbad schools. Furthermore
some streets, such as Buena Vista Way, Adams Street, Highland Drive and Crest Drive have
been budgeted for special studies.
The Council determined that the concept that standard street improvements may be
inappropriate on certain streets of special character should be further considered by a
Citizens Committee. The assignment of the Citizens Committee will be to review the
Sidewalk and Street Improvement Program objectives and priorities and to evaluate certain
streets for special designation. Resolution No. specifies the term, powers
and duties of that committee.

MORATORI U M :
The Council further determined that pending the Committee’s report on Sidewalk and Street
Improvements under Chapter 18.40, that a moratorium be declared on such requirements

and the

issuance of building or grading permits. Attacheu for Council’s consideration is
Ordinance No. NS-fi4 and regular Ordinance No. &‘’-fix for
and introduction, respectively, giving legal effect to that determination.
These ordinances do not apply to subdivisions. Chapter 18.40 establishes standards and
requirements for improvements in connection with the development of land in which no
subdivision is involved. If the Council wishes to prohibit the issuance of building or gradin
permits in subdivisions in the study area, then its action is to adopt Ordinance No. &V-S’l
pursuant to Government Code section 65858 which permits the Council to adopt an interim
ordinance prohibiting the issuance of building or grading permits which may be in conflict with
a contemplated General Plan or zoning proposal which it intends to study within a
reasonable time. The urgency ordinance requires a four-fifths vote of the Council and is
effective for 45 days and may be extended after notice and a public hearing for an additional
ten months and 15 days.
The prohibition on building or grading permits in the study area would impact only those
projects not subject to discretionary approval and where street improvements have not
already been installed.
FISCAL IMPACT:
There will be expenditures of staff time and necessary supplies, equipment, materials and
experts in order that the Committee’s may complete their work expeditiously in an amount
which will depend on the frequency of their meetings. It is estimated that approximately
$50,000 will be required for consultant services to support the two citizen committees.
ENVIRONMENTAL REVIEW:
The formation of the Committees and adoption of the ordinances are intended to facilitate
information collection and studies and will not result in any adverse environmental impacts at
this stage and are therefore categorically exempt under CEQA pursuant to regulations 15262
and 16306.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, FORMING A CITIZENS COMMITTEE
TO STUDY STREET TREES IN THE PUBLIC RIGHT OF WAY IN
THE AREA WEST OF EL CAMINO REAL TO THE OCEAN
BETWEEN AGUA HEDIONDA AND BUENA VISTA
LAGOONS
WHEREAS, the City Council adopted its Council Policy Statement on
Street Trees on October 20, 1970; and
WHEREAS, the City Council has determined that that policy needs to be
reviewed, updated and changed, as appropriate; and
WHEREAS, the City Council held meetings on September 28, 1999
and October 19, 1999 receiving public input and staff recommendations; and
WHEREAS, the City Council has determined that pending a study and
report from this Committee, no street trees within the public right of way shall be
removed without its permission; and
WHEREAS, the Committee is directed to consider all relevant issues in
formulating its recommendations to the City Council including but not limited to,
aesthetics, neighborhood compatibility and preferences, safety, liability, environmental
impacts, and to consider all applicable laws, including but not limited to Americans with
Disabilities Act, Clean Water Act and the like,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitals are true and correct.
2. There is hereby formed a Citizens Committee to Study the City's Tree
Policy (attached as Exhibit A) not to exceed 15 members and after careful study and
consideration of all appropriate and relevant information including public input, it shall
make its report and recommendations to the City Council. Its report shall recommend a
policy for the planting, maintenance and removal of trees in the public right of way. It is
expected that this process shall be completed early next year and after delivering its
report and recommendations, the Committee’s work is completed and shall be
automatically dissolved unless another Council resolution extends it.
3. The meetings of the Citizens Committee shall be open and public and
any person may attend. The Committee shall select a chairperson from its members
and shall conduct its meetings in general conformance to City Council procedures. It
shall allow a reasonable comment period on each of its meetings for public comment.
4. The Committee shall be given all necessary support, supplies,
materials, assistance of experts, and other resources necessary for the expeditious
completion of its work. The Public Works Director or his designee shall be an ex-officio
member of the Committee and shall attend all of its meetings and assist it in the
conduct of its business.
5. The Committee shall make its report to the City Council by December
15, 1999 unless at the request of the Committee it is impractical to do so and the
Council has determined a different date.

