RECOMMENDED ACTION:
Adopt Resolution No. 99-500 rejecting all bids, authorizing the re-advertisement for new bids
for the widening of Palomar Airport Road from El Camino Real to Melrose Drive, and authorizing
additional appropriation, Project 3602.
ITEM EXPLANATION:
On August 17, 1999, the City Council approved the plans and specifications and authorized the
advertisement for bids for the widening of Palomar Airport Road from El Camino Real easterly to
Melrose Drive. Eastbound Palomar Airport Road is being widened to full prime arterial standards
from El Camino Real easterly to Melrose Drive except for median landscaping and irrigation,
sidewalks and streetlights on the south side, which will be required when the frontage is developed.
Construction will include a third eastbound lane and an additional left-turn lane, eastbound on
Palomar Airport Road to northbound at the El Fuerte Street intersection.
On October 14, 1999, the Purchasing Department received twelve sealed bids as follows:
The City received a formal letter of bid protest on October 21, 1999 from the second low bidder,
Southland Paving, addressing two alleged errors in the bid from the low bidder Hanson SJH
Construction and protesting the award of the contract to Hanson SJH Construction. The first alleged
error on the part of the low bidder was on bid item 3, mobilization and preparatory work. The
specifications stated this bid item amount should not exceed $15,000. The low bidder presented a
bid of $40,350. The second alleged error was on bid item 17, a lump sum item for signing and
striping, and bid items 40 through 46 which were unit price items for the same work of signing and
striping. When the City realized the duplication of bid items on the day before bid opening, all
bidders were called and instructed to put all of their costs for final signing and striping in the lump
sum bid item 17 and to enter zero in bid items 40 through 46. The low bidder entered a lump sum
price of $22,600 for bid item 17 and a unit price of $0.01 for bid items 40 through 45 and $175 for
bid item 46 resulting in a total bid for bid items 40 through 46 of $2,197.50.

After consultation with the City Attorney’s office, staff recommends that the City Council follow the
provisions of California Public Contracts Code Section 20166, et. seq. and reject all bids received on
October 14th and re-advertise for new bids for the project. The California Public Contracts Code
empowers the City, in its discretion, to reject all bids without findings of fact or fault. Staff feels this
recommendation is appropriate since the City’s specifications and directives apparently contributed to
the alleged errors in the low bid.
City staff has taken steps to further clarify the specific requirements in the bid forms to reduce the
potential for dispute in the future. Staff recommends the City Council adopt the accompanying resolution which will formalize the rejection of the current bids and authorize the advertisement of new bids for the widening of Palomar Airport Road.
ENVIRONMENTAL REVIEW:
The potential impacts have been reviewed consistent with CEQA. Project 3602 was determined to
be within the scope of the environmental analysis for PCD/GPC 90-5. A Mitigated Negative Declaration (EIA 91-14) was issued for PCD/GPC 90-5 and the Planning Director has issued a
notice of prior compliance on June 10, 1999.
FISCAL IMPACT:
The following is an estimate of the of the total costs for this project:
Design Engineering $150,000
Administration and Appraisals $60,000
Miscellaneous $40,000
Construction $720,000
Inspection and Contract Management $100,000
Construction Contingencies (15%) $110,000
TOTAL $1.200.000
This project has an existing appropriation from TransNetILocal funds in the amount of $610,000. Staff recommends an additional appropriation from the General Capital Construction fund in the
amount of $590,000 to equal the total estimated cost of $1.2 million. Sufficient funds are available for the additional appropriation.
An agreement entered into on July 15, 1992 between the City and Bank of America National Trust and Savings Association, as Trustee of the Mary E. Bressi Trust (dated June 2, 1968) requires Lennar-Bressi Ranch to reimburse the City for the cost of the third eastbound lane when they
develop their property. The exact amount of the reimbursement will be calculated once the
construction is complete and the final costs are known.
The City hired Anderson & Brabant to appraise the right-of-way required for the additional left-turn
lane portion of this project, Their report provided a value of $31,000 for the necessary right-of-way.
The property owner, Lennar-Bressi Ranch, has signed the right-of-way documents in exchange for
(1) utility sleeves and (2) replacing the majority of asphalt berm with concrete curb and gutter. The
City has agreed with this exchange and will construct as many of the two items as possible up to a maximum of $31,000. The City’s estimate for these two items equals $70,000 and, therefore, exceeds $31,000. The Lennar-Bressi Ranch will be required to provide a check to the City in the amount of the difference in cost or the City will reduce some of these items of work before this
contract is awarded

6 WHEREAS, the City Council of the City of Carlsbad has previously approved the plans
? and authorized the advertisement for bids for the widening of Palomar Airport Road from
6 El Camino Real to Melrose Drive, Project No. 3602; and
9 WHEREAS, the City Council does hereby find that the project is in prior compliance with
10 Mitigated Negative Declaration EIA 91-14; and
11 WHEREAS, twelve (12) sealed bids were received on October 14, 1999 by the City of
12 Carlsbad for widening of Palomar Airport Road, Project No. 3602 and were thereafter reviewed
13 for said project; and
14 WHEREAS, with respect to all twelve said bids, the City hereby finds it necessary,
15 desirable, and in the public interest to follow the provisions of California Public Contracts Code
1s Section 20166, et. seq. whereby the City, in its discretion, may reject all bids and elect, in its
17 further discretion, to seek new bids for said project; and
16 WHEREAS, the City Council of the City of Carlsbad has previously appropriated a portion
19 of the funds for this project and will hereby appropriate additional funds to this project; and
20 WHEREAS, plans and specifications as modified for the widening of Palomar Airport Road
21 from El Camino Real to Melrose Drive, Project No. 3602 have been prepared and are on file in
212 the Engineering Department of the City of Carlsbad and are incorporated by reference herein;
23 and
24 WHEREAS, the City Council hereby finds it necessary, desirable and in the public interest
25 to proceed with the advertisement of construction bids for the widening of Palomar Airport Road
26 from El Camino Real to Melrose Drive, Project No. 3602.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the City Council does hereby reject all twelve bids received on
October 14, 1999 for widening of Palomar Airport Road, Project No. 3602, in accordance with the
provisions of California Public Contracts Code Section 20166, et. seq.
3. That the City Council does hereby authorize the Purchasing Officer to return all bid
bonds received for this bid to the respective bidders.
4. That plans and specifications as modified for the widening of Palomar Airport Road
from El Camino Real to Melrose Drive, Project No. 3602, are hereby approved.
5. That the City Clerk of the City of Carlsbad is hereby authorized and directed to
proceed to publish, in accordance with law, Notice to Contractors inviting bids for the construction
of the widening of Palomar Airport Road, Project No. 3602, in accordance with the plans and
specifications hereinabove referred to.
6. That an additional appropriation from the General Capital Construction Fund in the
amount of $590,000 is hereby approved.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 16thdayof NOVEMBER , 1999 by the following vote, to wit:
