RECOMMENDED ACTION: Adopt Resolution No. 99-506 accepting bids and awarding Project No. 3593-Z for the construction of Faraday Avenue Street Improvements to MJ Koch, Inc./El Cajon Grading & Engineering, Inc., Joint Venture. ITEM EXPLANATION: This project involves the construction of Faraday Avenue from its existing westerly terminus to Cannon Road. Features of the construction include the construction of sewer, water, recycled water mains, streetlights, sidewalks, curb and gutter, an enhanced and landscaped median, a traffic signal at the intersection and roadway surface improvements. The grading, storm drain construction and slope landscaping were completed under a previous contract. Construction of the street improvements is expected to take nine months. On July 6, 1999, the City Council and the Board of Directors of the Carlsbad Municipal Water District of Carlsbad, in a joint meeting, approved the plans and specifications for the Faraday Avenue Extension (Street Improvements) and directed the City Clerk of the City Council and the Secretary of the Water Board to advertise for construction bids. On October 5, 1999, eight (8) bids were received. The lowest responsive bidder was MJ Koch, Inc./El Cajon Grading & Engineering, Inc., Joint Venture. TABLE 1 BIDS RECEIVED 1. Staff has reviewed the bid documents and the joint venture agreement and finds the lowest responsive and responsible bidder is MJ Koch, Inc./El Cajon Grading & Engineering, Inc., Joint Venture. Staff, therefore, recommends the award of the contract to MJ Koch, Inc./El Cajon Grading & Engineering, Inc., Joint Venture. ENVIRONMENTAL REVIEW: The Planning Director has determined that the requested action is consistent with prior CEQA review. The project was reviewed in the Mitigated Negative Declaration, approved on September 8, 1998. Significant environmental impacts identified by those CEQA documents were determined to be mitigable to levels of less than significant. Permits from the resource agencies are in the final stages of approval. WHEREAS, bids have been received by the City of Carlsbad for the construction of said 6 project; and 7 ’ WHEREAS, the low bid received to construct said project submitted by MJ Koch, Inc./El Cajon Grading & Engineering, Inc., Joint Venture, is responsive; and 9 WHEREAS, sufficient funds are available for construction, administration, and inspection 10 of said project; and 11 WHEREAS, Subsection 3.28.172(c)(l) of the Carlsbad Municipal Code authorizes the ,2 City Manager to approve changes orders in the amount equal to the contingency set at the time ,3 of the bid award. 14 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 15 1. That the above recitations are true and correct. 16 2. That the low bid of $2,513,301.55 submitted October 5, 1999 for Project No. 3593-2 17 for construction of the Faraday Avenue Extension (Street Improvements) is hereby accepted and 16 the Mayor is hereby authorized to execute a contract therefor. 19 3. That the award of this contract is contingent upon MJ Koch, Inc./El Cajon Grading & 20 Engineering, Inc., Joint Venture, executing the required contract and submitting the required 21 bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of 22 this resolution.