PURPOSE:
To state City policy regarding removai and replacement of street trees.

The City will make every effort to trim and spray street trees according.to a regular schedule within the limits of available man powe r .
Dangerous street trees will be removed and replaced as expedi- tiously as possible. Dead trees will be removed and replaced, as work schedules permit, as will trees that are damaging side- walks, curbs and gutters.
Replacement street trees.wi11 be of the same species as those removed unless an.other species of street tree is designated on the master street tree plan.
Individuals or neighborhoods may request replacement of street trees by another species due to excess leaf drop, blockage of view, medical allergies (a doctor's certification may be re- quested where allergies are cited) or other good and sufficient reasons. In these cases the individual or neighborhood must bear the cost of removal and replacement since no general public in- terest is served. Except where allergies are indicated, the re- placement trees must be uniform and of an improved species unless otherwise approved by the Parks and Recreation Commission.
Any citizen or neighborhood may appeal to the Parks and Recrea- tion Commission and subsequently to the City Council regarding a staff decision on street trees. However, official City policy is to discourage removal of existing street trees simply on the basis of individual or group preference between species of trees.

THE ISSUANCE OF BUILDING AND GRADING PERMITS
IN SUBDIVISIONS FROM EL CAMINO REAL WEST TO
THE OCEAN BETWEEN AGUA HEDIONDA AND BUENA
VISTA LAGOONS PENDING A REPORT AND
RECOMMENDATIONS OF THE CITIZENS COMMITTEE
TO STUDY SIDEWALK AND STREET IMPROVEMENT
STANDARDS
WHEREAS, the City Council received testimony and considered the
issues of sidewalks and street improvement standards at its meetings of September 28,
1999 and October 19,1999; and
WHEREAS, the City Council carefully considered these issues and the
recommendations of its staff; and
WHEREAS, there are a number of pending subdivisions which would be
subject to the improvement standards in Chapter 20; and
WHEREAS, the construction of improvements would change the
character of the neighborhood and cause needless expense and inconvenience if those
improvements were later determined to be unnecessary or inappropriate; and
WHEREAS, the City Council has determined to study the General Plan
street design standards; and
WHEREAS, the City Council determined to appoint a citizens committee
to study the issue; and
WHEREAS, the committee has been directed to study this issue
expeditiously and to make its report and recommendations in a timely manner; and

WHEREAS, Government Code section 65858 authorizes the City Council
to adopt, as an urgency measure, an interim ordinance prohibiting such development
approvals for 45 days by a four-fifths vote; and
WHEREAS, Government Code section 65858 authorizes extension of
said emergency interim ordinance, after notice and hearing, by a four-fifths vote for up
to IO (ten) months and 15 (fifteen) days; and may be subsequently extended once for
up to one additional year; and
WHEREAS, alternatively, the City Council adopts this urgency measure
pursuant to Government Code sections 36934 and 36937 for the immediate
preservation of the public peace, health or safety based on the facts as set forth in the
recitals to this ordinance and the facts contained in Agenda Bill No. /5 976 and
the facts as elicited at the public hearings of September 28, 1999 and October 19,
1999; and
WHEREAS, the City Council has determined for the reasons stated above
that such potential development represents a current and immediate threat to the public
health, safety and welfare,
NOW, therefore, the City Council of the City of Carlsbad does ordain as
follows:
SECTION 1 : That the above recitals are true and correct.

Hedionda and Buena Vista Lagoons pending a report and recommendations of the

b) Notwithstanding the above, upon written request of the property
owner, a building permit or grading permit, or both, may be issued when the
improvement requirements required by Chapter 20 would not be incompatible with the
neighborhood as determined by the City Council.
c) This ordinance does not apply to discretionary approvals where
building or grading permits have previously been issued or where significant
infrastructure improvements have been made.
SECTION 3: On or before 45 days following the adoption of this
ordinance, the City Council shall hold a public hearing to consider extending this
ordinance for 10 (ten) months and 15 (fifteen) days pursuant to Government Code
section 65858(a). The City Clerk is directed to notice the hearings as required by
Government Code section 65090.
SECTION 4: The City Council may amend this ordinance from time to
time if it finds there are changed circumstances in the facts that led to its adoption.
DECLARATION OF URGENCY: This ordinance is hereby declared to
be an emergency ordinance adopted as an urgency measure to protect the public
health, safety and welfare and shall take effect immediately upon its adoption. The

EFFECTIVE DATE: This ordinance shall be effective immediately upon
passage and shall be of no further force and effect after 45 days of the date of its
adoption unless extended by the City Council according to law. At least ten days prior

to the expiration of this interim ordinance, the City Council shall issue a written report
describing the measures it has taken to alleviate the conditions which lead to the
adoption of this ordinance. The City Clerk of the City of Carlsbad shall certify to the
adoption of this ordinance and cause it to be published once in a newspaper of general
circulation in the City of Carlsbad within fifteen days after its adoption.

PURPOSE:
To state City Policy regarding removal and replacement of street trees.
PO Ll CY:
1. The City will make every effort to trim and spray street trees according to a regular schedule
within the limits of available manpower.
2. Dangerous street trees will be removed and replaced as expeditiously as possible. Dead
trees will be removed and replaced, as work schedules permit, as will trees that are
damaging sidewalks, curbs and gutters.
3. Replacement street trees will be of the same species as those removed unless another
species of street tree is designated on the master street tree plan.
4. Individuals or neighborhoods may request replacement of street trees by another species
due to excess leaf drop, blockage of view, medical allergies (a doctor‘s certification may be
requested where allergies are cites), or other good and sufficient reasons. In these cases
the individual or neighborhood must bear the cost of removal and replacement since no
general public interest is served. Except where allergies are indicated, the replacement
trees must be uniform and of an improved species unless othewise approved by the Parks
and Recreation Commission.
5. Any citizen or neighborhood may appeal to the Parks and Recreation Commission and
subsequently to the City Council regarding a staff decision on street trees. However, official
City policy is to discourage removal of existing street trees simply on the basis of individual
or group preference between species of trees.
6. Notwithstanding the “Removal” provisions of Parks and Recreation Department Policy No.
31 , for the area bounded by El Camino Real on the east, the Pacific Ocean on the West
between Agua Hedionda and Buena Vista Lagoons, pending the report and
recommendations of the Citizen’s Committee to Study Trees, no City street trees shall be
removed without approval of the City Council.

sidewalks in “Olde” Carlsbad in response to a mtion by CPOC and also stated that a
committee would be formed to study the issue. You asked for recommendations for

project be exempted from the “Olde Carlsbad” moratorium. I called your office and was
informed that you were out of the office both Thursday and Friday. I talked to Ron Ball, and
asked that the permits be released today. He told me that the entire City Council would have to
vote on the status of the project.

I would like to add some additional information to the letter you received yesterday. It was
brought to my attention that the engineering staff wanted the particular design for the Chinquapin
improvement plans that has been approved. In our effort to cooperate with the City we applied for
a variance for the home located at 156 Chinquapin so that the bulb of the cul-de-sac would work
as designed. This request added two months to the approval process and made it necessary for us
to design a special plan to fit on the lot.

SUBJECT: AV 99-03 - BEACH KING LOT CONSOLIDATION
The Planning Director has completed a review of your application for an
Administrative Variance, AV 99-03, to reduce the front and rear yard setbacks to
15 feet on property generally located on the north side of the western terminus of
Chinquapin Avenue. After caretui consideration of the circumstances surrounding
this request, the Planning Director has determined that the four findings required for
granting an Administrative Variance can be made and therefore, approves this
request based on the following findings and conditions.
Findinas:
1. There are exceptional or extraordinary circumstances or conditions applicable
to the property or to the intended use that do not apply generally to the other
property or class of use in the same vicinity and zone. Lots 5 and 6 of parcel
map no. 1747 have been required to dedicate land for the construction of a
cul-de-sac bulb for the western terminus of Chinquapin Avenue. The cul-de-
sac bulb is offset to the north requiring a larger than typical amount of
dedication. The two lots have been adjusted to create one lot as the
individual lots would be too small to support a single-family residence. The
remainder of the lot is too shallow to accommodate a home typical of those
planned on the adjacent lots. The lot, because of the consolidation, is twice
as wide as the adjacent thus requiring twice the required rear yard setback as
the adjacent lot. The property is further encumbered by an access easement
granted to the adjacent lot to the west. This lot fronts on Carlsbad Blvd. and
is precluded access f rom Carlsbad Blvd. The extraordinary circumstances
and conditions created by the dedication of property for public roadways and
access easement justify the modification of the required front yard setback.
2. The requested variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone but which is denied to the property in question because other
surrounding properties have unconstrained lots which allow for the
development of reasonable sized homes consistent with the development
standards of the R-3 zone.
3. The granting of this variance would not be materially detrimental to dhe
public welfare or injurious to the property or improvements in the vicinity and

zone in which the property is located because the rear yard setback would be
equal or greater than provided if the lots were unconstrained. The front yard
setback reduction would not negatively effect surrounding property values
nor would it impact public safety in that motorists traveling along the street
frontage would continue to have good visibility. In addition, the integrity of
the neighborhood street scene would not be compromised. The subject
property fronts on a cul-de-sac bulb which places the building farther back
from the street center line than other homes fronting the street, even with
the reduced front yard. Since the subject property's home would still fall
behind the "string line" of homes fronting the linear portion of the street, the
overall effects of the reduced set backs would be minimized.
4. The granting of this variance will not adversely affect the comprehensive
General Plan because the property is land use designated as residential and is
being developed with a residential single-family home.
Conditions:
1. All development, including improvements shown on
submittals, shall be to the satisfaction of the Planning

The Applicant owns various parcels along Chinquapin Avenue.

Chinquapin Avenue including the dedication of additional street right-of-way
for future construction of a cul-de-sac.

lots 5, 6, and 7 has resulted in a substantial reduction in the depth and areas
of Lots 5 and 6.

Dear Mr. Ponder:
Pursuant to our conversation regarding Adjustment Plat 525 referred to in
Appendix B of our application, I spoke with Van Lynch of the City of Carlsbad
Planning Department regarding your request for copies of the staff report and
resolutions. Van indicated that they did not necessarily have either but felt that
by sending you copies of the Certificate of Compliance, recorded November 12,
1998 and the Grant Deed of Easement recorded January 15,1999 that it would
show compliance as far as the city was concerned.
As I indicated in our phone conversation, the adjustment had more effect on Lots
5 and 6 of this subdivision rather Lots 7 and 8 , which are a part of the above
reference application. Originally, it was our intent to file the application for all of our holdings located north of Chinquapin Avenue at one time, thus the reference
to Adjustment Plat 525 by the City on the Appendix €3 form. Since the time that
the City had filled out the form, we have had to omit Lots 5 and 6 from our
application due to the fact that we are currently applying for a set back variance
with the City. We intend to submit an application on Lots 5 and 6 once we are
further along with our variance application.

Thank you and the members of the Council for forming the two
advisory committees concerning the trees and safe footing for pedestrians in the Northwest Quadrant.
Unfortunately, I am only able to drive only during daylight hours
so I am not applying to serve.
However, I will attend the daytime meetings as a very interested
citizen. The 12th anniversary of the Pedestrian Action Plan may
be a memorable one.
I believe the Village atmosphere can be preserved as well as
safety for pedestrians be provided.
The cooperation of the COPD and the Council is a beautiful
example of democracy at work.

hcron rookcrics arc locatcd in Sau Dicgo County. Onc is locatcd on thc grounds of thc North
Island Naval Air Base and the second is located in the many tall Torrey Pines around Highland
and Oak streets in Carlsbad.
For this reason, we would strongly oppose any plan that would jeopardize this important breeding

CITIZENS FOR THE PRESERVATION OF OLDE CARLSBAD- (CPOC) PETITION.
This memo attempts to respond to of the CPOC letter and petition (see attached) item
by item. These items were addressed completely in the October 19, 1999, staff report
but not in a point by point format. The staff report was intended to address all of the
testimony received at the September 28, 1999, council meeting which raised many
more issues than those identified on the petition.
It should be noted that the five points differ from the description contained on the
petition. It is not clear who CPOC is although one could assume that it is those people
who signed the letter. The letter identifies 5 items which will be addressed individually.
1. Direct the city staff to draft an emergency ordinance to exempt the area bounded by
Wilson Street, Forest Avenue, Crest Drive and Buena Vista Way from any street
widening , street dedications, tree removal, or “future improvement agreements”,
Staff did not recognize this area specifically for special treatment however,
recommended that no street widening would be ordered without notifying the
council. Staff opposed waiver of dedication and future improvement agreement
requirements in this or any other area of the city .
Council directed a moratorium on building permits which results in the imposition
of a moratorium on street widening, street dedications, tree removal or “future
improvement agreements”, in this area and the larger “Olde Carlsbad “ area,
that are subject to the requirements of Titlel8. This action accomplishes what
was requested, but restricted building permits in addition.
2. Direct staff to study the feasibility of expanding the emergency ordinance to the rest
of I‘ Olde Carlsbad”, this area being defined as the area bounded by Buena Vista
Lagoon, El Camino Real, Aqua Hedionda Lagoon and the Pacific Ocean ( with
exceptions as defined in our petition)
Council directed a uniform policy to include the designated “Olde Carlsbad” area
and established a Citizens Committee, to recommend streets for designation as
special design streets.
3. Direct staff to prepare a cost / benefits analysis and identify funding sources to
properly maintain existing trees within the right - of - way in “Olde Carlsbad”.
Council approved staff recommendation to form a committee to study the tree
policy. The committee can request information relative to cost / benefit of
maintenance of trees and funding mechanisms.
4. Direct staff to prepare an analysis of the costs and benefits of discontinuing its
policy of removing trees within the existing right - of - ways in “Olde Carlsbad”, and
instead use alternative methods for risk management such as tree wells, concrete
pavers, flexible walking surfaces and grass lined walking surfaces.
Council approved a tree policy committee to study this issue and review these
policy alternatives.
5. Immediately discontinue all street tree removal until hearings are completed before
the Council.
Council adopted this policy until the tree policy committee completes its work and
the Council takes action. Council did reserve the right to approve individual tree
removal where in its judgement the public interest is best served.
On October 26, 1999, Mr. Gary Piro representing CPOC submitted a letter to Council
with four additional requests.
1. CPOC Action Request. * At no time in the presentation given by your staff did they
address our report. Specifically, we would like your staff to acknowledge our
specific five (5) action item request. We would also like them to respond to the
information we have provided such as documentation and publications pertaining to
statistics showing that narrower streets have less accidents.
The five actions are addressed above.
Mr. Piro submitted a number of reports. This information was transmitted to the
Transportation Division of the Engineering Department. This information and
other relevant studies will be made available to the Streets and Sidewalk
Committee for its consideration.
2. Wilson Street. Fores t Avenue. Cres t Drive and Buena Vista Way: The Owners of
this area were led to believe that they could be given an exemption of F.I.A. and
dedication requirements if they received 100% support. We provided 100% support
petitions for this area and would like the Council to give us a decision, yes or no.
This area serves a very low traffic volume and road widening is impossible since it
would require removal of front yards, removal of structures and in many instances
makes it impossible for residents to get into their garages. For clarification of the
problem, we have marked off the area of existing required improvements for you to
see visually for yourself.
Staff has no knowledge of this representation. The Municipal Code as
currently written would not allow this approach. These four streets and
many others can be considered by the Streets and Sidewalk Committee
for special treatment. No improvements will be one alternative ultimately
explored.
* On October 19, nowhere in your motion did you address dedication
requirements. We feel that this should be addressed by your staff as part of any
future studies.

Staff would propose that a report be prepared for council consideration on
both the dedication and improvement requirements stipulated in Title 18 of
the Municipal Code.
.. 4. Bull-torium : Although we appreciate your sympathy on October 19, and
believe that Councilmember Kulchin's motion was meant to help us, we are,
however, cateaorically opposed to a building moratorium. The motion, as made,
would make the situation worse in that it will allow developer / builders to go ahead
and widen roads that we may wish to be left alone. Furthermore, existing owners
who had the right to remodel their homes and execute an F.I.A. which might not be
implemented later could have signed a document in the past, however now they will
be held up.
If you decide to refer to the matter to the committee, a better motion would be to put
a moratorium on all road widening required as a condition of a building permit and
instead give a blanket approval of an F.I.A. with no dedication . There would then be
no need for a moratorium on building permits and homeowners wishing to improve
remodel could proceed while the study was being done. These owners could even
sign the F.I.A. "under protest" to protect them should the committee determine that
the improvements were not necessary.
This is not a question but rather a position statement. It is not dissimilar to the
original staff recommendation that was opposed in testimony October 19. Staff
can support the liberal granting of F.I.A.'s during the period of study. It was
however requested that Council reserve the right to allow installation where the
public interest is serve such as in areas where gaps exist or in the areas in
proximity of schools, churches, parks, or other places of public assembly.
Staff does not support waivers of dedication requirements. If it is found that
standard thirty foot half width dedications are not required Council can quit claim
the rights of way back to the property owner.
Staff does not support the signing of F.I.A.3 under protest. This would be the
equivalent of an illegal wavier of the requirement. If it is determined that no
improvements are required the agreement may be discharged in the future at
Council direction. Hopefully this clarifies staffs response to the issue raised.

Attached you will find petitions which cover every property in the area of “Olde
Carlsbad” bounded by Wilson Street, Forest Avenue, Crest Drive and Buena Vista Way.
Because we are concerned about city policies which threaten the high quality of life we
currently enjoy in our community and neighborhoods, we have formed a group called
“Citizens for the Presenation of Olde Carlsbad” ( C.P.O.C.) and are requesting a hearing
before the Council on Tuesday, September 28 to discuss your cun-ent road improvement
policies in residential neighborhoods, specifically the area known as “Olde Carlsbad”
which lies west of El Camino Real.
More specifically, at that hearing, we are requesting that the Council take the following
action:
1. Direct the city staff to draft an emergency ordinance to exempt the area
bounded by Wilson Street,
from any street widening,
improvement agreements”.
2. Direct staffto study the feasibility of expanding the emergency ordinance to
the rest of “Olde Carlsbad”, this area being defined as the area bounded by

C.P.O.C. understands that the City Council has the responsibility to maintain a sound
fiscal policy. We also believe that no public official intends to implement policies
which harm our community character. We believe that many of the
intendedimplemented “improvements” made in the last 10 years have resulted in
irreparable damage. If such “improvements: continue, the result will be irreparable
damage to our community character and quality of life. C.P.O.C. is also submitting for
your review significant research to show that urbanization of established residential
neighborhoods can result in increased incidents of accidents, increased maintenance
costs, increased urban runoff, and reduced property values. In fact, studies show that,
ironically, there are 50% fewer severe accidents on narrow, three shrouded “shared
streets” than on standard residential streets with curbs and sidewalks. On these “shared
streets: the driver perceives that he is entering a zone where the pedestrian has
preeminent privileges.
c.P.0.c.’~ research has determined that Carlsbad’s policy of urban improvements is one
of the most aggressive in the greater San Diego area. We can find no other agency which
does not allow any trees in the right of way of new developments, we can find no other
agency which requires the installation of 30 foot “half width” improvements for a
$50,000 home remodel, and we can find no other agency which has such an aggressive
policy of tree removal in established residential neighborhoods. Does Carlsbad want to
be a leader in ?he field of urbanizing established residential neighborhoods or does
Carlsbad want to be a leader in preservation?
There is precedent in the ordinance proposed. Encinitas has a specific plan area where
certain streets will not be widened. The Fallbrook Community Plan allows for
developers to waive curbs, gutters, and sidewalks on small lot subdivisions, “Olde Del
Mar” mandates no street widening.
Preservation minded cities like Charleston, S.C. and Annapolis, MD are among the
leading tourist areas in the country, whereas the Amish area of Pennsylvania is suffering
due to sprawling developments with wide streets surrounding old villages.

STREET IMPROVEMENT POLICY
Whereas the City of Carlsbad is implementing an aggressive policy of requiring Urban Type
“Improvements”(mch as street tree removal; construction of curbs, guttersJ sidewalks,
paved streets over 24feet wide; excessive dedications and Future Improvement Agreements)
in ow “Olde Carlsbad” residential neighborhood3 ad...
Whereas we, the residents of Carlsbad are concerned with the impact that this policy is
having on the character andsalty of our “Olde Carlsbad” communi ty...
Now tkrefore, we the undersigned hereby request the Council to adopt an emergency
ordinance immediately suspending these requirements and to direct staff to prepare a City
Policy which would discontinue the current requirements for Urban Improvements in the
residential areas of “Olde Carlsbad”. This area is defined as the area bounded by Buena
Vista Lagoon, El Camino Real, Agua Hedionda Lagoon and the Pacific Ocean, (excluding
the Beach and Redevelopment Areas). The only exceptions to this policy would be as
follows:
